Transcript Partial transcript
Machine transcription of the meeting recording. The words are the recognizer's, except where a passage is marked as corrected or machine re-recognized; most have
not been checked against the audio, so words, numbers and names can be misheard.
It describes what was said. It cannot establish who voted how, an amount or an outcome — the City's
minutes do that (above).
A time links to its passage, and “Copy link” copies that link. “▶ Play” opens the recording at that moment, on YouTube, in a new tab.
750 suspect passage(s) marked in place; inspection incomplete: language review; 3 stretch(es) where a voice was detected and no words were recognized.
How this transcript was made. New machine transcription of the whole recording, with 28 voices separated from the audio.
66 short machine repair(s) (80 word(s)) are labelled in place, with the original words beside them: an ordinary word was replaced only where two further machine readings agreed on a different one.
Checks run on this transcript: the recognizer's own warning signs and whether a voice was detected where the words are. Not completed: language review.
A second, independent machine reading was compared with it word by word: the same words for 91.0% of 27,506 content words.
Dotted words (768 places) are ordinary wording differences: hover or tap to see the other reading.
750 passages (25% of the words) are marked suspect: their words are not shown ("unclear audio") and support no statement: numbers, amounts, negation or names differ; the language review questioned them; or no voice was detected there.
Agreement between two machine readings is not verification.
Inspection is incomplete: language review.
Voice detected, no words recognized (3 stretches). Something may have been said here that the transcript does not have:
00:32:32 (8 s) — neither reading has words
00:34:07 (8 s) — neither reading has words
00:35:04 (8 s) — neither reading has words
Speakers were separated by voice. A plain name rests on evidence tied to that voice; “provisional” is a name from an earlier text-only pass and is not verified; “Speaker N” is an unidentified voice.

connected. And, that's really important that our city become more connected with these pathways. Now, this was the Florida Highway Administration that did the workshop. And, one of the takeaways for me was, I did not realize there was so much law behind there being the right of bicyclists and pedestrians on our streets. So, more and more, if you travel in other states, you'll see these bikeways as well.
So, I'm hoping that, you know, we're looking into right now taking Michigan Avenue, which is a county road. We're checking into whether or not they would be willing to let us have that, take charge of that road and create some more pathways there. So, I'll look forward to working with my other council members on that in the near future.

Thank you. We all know sometimes people look at sports as just kids running around and scoring touchdowns. But we all know that in football especially ‸ is about teamwork, commitment, adults also taking their time out to commit to these children. These kids are our future. They're five and six years old. Most of them are, what,
first grade. So for them to be undefeated and to dedicate all their time since probably June, July timeframe, eight to nine hours a week, is a great accomplishment. And we'd
to give them a round of applause before I call their names. The first name is the team manager. I'm pretty sure she kept the coaches in line with schedule. So Ms. Brittany Williams,

That means if the issue is to vote against the police, that's what they do. If it's to vote for the suspect, they do that. accepted three petitions of annexation on November 13th of this year. Staff notified property owners within the annexation area of the City's intent to annex their property along with the date and location of the two public hearings in which the item will be considered. ‸ Staff has confirmed with the Brevard County Supervisor of Elections that no registered electors currently reside in the proposed annexation area. Road. It comprises 59 parcels at 139.23 acres of real property, of which 43 parcels ‸ for 122.5 acres are consenting, and 16 parcels for 16.65 acres, which are non-consenting. The annexation is therefore consistent with the requirements of the Florida statute. The future land use designation and zoning classifications are not yet determined. That report also provided that analysis of the facilities available to serve the annexation study area determined that the City of Cocoa has and can provide necessary public facilities and services to serve the study area in the same manner as such services are provided within the rest of the City of Cocoa. The regulating plan describes this building type as a building lot located and designed to accommodate single-use office and retail. The second change would allow an increase in the maximum lot depth for this building type from 300 feet to 400 feet.

