Transcript Partial transcript
Machine transcription of the meeting recording. The words are the recognizer's, except where a passage is marked as corrected or machine re-recognized; most have
not been checked against the audio, so words, numbers and names can be misheard.
It describes what was said. It cannot establish who voted how, an amount or an outcome — the City's
minutes do that (above).
A time links to its passage, and “Copy link” copies that link. “▶ Play” opens the recording at that moment, as the City's file, in a new tab.
69 suspect passage(s) marked in place.
How this transcript was made. New machine transcription of the whole recording, with 9 voices separated from the audio.
10 short machine repair(s) (10 word(s)) are labelled in place, with the original words beside them: an ordinary word was replaced only where two further machine readings agreed on a different one.
Checks run on this transcript: the recognizer's own warning signs, whether a voice was detected where the words are and a language review for likely mishearings.
A second, independent machine reading was compared with it word by word: the same words for 95.6% of 3,382 content words.
Dotted words (55 places) are ordinary wording differences: hover or tap to see the other reading.
69 passages (19% of the words) are marked suspect: their words are not shown ("unclear audio") and support no statement: numbers, amounts, negation or names differ; the language review questioned them; or no voice was detected there.
Agreement between two machine readings is not verification.
Speakers were separated by voice. A plain name rests on evidence tied to that voice; “provisional” is a name from an earlier text-only pass and is not verified; “Speaker N” is an unidentified voice.

Thank you. So moving on to item two, approval of the agenda and the minutes. Do we need a minute to review those? Or if we don't, someone can make a motion to approve.

And tonight we're here to consider a sign waiver for the A1 Home Center. And so, like I said, this is a sign waiver request for the A1 Home Center, which is a home improvement store located at 1066 Clear Lake Road. Just as a reminder for

per article 17, section eight, regarding waivers from certain code provisions. The board may grant a waiver from the strict application of certain code requirements. In this case, chapter three, advertising and signs. Providing the procedures in section eight C in the code are followed and certain findings are made, including the initial finding criteria, which is that ‸ the need for the proposed waiver arises out of the physical surroundings, shape, topographical condition, or other physical or environmental conditions that are unique to the specific property involved. So, in granting a development approval involving a waiver, the board may impose such conditions and restrictions upon the premises benefiting by a waiver as may be necessary to allow positive finding to be made on any of the additional criteria that's considered for a waiver.

the city of Cocoa code regarding general sign regulations. And so, part A is to increase the maximum permitted number of one attached sign per business establishment on an interior lot in the neighborhood commercial zoning district to 11 signs. And part B is to increase the maximum allowable sign area of attached signs from 20% of the surface area to ‸ which it's attached to 25%.

audience this evening to answer any questions after the presentation. And the zoning district is neighborhood commercial. The future land use is commercial. ‸ And so, Do It Best is a home improvement cooperative. A1 Home Center, LLC, the partner name, is the applicant's parent company that manages the cooperative. The Do It Best sign, the individual home improvement symbol signs, such as the screw, the drill, and the pipe, and the entrance awning, are part of the ‸ Do It Best brand.

and it's the world's largest hardware lumber and building materials buying cooperative in the home improvement industry. With nearly $6 billion in annual sales, they support thousands of independently owned locations across the United States and in more than 60 countries worldwide. Partners in the company have the flexibility to operate under the Do It Best true value or their own local store identities, offering a diverse range of branding options to best serve their communities. So,

receipt on March 18th and held their Accelerate Brevard ribbon cutting on March 21st. So, in addition to adding signage and interior remodeling, as you can see here, ‸ the interior of the store, the property owner is making improvements to the parking lot and has submitted for a minor site plan amendment for these parking lot improvements, which includes repairing asphalt potholes, applying a seal coat, re-striping, and adding landscaping and trees.
were installed prior to permit approval. And the applicant is aware that if the BOA does not grant the waiver for additional signage, he must remove the signs that are not allowed per the code.
the neighborhood commercial zoning district, there's one sign per apartment complex or business establishment is permitted. And then the attached sign shall in no case exceed 20% of the total surface area of the wall to which it is attached. So, that is the actual code language that we're asking a waiver from. ‸ So, for request part one, let me go back to this one here.
of one sign permitted per business establishment by 10 signs, so totaling 11. As previously mentioned, the do it best sign, which is internally illuminated. The individual home improvement symbol signs, which are not internally illuminated. And the entrance awning are part of the do it best cooperative brand. The applicant is requesting a waiver for the additional 10 signs. And so, like I mentioned, the ‸ only signs that are illuminated are ‸ the do it best sign there. And the other signs are, I believe, their canvas material. Okay. And so, that was part one of the request for the number, for exceeding the number of permitted signs. So, request part two is, so the A1 Home Center, this is a planned view of the building. And the A1 Home Center business occupies approximately 52,000 square feet of a 70,200 square foot building. The facade of the A1 Home Center is approximately nine feet high and is divided into five sections or vertical surfaces. Three of the five surfaces contain attached wall signs, and all three of which exceed the maximum 20% of the surface to which they are attached. So, surface one here, so I've kind of numbered the individual surfaces that make up the entire storefront.
that comprise approximately 24% of that facade area. Surface two is approximately 664 square feet containing one 118 square foot sign that comprises actually 17% of the facade surface area.
Surface three is approximately 522 square feet and contains an entrance awning. No signage or graphics. And then surface four is approximately 522 square feet containing five 25 foot 25 square foot signs that

