Transcript Partial transcript
Machine transcription of the meeting recording. The words are the recognizer's, except where a passage is marked as corrected or machine re-recognized; most have
not been checked against the audio, so words, numbers and names can be misheard.
It describes what was said. It cannot establish who voted how, an amount or an outcome — the City's
minutes do that (above).
A time links to its passage, and “Copy link” copies that link. No recording can be started from here.
154 suspect passage(s) marked in place; 1 stretch(es) where a voice was detected and no words were recognized.
How this transcript was made. New machine transcription of the whole recording, with 15 voices separated from the audio.
21 short machine repair(s) (22 word(s)) are labelled in place, with the original words beside them: an ordinary word was replaced only where two further machine readings agreed on a different one.
Checks run on this transcript: the recognizer's own warning signs, whether a voice was detected where the words are and a language review for likely mishearings.
A second, independent machine reading was compared with it word by word: the same words for 91.5% of 6,712 content words.
Dotted words (111 places) are ordinary wording differences: hover or tap to see the other reading.
154 passages (24% of the words) are marked suspect: their words are not shown ("unclear audio") and support no statement: numbers, amounts, negation or names differ; the language review questioned them; or no voice was detected there.
Agreement between two machine readings is not verification.
Voice detected, no words recognized (1 stretch). Something may have been said here that the transcript does not have:
00:39:44 (6 s) — neither reading has words
Speakers were separated by voice. A plain name rests on evidence tied to that voice; “provisional” is a name from an earlier text-only pass and is not verified; “Speaker N” is an unidentified voice.

If we could perhaps change the order for now. If the board is amenable to that, see if any... If the applicant shows up for it. Otherwise, I would recommend that we postpone it.

So the subject property is approximately 4.92 acres and is currently vacant. It is located at the intersection of 524 and Friday Road west of Interstate 95. Surrounding uses include an existing commercial business to the north, a car wash and
the western boundary of the site. And that information can be found on your environmental report. That is one of the attachments with this agenda pack. So the subject property is on general commercial.
other properties within the city. They are also zone general commercial. The property contains two feature land use designations, commercial and conservation. The majority of the site is designated commercial, which supports the proposed commercial development. A portion of the eastern side of the property is designated conservation and corresponds with the jurisdictional wetland area. The proposed development includes approximately 0.16 acres of direct impact to the wetland within the conservation designated area. Because that area remains designated conservation, development cannot simply proceed based on the commercial designation ‸ applicable to the remainder of the property. The project must first satisfy the applicable provisions of

A wet detention pond is proposed along the western portion of the site, while the primary site access and utility connections are provided along Friday Road. A jurisdictional wetland identifies, and as previously mentioned here, is located the eastern side of portion of ‸ the property and extends to adjoining property to the south. The site plan provides 131 parking spaces compared with the 98 spaces required by the code, including five accessible spaces. Of the total parking provided, 34 spaces are identified for employees and 97 spaces for customers. The development also includes dedicated vehicle display areas,
50 foot by 14 loading zone, internal drive aisles, circulation, landscape, utility stormwater management, and other associated site improvements. Starting with existing conditions on Friday Road, the Space

approximately 1,850 average daily vehicles on Friday Road near State Road 524. The directional count is approximately 940 vehicles northbound and 910 vehicles southbound. Looking at the current level of service, the same Space Coast TPO data identifies this portion of Friday Road as currently operating at a level of service A. For comparison, the city's comprehensive plan established a minimum level of service E. For Friday Road between State Road 524 and State Road 520. Based on the available information, Friday Road is therefore currently operating well above the city's adopted minimum level of service standard.