So that ordinance was in 2016, as I said. It changed the regulating plan to allow the single-story commercial buildings on those parcels in between east and westbound 520. And it was only those parcels within the Cocoa Village Sub-District.

which is probably my best guess as to why it wasn't included in the previous ordinance. However, the essential characteristics of those parcels and this subject parcel are essentially the same constraints ‸ that posed problems for the other parcels applies to this parcel. In addition, the historic character of the village is largely one to three-story buildings in height. So prohibiting single-story building height on the subject parcel is not consistent with a surrounding built environment. And in addition, allowing a single-story commercial building on the site ‸ would allow views into the Cocoa Village from westbound 520,
And it should also be noted that this change would, while it allows single-story commercial buildings on that parcel, there are a number of other building types that are currently allowed, ‸ and those would still be allowed.

Trying to discuss this because there's three right-of-ways ‸ surrounding this parcel, really four. And it's complex. And then it sits at the bottom of a valley, effectively, because of the bridge and then the hill along the ridge. So FDOT is concerned. And, of course, they have plans, you know, to try to do something to slow some of the traffic flow coming downhill, headed eastbound. So all those things are ‸ important. So we need a dialogue ‸ with FDOT. And we've been having that.

of the code of the city of Cocoa to establish civil penalties for the possession of cannabis marijuana for amounts under 20 grams and possession of drug paraphernalia, setting forth penalties and enforcement responsibilities for a violation of this code, providing for the repeal of prior and consistent ordinances and resolutions, incorporation into the code, severability, and an effective date. This is a second and final reading of this ordinance, also a public hearing item. They have not done any changes since first reading.
In English. This is an ordinance. The city council is considering establishing a civil penalty, not a criminal penalty, for possession of cannabis, marijuana, for amounts 20 grams or less, or drug paraphernalia. Can you hear?
ordinance provides technically an alternative to an arrest for police officers when dealing with individuals that are in possession of cannabis of 20 grams or less or drug paraphernalia. And the ordinance provides for community ‸ service ‸ in lieu of paying a fine. And there's a graduated penalty section for first violation, second violation, and third violations.

I have a comment. I want to make a comment because the last Mardi Gras that we had, I bought several VIP tickets. And nevertheless, to say that I was very disappointed with what I saw down there. And I guess the same individual is going to be putting this event on this year or next year.
I just, you know, Mardi Gras was something that the city would normally have individuals come in and submit, you know, their requests to put on the Mardi Gras and we would select them. They do like a three year deal or whatever. And so

Georgia Ave. I have lived in Broadmoor Acres for over 10 years now. And when we first moved here, it was awful. We had trash everywhere, rundown houses, people in the streets, all hours of the night. The first night that we lived in our new home, my husband was so tired and he decided to call for pizza. And the pizza company informed us that they would not deliver to our neighborhood. We asked, oh, after dark?
they said, no, never. Four days later, I had a helicopter spotlight in my yard looking for someone. I had criminals hiding in my yard. After that, we had our house surrounded by the police on numerous occasions for other people hiding in our yard. Neighbors didn't talk to each other. That was then. The neighbors now check in on each other. We call the police if we see suspicious activity. Code enforcement comes out regularly. We report all suspicious activity. Neighbors volunteer more, get involved.
out and visit all the neighborhood kids. He had elves to help him wrap gifts and we even had a local rest a restaurant open her doors after hours so everybody could do this.
This has taken a lot of commitment, a lot of time, and a few people who really care and got involved. Please go, please grant this extension. Let this amazing transformation continue in this neighborhood. I don't understand why the city wants to stop the progress and I don't understand why the people who do try and make a difference, it seems like the city's against them.
Good evening. Thank you, sir. My name is Derek McGillia. I live at [address]. I generally don't get involved in any type of political anything, but you know, when I heard about what's going on back up and them needing an extension, I figured I would just give my two cents. Yeah. And I moved down here in 2016. I got into the house and it was a crappy landlord that actually came ‸ and tried to present violence towards me by not following his made up rules.

