Transcript Partial transcript
Machine transcription of the meeting recording. The words are the recognizer's, except where a passage is marked as corrected or machine re-recognized; most have
not been checked against the audio, so words, numbers and names can be misheard.
It describes what was said. It cannot establish who voted how, an amount or an outcome — the City's
minutes do that (above).
A time links to its passage, and “Copy link” copies that link. “▶ Play” opens the recording at that moment, on YouTube, in a new tab.
593 suspect passage(s) marked in place; 1 stretch(es) where a voice was detected and no words were recognized.
How this transcript was made. New machine transcription of the whole recording, with 21 voices separated from the audio.
53 short machine repair(s) (59 word(s)) are labelled in place, with the original words beside them: an ordinary word was replaced only where two further machine readings agreed on a different one.
Checks run on this transcript: the recognizer's own warning signs, whether a voice was detected where the words are and a language review for likely mishearings.
A second, independent machine reading was compared with it word by word: the same words for 92.2% of 22,362 content words.
Dotted words (607 places) are ordinary wording differences: hover or tap to see the other reading.
593 passages (23% of the words) are marked suspect: their words are not shown ("unclear audio") and support no statement: numbers, amounts, negation or names differ; the language review questioned them; or no voice was detected there.
Agreement between two machine readings is not verification.
Voice detected, no words recognized (1 stretch). Something may have been said here that the transcript does not have:
00:10:49 (8 s) — neither reading has words
Speakers were separated by voice. A plain name rests on evidence tied to that voice; “provisional” is a name from an earlier text-only pass and is not verified; “Speaker N” is an unidentified voice.
Please, ma'am, please, sir, as we just take a moment of silence for our fallen comrades that were affected by the tornado that affected several states and the falling of one of our great senators, Robert Dole, also a military veteran who served their country with us. I ask for a moment of silence and recognition. Okay, thank you very much. Madam Crook, may we do a roll call, please,

one option was to have a nomination from each council member and two from the city manager. That was actually the proposal, but it was not my position. In fact, I was opposed to it. ‸ Would like that at that point to read, she pointed out that the proposal to have a nomination from each council member and two from the non-elected city manager undermines a representative government, period. Advisory councils exist to give citizens voice and make recommendations to consult to direct staff, period.

The next presentation that we're doing, I thought it was necessary that we honor our first responders, which is our fire and our police. But there are two officers that jumped into the line of duty when actually

one event that took place, I know that they do this on a continuous basis in our city. So ‸ recognition of them, Officer Collins and Officer Leach were the two officers that jumped in right away. Because like I told council last time, I panicked. I really didn't know what to do. And that but they jumped in because they're trained for this. So that's their world. And then we really appreciate the police department jumping in also fire as well. We deliver I don't know how many cans of Narcan within our city. And so we appreciate fire and police officers for jumping in all the time and saving lives ‸ in our city. And the young man who OD, he called me crying two weeks ago. So he wasn't he not ready to come today. But he said when he is ready,

I am a Cocoa High Tiger alumni. I swam in that pool for several years and trained very hard and at 14 made it to nationals, just missed Olympic trials. So my heart is with that ‸ pool. It is also incredibly important to the high school for kids to learn how to swim. The access for them to get to that pool is walking distance. If we try to move them anywhere else, they're not going to have the transportation to get there. There's such an opportunity in this area and there is no other Olympic-sized pool or public swimming pool north of here. From McLarty to here, there's nothing. So we need to have some sort of pool so that we can get there and teach these children how to swim. It is important, so important. And Ms. Ty and I, when we