It's important to note that 1,463 daily trips represent the ‸ total trips generated by the development and should not be interpreted as additional to the 1,463 vehicles traveling on Friday Road. The application does not include a project-specific trip distribution, identifying how

streets will divide between Friday Road, State Road 524, and the surrounding roadway network. Therefore, staff cannot calculate a post-development level of service for Friday Road from the information submitted for the project. a current level surface, level surface, service deficiency on Friday Road. However, the proposed development will contribute additional traffic to the surrounding roadway network. Starting with the utilities as part of the analysis for the development plans, the project will receive city water and sanitary sewer service. The utility department has several remaining technical plan comments, which we ‸ incorporated into the recommended conditions of approval, and we'll discuss later in this presentation. For stormwater, the project proposed a wet detention pond on the western portion of the site with downstream discharge to the existing drainage system.

previous acreage discrepancy and conformed that proposed direct impact to the wetland as 0.16 acres. So when I was completing this staff report, I noticed there was a discrepancy between the site plans and the environmental report as the total acreage for the wetlands. So the engineer was able to solve that discrepancy by answering and confirming that it is 0.16 acres total. So the low quality, so the engineer also confirmed that the affected portion of the wetland is classified as low quality, because

credits through FarmTown Mitigation Bank to address the proposed wetland impacts. With the updated information, the 0.16 acre direct impact and the low quality classification have been clarified. ‸ So what remains for the city that ‸ needs to be addressed, as I mentioned, is going to be the revised environmental report

protections for environmentally sensitive areas and requires impacts within conservation areas to comply with the conservation element. Policy 12.1.6.15 wetland protection requires avoidance and minimization of wetland impacts and mitigation when impacts are unavoidable.

the affected area remains as a jurisdictional wetland within the conservation future land use designation. Because development is proposed within this area, the applicable conservation element policies must be addressed. Second, the updated information from the engineer identifies the affected wetland as low quality. However, the policy here presented also requires the applicable determination regarding minimal restoration potential. So the low quality classification alone does not fully satisfy the policy. Third, the ‸ project has received a St. John River Water Management District environmental resource permit and has reserved the mitigation credits. These credits are intended to offset the proposed wetland's impact. Finally, staff is recommending a condition of approval requiring the applicants to provide the remaining documentation demonstrating compliance with the policy before development occurs within the conservation designated area. Once the policy criteria are satisfied, the applicable commercial future land use category may apply to the affected area, as provided by the comprehensive plan. So the proposed condition allows the site plan to move forward while ensuring that the required comprehensive plan determination is completed before development occurs within the affected conservation area. So the proposed commercial use is consistent with the commercial future land use designation applicable to the upland portion of the site.

and reserve wetland mitigation credits, and the recommended conditions preserve the required comprehensive plan determination and remaining utility compliance. In conclusion, staff recommends approval of the large-scale site plan for Sky Power Sport, subject to the following conditions. Prior to development within the area designated conservation on the future land use map, the applicant shall provide documentation demonstrating the affected well land satisfies the criteria of comprehensive plan policy,
here mentioned, upon satisfaction of the requirements of this policy. The applicable commercial future land use category should apply to the affected area as provided by the comprehensive plan.

I do have a question. Thank you for the thorough presentation. ‸ My question is regarding one of Alex's top subjects trees. Of all things I would pick tonight.
in review of this, my only question to staff is regarding to why is it, and this is for my knowledge to help me understand, why is it that when we ‸ start to do the calculations based off of the number of trees within ‸ this parcel of land, why do we not calculate where the building itself is going to go?
Flag: numbers, amounts, negation or names differ between the machine readings · 00:23:41–00:23:45 · unresolved: the words are not shown (unclear audio); listen to the recording
Okay. So ‸ that would clarify as to, and it does say trees located within the proposed building footprint and within 7.5 feet of the building footprint are exempt from the applicable tree replacement requirements and are not included in the mitigation calculation. But is that based off of code? Okay. Yes.
a code or if that's, if it's, that's how I got it. So I didn't understand that. So for that, that makes the mitigation applicable based upon what is being calculated and what is being therefore required to be paid to the city. I have no further question for ‸ the staff. Okay.