then you had a lot of homes that were demolished. So, ‸ you know, when you demolish homes and certainly the crime rate is going to go down when you're, you know, and yes. Anyway, thank you, sir.
Yes, Mr. Mayor. I had had someone question the ethics of me being involved in voting on this issue because I sit on the board of directors at Broadmoor Acres. So, even though the city attorney felt that my voting was not a conflict of interest and we had had that discussion when this original agreement was initiated and I was able to vote on that ‸ initial ‸ agreement.
turkeys to try to find financing and people that are interested in investing in this neighborhood. Because I have no conflict of interest in voting on this issue, I would like to make a motion to approve this issue and move forward.
just trying to explain to him. He's going to answer. I'm just curious. And I just don't want this to come back later and be an issue that, you know what I'm saying? So
that's an excellent point. In this particular case, the way the law is written, because Councilwoman Warner is working as a board of director on a nonprofit organization and she is uncompensated. The law does not recognize that in the category of the voting conflicts law.
would not inure to her special private gain. It's a carve out of, like if this was a private corporation and she was a principal, we'd be having a ‸ totally different discussion. I mean, but this is a nonprofit organization where she serves as an uncompensated director. So, again, the law treats that differently as not presenting a voting conflict.
No. I mean, I don't want to speak for Councilwoman Warner, but, you know, she has advised me that she is an uncompensated director ‸ on that. And I ‸ take that, you know, ‸ as her word.
there is a voting conflict, it's presented and, you know, the person has a voting conflict and they voted anyway and the vote would not have prevailed but for that person's vote. So,
just went through this very same situation with NAACP with Yvonne Miners. She voted on financial donations to NAACP and the ethics. I guess there was in the thought of an ethics violation because she was a member or a board member of the NAACP. So, I'm just, I want this to pass, but I don't want to be an issue for a back grab later on either.

Okay, so we're going to switch gears totally and completely. You can't believe how much we can switch gears here. Okay. We need it. And I think everybody will be on board for that. Good evening, council. I'm Kathy from the sister city program of Cocoa, Florida.
wanted to bring you, update you on what we've got going on now. One of the most exciting programs I think we've ever done. Brief history. On February 21st of this year, Kennedy Space Center, SpaceX launched its Falcon 9 heavy lift rocket. And
moon mission. The moon lander built by a private Israeli nonprofit organization was given the name Bereshit, which means in the beginning. Some of you may recognize that the first words in the Bible. That's a Hebrew word. It was Israel's first attempt to get a launch above the Earth's orbit.

the moon, unfortunately, Israel is very interested in space exploration. This is the new hot thing in Israel. And Israel is aiming to be the fourth of only four countries in the world that have ever put a lander on the moon. The Soviet Union did that in 1966. We followed up later that same year. China did it in 2013.
million school children in Israel talking about space exploration. So their goals is to encourage young people in space exploration. So Israel has space fever.
think all of us can think of another area of the world that also has space fever somewhere around here. That would be us. So Sister City thought this is a great idea. We're going to bring together our two sister cities in an area that we both have a great interest in. So that's what we're doing. This year we've been

The plan for this project is to bring Israeli children from Beit Shemesh, Israel, our sister city, to study space together here in Brevard County at Kennedy Space Center. This is going to happen December 23rd through the 27th. Nine

Florida. They will together be attending KSC's International Space Camp, which is a five-day program that, yes, does go right through the week of Christmas, believe it or not.

And Sister City has spent the last many months raising this tuition for every single one of these students, both from our sister city and the local students here. So our locally, we have been involved. We have selected our students. Israel has selected their students. They are now busy getting their visas.
join us to meet the students and their families. We had representatives from Florida Today who created the documentary, The People of Apollo. They did a special screening of that video for our students. It's to start getting them really excited about this. Our students have also attended three one-hour space history classes put on by NASA veterans. So they are so excited to be doing this in December, ready to meet their Israeli counterparts in this really exciting venture, and something we've never done with Sister City. But it's our effort, just like Israel's, to encourage students in studying science, technology, engineering, and math.
And our kids on our end are excited to meet them and work with them on this five days of camp. So I wanted to leave with ‸ an invitation. Right here in Riverfront Park, December 22nd at the Hanukkah Musical Festival. All of the kids, both from Israel and from Brevard County, will be introduced from the stage. And they will do a robotics demonstration from the stage. We encourage everyone to attend.
and for all of these kids to be recognized, both from Israel and Brevard. So we invite everybody here to that event. And we're excited about it. And if anybody has any questions, I'm happy to answer.