And I can't tell you how you all are well aware of the drownings that happen in our county. And we want to try to eliminate that or get the percentage down significantly.
on tearing the pool down. It is, like I said, one of two Olympic-sized pools available in Brevard County. The opportunity for money to come into this area through training and having international college teams coming in, any college teams from around the United States can come in and train at that pool. And I just ask you to please consider writing that letter and sending it to EFSC,

cross country and tennis yeah and and other things too so I wanted to update you guys on the trail project in the Cocoa conservation area it was about this time last year that I took we actually have a trail running group here in Brevard County they run multiple venues they often run at the Enchanted Forest in Titusville and so when I showed them the opportunity and just started brainstorming with them the potential for that there's a significant amount of interest since then I've also had the opportunity myself and
we've taken other high school running coaches out there in the area the wrestling coach at Cocoa High was a cross-country runner for one year and was very interested we've had some environmental people out there I've worked with some of the students at the high school who need bright futures and volunteer hours. And so we've had them out there. We're not just walking around. We are pulling weeds, chopping trees, moving branches, and there's multiple trails on the area. So there's a lot of work that we have done and then a pretty good amount of work that we still need to do in that area but it is an amazing area what I would encourage you to do is ‸ there's a couple opportunities coming up. One is a big opportunity just to highlight this area and ‸ tell you what kind of interest we have in it

32922 ‸ this item that I'm bringing before the board ‸ the committee um is in reference to my dad Kalita Gibson. He has moved to 1204 C Street as of October. I've made a couple of phone calls requesting better lighting in that area that runs east and west on C Street. um He's 95 years old, but he's very mobile, and he does have an tendency to walk away from his unit as he did in the past.
of him to say, here's my phone number. If you happen to see him, get out. I can't chain him in there. I do have a caregiver. But I'm requesting better lighting or lighting in that area.
on to Fisk, but I turned to see right where they were. I heard them. And I went i went to shine the light down there, and it's like at least six kids in the road playing. And I said, wow, if I hadn't heard them, I would have drove right past those kids and not see them. So I'm pretty sure they started during the daylight hours, and then

So whoever can make this happen, I would really appreciate this, and it would put me at ease knowing that there's some lighting if by chance he gets out and the caregiver doesn't know it, somebody will see him uh wandering and they'll say uh call 911 or call Anita or whatever. But this is extremely important to me to have this done in a timely manner. Please and thank you.

the Florida legislature recently enacted a new law ‸ requiring local governments to include a separate standalone property rights element to their comprehensive plan.
be put into the comprehensive plan. This ordinance proposes to insert into the comprehensive plan those minimum requirements. In essence, the the City will, as as directed by the statute, incorporate language acknowledging that the City will respect judicially acknowledged and constitutionally protected private property. rights and there's a goal, objective, and policy um that sets forth those minimum requirements required by statute. write me about this, um concerned that as you said, we're doing the minimum, we're putting in the minimum standards, but also pointing out how this could, if he understood it right, if I understand it right, adversely impact one neighbor against another. For example, and maybe you have better examples, but I'm just thinking about, um a house. acouple couple houses away decided to put up a street pole, very bright light that shines into everyone else's yard as well as their own
and adversely impacts its neighbors. Do we still have the ability with with this property rights to create code that would um allow us to control that?
um The short answer is yes. um A little bit more detail, however, would be um this ordinance, this this proposed comprehensive plan amendment and the minimum requirement um doesn't really change judicially uh and constitutionally recognized property, private property rights. So it doesn't add to or subtract what already exists.
property owner exists to use, maintain, develop and improve his or her property uh for personal use or the use for any use of any other person, it states that it's subject to state law and local ordinances. So local ordinances that are on the books like abating public nuisances, um still apply and are not affected by this proposed element. Okay.