I wonder, is it too low for what's going on? It looked like from the picture you guys put up that that's where the retention pond is going to be at, at the corner of the road, but it is still fairly low there. I know I wasn't contacted. Have other people on the block been contacted?

way? Who has been contacted? Are there going to be any noise regulations regarding what is going in there? There ‸ are a lot of people that with this head of gray hair ‸ on that block, I can call old with a straight face. I am not a spring chicken.
two miles east of there, are going down there. And Publix gets restocked through there. There's a lot of stuff in that little corridor. And apartments are going up all the time. You guys are the ones approving them. So are these things going to be accounted for? Because as I said, I've lived there off and on for 49 years. Most of the off was my mother's army service. There are a lot of things that have went in west of 95 in that part of the county that do not have enough turn lane, do not have enough easement, have gotten special consideration often from the county, not from y'all. But they have gotten that special consideration.
that same block are already high. How is this going to impact us? I already flood from when 520 was expanded 20 years ago. I was told by FDOT 30 years ago that it wasn't going to flood us. We were flooded in for a week after one hurricane.
That's good questions. Thank you. Thanks so much. Staff, would you mind answering the questions on proper signage and posting of the meeting before the, before the meeting occurred?

see. I'm not sure. Uh, I can't remember recall if there is a turning lane or any additional lanes that was required by FDOT. And that is, it is a separate permit that they have to pull with FDOT. So, and I don't think the engineer record is here today to answer that question.

applicant. I'm happy to answer any questions you might have and like to kind of summarize what we heard from Mr. Parrish, I guess first relative to the questions regarding drainage and other things.
and Friday Road, we did have to go through an extensive DOT permitting process for specifically drainage. There's a large drainage ditch on the south side of 524. It drains to the west. So we were the site plan. If you look at it on the grading plan, drainage plan, you'll see there's actually bypass piping, as well as a big pond in the back on the west side. Both of those are in there based on the fact that we had to work with DOT and obviously the site itself to accommodate the drainage for the Water Management District and DOT and then use a bypass system in order to route water around the site as it normally went through the site before we got there. As you know, when Water Management District permitting as well as DOT, there's a lot of different iterations of storms you have to run, models you have to deal with, grading you have to deal with. The site had some on-site little depressional areas. You have to account for those when you're doing your stormwater management ‸ plan.
environmental resource permit, the Water Management District was okay. We also have ‸ the DOT permit regarding the drainage issues and both were okay with that. So we paid attention to all the drainage that comes onto the property. We also paid attention to the site itself and the impervious area that we're putting down and took care of that

probably had to deal with that before, but they pay attention. So both met that requirement. The water at that corner, he's completely correct, it is low there.
It's a big distance, probably over 100 feet from the road itself to the right-of-way line for DOT on 524. So that area is where we did our work to help mitigate that drainage.
And then just to answer the last thing, there was a concern about the noise. So then that property will, we do have a noise ordinance and it would apply to that property. I just want to mention that. I think it was one of the questions.
That's very good. Thank you. Thank you. All right. Any, anyone else for the public want to speak on this matter? All right, then. And we'll close it to the public, bring it back to the board, the ‸ wishes of the board.

Um, as far as I know, the only time that you're going to hear any noise is when they're putting their product out cause they'll, they're going to store it in the back. They'll drive it around to the front, park it out along the street, whatever else. And then they put it away at night.

Since then, the applicant has revised the site plan to consolidate the six commercial lots into only two and the stormwater areas were redesigned. Internal roadways and access remain the same and the site plan also remains an infrastructure only with no vertical construction included. Any additional activities on the property will have to come back through the site plan review ‸ process. A preliminary plot is being processed concurrently with the site plan and creates the two commercial lots along the future along with the future development, stormwater conservation and access tracks and it depicts the utility easements and technical information required for plots. It's been reviewed by staff and city attorney's office as well. In summary, this is an infrastructure focus site plan to allow for road improvements and construction utility services, site grading and stormwater retention areas. Individual site plans will be required for future commercial out parcels and residential development and landscape requirements includes the planting of 635 replacement trees.