So, my intention wasn't to speak or give comments this afternoon because earlier in the week, sorry, this document stated that the most responsible and responsive bidder, low bidder, was Rush Marine. So, when I got here tonight and pulled the agenda off the table, that has been now changed.
were three bid items that he did not submit with the bid package as required by the bid submission within the contract documents provided by the city of Cocoa. So, we're asking for your consideration to award this project to Rush Marine, which is the right thing to do based on the contract documents provided at bid time. There were no addendums to change the requirements or the bid submission package. And we followed the Bible, so to speak. And we feel that we should be the awarded contractor.
Staff reviewed all the bid submittals with legal and felt that the documents provided or left out by Canaveral was still sufficient to award the contract to them.
But the bid package states that you shall submit the items as part of the introduction to bidders. So, there were other contractors that were non-conforming because they didn't have something or they didn't sign something in the document.
think ‸ the bid documents also allow the city to waive minor irregularities regarding the bid, which is a standard paragraph. literally, ‸ sir, sir, sir, excuse me. But earlier at the CRA ‸ moving meeting, we had to move money out of fund balance in order to fund part of this. And we are doing a budget amendment related to this. So you did not have the budget numbers.
I'm going to make a motion that we go with the city recommendation. ‸ The only legal thing we can do right now because the money is not allocated for anything else.
The city, the city's, um, awards to the lowest and most responsive ‸ bidder. Okay. Now the city awards based on the RFQ, RFP that goes out on the street. Okay.
instructions to bidder. ‸ Some cases there are, uh, hiccups with the paperwork that's, that's submitted. The city's bid package allows the ‸ city to waive minor irregularities. Okay. They really are not material to the bid amount.
Just the instruction. Just the, ‸ and actually back up. And then the other, so those forms are in there. The lowest bidder didn't execute those documents.
Flag: numbers, amounts, negation or names differ between the machine readings · 02:43:26–02:43:27 · unresolved: the words are not shown (unclear audio); listen to the recording
And they didn't put it back in the package when they submitted it to the city. Okay. That doesn't mean, they're form agreements and form bonds. They're not the final contract and they're not the final bond. So regardless if you sign them, we're going to make you sign it again because there could be changes to the contract, changes to the bond, etc. So, staff determined that those two submittal irregularities were minor in nature and shouldn't go against that lowest bidder's bid, right? Because the, you know, the purpose of the bid process is to try to get, you
the best deal for the city. The other irregularity is that under the bid documents, as I understand it, there's an instructions to bidder. And it requires you just to submit the whole instructions of bidders back with your ‸ bid executed as you're agreeing or acknowledging the instructions. The lowest bidder submitted the signature page but didn't submit all of the pages for the instructions. And basically he didn't regurgitate them back to the city when he submitted his bid. He just gave the signature page. Those, as I understand it, are the three irregularities. And under those circumstances, staff is recommending going with the lowest bidder and waive those irregularities in the submittal so the city can get the most competitive price that was submitted. Correct? That's correct.

uh Just a real quick overview of that. They're proposing a couple bills uh coming up next year about railroad ‸ safety and basically trying to require FDOT to require some more safety requirements on the rails as they're coming through the state. Most of that involves emergency response to local agencies provided by FDEM, upgraded safety equipment that's beyond the current federal standards, and then some notifications whenever hazardous materials are going to be transported. Florida is one of the only areas where we'll have passenger rail running parallel to freight rail that can also transport hazardous materials. So those are some of the items they highlighted. if you'd like i could give you a bigger overview of that through email and just everything that citizen concerns and things like that as well