minimum requirements. The city is prohibited by the department of economic opportunity to adopt any other amendments to your comprehensive plan. Okay. So it kind of, you know, puts you in the trenches until you know, you follow the edict that has been handed down by the legislature.
Okay. um I would like to shed a little light on this and then I'll turn it over to the public. um a couple of council meetings ago, um at that time, I think it was former deputy mayor, uh

ordinances and resolutions incorporation into the code, severability and an effective date. This is first reading of this ordinance proposing amendments to the City Zoning Code.
um This is another gift from the Florida legislature. The Florida legislature has deemed it appropriate to preempt municipal and county home rule authority regarding the regulation of home-based businesses.
um consistent with the new state preemption, was to go through the City's zoning code and strike out all of the previous municipal home rule regulations pertaining to home
must apply one uniform statutory standard regarding the regulation of home-based businesses. The excerpts of the statutory standards are in the agenda ‸ item. So from a planning exercise now, someone wants to operate a home occupation in their ‸ residence, the staff is now in legal, we'll have to, and council and boards will have to refer to
on for the most part, with very few exceptions. You know, the local regulations that you previously had on the books expressly related to home occupation. With that said, there are regulations currently on the books that the city has of general applicability to all residential dwelling units, regardless if there's a home occupation. Those regulations are not impacted.
those specific local regulations related solely to home occupations that now have been preempted. And, you know, I'd be happy to answer any specific questions, but the most obvious is the glaring point of the ‸ piece of legislation is

Yeah, so just a clarification. So since I've been in office, I've helped two constituents. Well, it's really code enforcement that has helped them to move an auto body business that was very loud and disruptive in the neighborhood out. Does this, do we have any ability to ‸ prevent that sort of business in a residential neighborhood, given ‸ the, ‸ noise level and the machinery and?
Well, yes ‸ and no. ‸ In terms of just looking at the use, I can't tell you that per se that would be prohibited in a residential area if they can meet all the statutory requirements that the legislature has imposed. Now, with that said, there may be some uses that, because of noise, like you said, and odor, that may run afoul of ordinances of general applicability, like nuisance-based ordinances, that make it very difficult, if not impossible, to operate

The outdoor dining has been very popular. We still live under the threat of COVID. We've had no real negative incident that I'm aware of as a result of the outdoor dining and it's become very popular in a lot of cities. My stance on it from the beginning is always to make it permanent. I love seeing people outside. I love going out with my own child. ‸ I hate taking him inside. I love sitting outside. We do it all the time at Pub Americana all the time. And just like we just left the Christmas parade, to see the people sitting out there eating and waving at us, I believe it makes a difference in our downtown area. It brings a different feel to it. I see it in Kissimmee. I see it in St. Cloud. I see it all over. You know, just because we haven't done it previously on a permanent basis does not mean that we should not try something different. And I've not heard any negative. I've heard a few things about the parking, but that's only from one or two people. But it's an overwhelming amount. I think they had over three or four hundred different petitions supporting outdoor dining. So I'm a strong proponent for outdoor dining. So I would like to extend it permanently, but I wouldn't mind extending it for a longer period of time for now. But I mean, I might make this. It depends how this vote works.

Due to the limitations with some of the parking areas, we ‸ probably would not be able to accommodate most wishes. Deputy Mayor. All right. From what I've seen in the village over the past months, allowing that outside dining in those parking spaces, not only it created the expansion of safety during COVID, but it also gave businesses a chance to expand their business capabilities as well. So I see that we're making investments in the cities for parking. If I'm correct, we just, we were looking at parking spaces. And
think we have potential for more parking spaces coming up in the near future. So I'm in favor of seeing the outside dining stay as well. How many total spaces is it again? That's being utilized.

Thank you very much, Mr. City Manager. I want to say thank you all to council right now for addressing this issue. It's been very sensitive. It's an ongoing project. A lot of emotions have surfaced. We had one member on that board that came forward, and she was chastised privately, publicly, and also social media. ‸ and I was concerned about that
citizens are trying to do the right thing. so as chair I'm asking to make a motion to delay the composition of the sustainability board for one year until January 2023