It has no signage. And so, the requested waiver was analyzed according to the criteria previously mentioned in Appendix A, Article 17, Section 8. ‸ The initial criteria, which is the need for the proposed waiver, which is, like I said, arises out of the physical surroundings, constraints or shape and other physical environmental conditions that might prevent the applicant from meeting the code requirement.
1984. It is of the ‸ big box retail character. And the 52,000 square foot interior is out of scale with the sign regulation of only one sign per business because of the ‸ length of the facade there. So, and then ‸ there were additional criteria to consider regarding the, you know, is there an economic hardship? Is the applicant requesting a cost reduction? Will it increase traffic, cause congestion? Will it be a hazard or a nuisance? ‸ Will it adversely affect property values? Is it in harmony with the comprehensive plan and zoning code?
order to be in compliance with the do-it-best brand, which, ‸ you know, ‸ so has increased his investment cost and the overall improvements to the building. And the signs are, you know, they're surface mounted. They're not on the ground. They don't pose any danger to the public. And they are not anticipated to decrease property values.
COCO comprehensive plan and the zoning code with regard to redevelopment, where the city shall encourage the redevelopment of areas that are exhibiting evidence of decline.

recommends the following conditions be applied. That the sign quantity and size are approved per the document submitted with this and the sign permit application that was previously approved attached to this agenda item, which is in your staff report. If the applicant wishes to increase the quantity or size of the approved signs, an additional waiver will be required. And if there's any other conditions, the board deems necessary to add, you know, is with consideration. And also to note that the staff met the advertising requirements and
to the proposed waiver. And so, ultimately, staff recommends approval with conditions of this waiver request from Chapter 3, Article 2, Section 3-23, Table

Jennifer, I have one. Actually, the building looks lovely and thank you very much for making that area look so much better. If we approve it for this one, this waiver, then does that apply to anyone else that may want to come in? Or just is each one separate? What I don't want to set the precedent
So, ‸ yes, it would be on a case-by-case basis. Each business would, for the signs that would apply to their business, would have to request their own waiver. Okay. So, ‸ this waiver is specific to this business.

into that. Almost the roof would cost at least $800,000 to replace. The first thing we did is the replacement of the roof and then I tried getting at least ‸ 500 leads ‸ once I posted online to get a business for that area. I had a lot of interest by the people but none of them came through after looking at the demographics and I disagreed with that and I said there's a lot of potential, there's a lot of people who do ‸ construction in the area, there's a lot of Spanish population, there's a lot of
and I don't want to bring another grocery store where we have Walmart, save a lot, we have a lot of other things and I decided to bring in myself. I'm a contractor too and I've been in the area for 15-20 years and so I decided to bring in the hardware store and because I couldn't find any renter and I don't want to leave that empty for another 10 years so I opened the business and one of the important thing is Do It Best actually gave us some incentives as a cooperative member and

interior signs so and then once I follow that and they would give me that incentives to be in the business and supply the inventory at a percentage so I can survive and they did that and ‸ everything went well and we are doing

I saw her, I didn't know that she was a board member. And so we combined a lot of businesses inside. There was a corner where nobody can see, a lot of businesses went in there and nobody succeeded. So we combined everything and made it into one big business where we can control everything, we can develop it.

you would see beautiful again that area completely. And I made myself when I'm renting to the people, I made myself some principles like do not rent to marijuana place, do not rent to vape shops,

you're more than welcome to, uh, come and see the improvements and I'll let you guys know. Awesome. And also it creates at least 20 to 30 employments, uh, in that area. Okay.
So I totally appreciate that. Um, ‸ seeing the goals like laid out before us of what the city is looking for enhance the quality of life and prosperity for citizens.
it is to see somebody come in and speak the way you just did and do something that is for the citizens and will help us. Like your comment about no vape shops, like the amount of vape shops and storage units that I drive past to get here every week is appalling and
So I truly appreciate it. And like that needs to be set on record and more people need to start speaking out about it, that we have to do what is best for our city, not taxpayer dollars, which I hear a lot of comments from other board members online saying that we need more taxpayer dollars coming in. We need folks to have businesses that appeal to them.