But the thing that is most important thing of all of this, I think we have a very competent elitist staff and I think we should trust our staff I think we should just let things calm down for a year until January of 2023 And then we can come back and address these issues. So that is my concern. I know that we trust them because we've given presentations just today, acknowledging our police department. there again
yeah I'm not sure what a competent staff has to do with this actually at all or how not having an operating sustainability advisory board for a year would serve us at all. you've offered no reason for that I guess it's a cool down period I don't know that there's any reason for a cool down period given the fact that the board has already been disbanded
I think this was from the beginning You came forward after you were elected and questioned whether the committee should even exist. I think this is the continued anti-sustainability campaign that for whatever reason, ‸ perhaps it's because we're in a time of great change. We sit on the cusp of ever greatness with all the development that is coming to
but to take into account how we develop and how ‸ the experience of living in COCO is going to look into our future. Sustainability is all about cutting edge. It's ‸ all about the future. This is a movement that is riding, trending well within Brevard And it's something that you can't even watch your news every night without hearing about. And without disasters that call for the need of sustainability. ‸ And for us to step back and not be there at the cutting edge, ‸ not meet those challenges, not even attempt to meet them. That would be a sad, a sad story about COCO I think COCO is better than that I think our youth are more important than that And that's what sustainability is really about, is future generations what the future of our city looks like. and so of course I will vote nay and I also want the record to reflect that this is a continuing campaign, a continuing anti-sustainability campaign.
is that it ma'am? yes thank you That is a complete of your opinion, ma'am. and I beg to differ but I'm not going to make this a squadron match I'm going to address the likes of the individuals and I'm also going to say it this way in the most kind and polite way. I trust staff I trust intermingling with my community the entire community I'll cover all districts
And we're going to move forward with this issue because I believe in our staff Even when that one individual came forward and stated that she clearly made it clear that staff was to blame for all the misconceptions or the problems that they faced. And
I respect about her I respect her to the fullest Just like you stated in one of your council meetings that you thought one council, ‸ the person you appointed was the smartest one on that. and I was shocked I think everyone is intelligent and competent especially in this position where they are paid to do this type of work, meaning staff

was actually supposed to be the day to bring the appointees to the table so I made a phone call to carry to make sure and I listened to it myself to make sure that that you know that was the case inside of that motion

federal grants that are going to be available as well as at the state level that we are eligible for those were all designed to help us move toward that more resilient and sustainable path so I you know we'll end my remarks there and I just think of the youth think of the best interests of this city you cannot watch the news tonight and tell me we don't need to have a sustainability lens just look at the storms that took place just a couple days ago we're vulnerable to storms too and if we don't do everything we can to protect ourselves to make ourselves more resilient and see that our city is more sustainable we owe that to our residents as the elected representatives we owe a lens for sustainability an eye for resiliency and actions toward that we owe that to our constituents

so my points are similar to the last time we discussed this that I'm concerned that we are eliminating a pathway to citizen engagement but more importantly that by giving nomination power to the city manager we are breaking all precedents and that we're undermining our representative democracy the whole purpose of advisory boards is to make recommendations to consult to direct staff giving the unelected city manager two nominations not just one allows him to decide who advises him and it takes power and voice away from the people so I would hope that I'm concerned that we're setting precedent here this does not exist in any other committee that I could discover other than in Coral Gables and there they have a

sustainability budget and an entire department devoted to sustainability so I would I would like ‸ this has nothing by the way to do with confidence or lack thereof in the city manager It has to do with the precedent he's made we've had conversations about this he's made several recommendations I would vote in support of those recommendations but the whole point that the city manager starts to nominate the people that are making recommendations to us to direct him becomes a self-licking ice cream cone and

I just wanted to make one correction it's not reporting to him it's directing him that's the difference and this is a precedent that we're setting ‸ okay and I mean there's no question that our city manager is smart that's why we hired him the issue is the voice of the people of our constituents and our opportunity for civic engagement and again I would never even have been on a sustainability committee if it had been a matter of knowing or being in favor with a council person so you know we're closing that avenue by not having any at-large positions
