Transcript Partial transcript
Machine transcription of the meeting recording. The words are the recognizer's, except where a passage is marked as corrected or machine re-recognized; most have
not been checked against the audio, so words, numbers and names can be misheard.
It describes what was said. It cannot establish who voted how, an amount or an outcome — the City's
minutes do that (above).
A time links to its passage, and “Copy link” copies that link. “▶ Play” opens the recording at that moment, as the City's file, in a new tab.
678 suspect passage(s) marked in place; inspection incomplete: language review; 2 stretch(es) where a voice was detected and no words were recognized.
How this transcript was made. New machine transcription of the whole recording, with 32 voices separated from the audio.
74 short machine repair(s) (84 word(s)) are labelled in place, with the original words beside them: an ordinary word was replaced only where two further machine readings agreed on a different one.
Checks run on this transcript: the recognizer's own warning signs and whether a voice was detected where the words are. Not completed: language review.
A second, independent machine reading was compared with it word by word: the same words for 94.3% of 30,385 content words.
Dotted words (739 places) are ordinary wording differences: hover or tap to see the other reading.
678 passages (22% of the words) are marked suspect: their words are not shown ("unclear audio") and support no statement: numbers, amounts, negation or names differ; the language review questioned them; or no voice was detected there.
Agreement between two machine readings is not verification.
Inspection is incomplete: language review.
Voice detected, no words recognized (2 stretches). Something may have been said here that the transcript does not have:
03:01:30 (22 s) — neither reading has words
03:18:07 (6 s) — neither reading has words
Speakers were separated by voice. A plain name rests on evidence tied to that voice; “provisional” is a name from an earlier text-only pass and is not verified; “Speaker N” is an unidentified voice.

Thank you, Madam Clerk. I'm happy to say. I wanted to just, school has started. And I'm a firm believer in doing things decent and in order. Also in attendance, I know we're going to talk about it possibly on the reports too as well, but we had the Honorable Esquire Alton Edmonds there at the grand opening day or first day of school.

all different tribes were well represented there. So day one, I believe we're doing things decent and in order. And I'm saying this for a reason. I believe in your right to articulate your thoughts. It's not what you say, but how you say it. So I'm just asking that we all treat each other the same way we want to be treated. Amen? Amen. All right.

when individuals and businesses recognize black-owned businesses across the country. During Black Business Month, local government officials, community leaders, and venture capitalists are encouraged to focus efforts on supporting black-owned businesses and creating a more hospitable environment in which black-owned businesses can grow. Black-owned businesses are essential to our flourishing communities and culture as they support families and provide careers to Floridians across the state. The City of Cocoa honors the historic and contemporary achievements of black entrepreneurs, acknowledges their vital role in creating

the 12th day of August 2025." Let's give the President and the Leader of the Space Coast Black Chamber of Commerce a round of applause, please. There are big ships and little ships, but nothing like friendship, partnership, and ‸ more so than anything else, scholarship, being smart,
being able to acknowledge the environment in which we're all God's children. Even though we come from different tribes, we belong to one race, that's the human race, and we are all God's children. Amen?
So I salute all businesses, especially African American businesses, because we have a couple of them here now in the audience. And I am living proof, as well as everyone else is living proof. So I thank you very much, ma'am. I'm gonna give you the microphone, but shall I give it to your daughter first? Would you like to say anything? Okay, here we go.

While this is a moment of celebration, I would be remiss if I didn't share the reality that drives our work. I know there may be people here watching online and wondering why do black chambers of commerce exist? The answer is in the numbers. In government and corporate procurement, black-owned businesses are classified as minority-owned.

men included. This is why the Space Coast Black Chamber will keep advocating not only in times of challenge, but also in moments like this. Because progress requires both recognition and action. Too often, black Americans are called to stand for every group in this country. But when we speak up for ourselves, we are told we should all come together. The silence from every group in America that has benefited from the term minority or under the umbrella
should show us why now is the time for our people to let old grievances go and work towards uniting. So in closing, I will ‸ share the words of the U.S. Black Chamber of Commerce President and CEO, Ryan Busby. In order for there to be a great America, we have to have a great black America. In order to have a great black America, we must have great black businesses.

power in numbers on all sides of the tracks. So I gladly embrace all businesses to as well. But yes, ma'am, you're right. So we're going to move forward because why there's power in numbers and what's in the past and what's in stored for us for the future. I believe in this. So I'm thankful again. Job well done, my fellow Floridians. And I look forward in having this. Continue to move forward.

state, and federal levels, as well as in the form of scholarships and acknowledgments. There is an issue that has caused me grave concern. Now, I'm in no way trying to create tension or an enemy, but the truth is the truth. When a member of the council went on record through social media, criticizing their fellow ‸ board members, employees of the city, the chief of police, and the city itself, this was an egregious act. I watched the video reel in disbelief. I understand that the media is well-versed in directing their questions to skew your response, but this council person continues viewing what was truly disheartening to each sector that was named during the podcast. Please understand that

participated in an interview. And I didn't call out anyone in particular. In fact, I talked about raised issues that I have raised numerous times on this dais. Now, the last meeting was quite a punishment for that act. I think it was meant to intimidate, censor me. But I'll continue to raise those issues because they have to do with how we engage with the public and how we manage policy development. Nothing I said there was a personal attack. And I find it hard that you could listen to that interview unless you had already determined that it was that and come to that conclusion. I've talked to a lot of people since then.
I would just say that ‸ the points that I made, I have made here many times. And I'll continue to make them because I think they're important. They're important to our democracy. And that's what

sir. Former. Had a lot of experience with that. I want to continue the presentation that was done by the previous citizen that was just up here earlier. I also had myself and other people that saw this interview by the council person. And it is not well received because it's showing how there is absolutely no teamwork. This is not the way things should work on the council. There's other examples, not just ‸ from that video, but there was numerous ethic complaints where the mayor was attacked. ‸ The city manager was attacked. The fire chief was attacked. People ‸ campaigning against this council person was another complaint sent in. This ‸ is just disruptive.

for them developing a project in Cocoa. I cannot believe that was done by letter. And it sends the wrong message that because this council person put their name down, it looks like that the rest of the council supports it. And they do not. I don't know of any other council member that's gone that far in reference to trying to fight a project. The other thing that's really odd, it's not in this council person's district. To send a letter, this is unheard of. Other examples. Other
There's one person that an apology is expected of. And that's to Jack. And that's not happened yet. He's one of the staff members here. Altering minutes. Voting no on 403 project until when the first reading came up.
In summary, it's always been stated that ‸ of being bullied, that this council person is being bullied. And also made a motion ‸ to be honored with the deputy mayor position.

Yeah, well, it looks like we've got a nice little ambush planned here. But I will say this regard to the St. John River Water Management District letter. I wrote a letter to the district asking how citizens could weigh in on this. Secondly, let me, ‸ coming from you in particular, and with all the moral indignation that's been expressed,

And despite my calls for a point of order, he was allowed to continue, even though Article 11A of our procedure guidelines reads, no person shall be allowed to make impertinent or slanderous remarks while addressing the council. That harassment included an ethics complaint, all of which at least two members knew about on our council and encouraged. And the ethics commission responded.
preservation of wetlands and development. However, just because one disagrees with the policies and viewpoints of a public official, that does not mean the public official's actions are corrupt. Strategy is ‸ really common in politics today. A lot of this is gaslighting, when you psychologically manipulate the conversation, to confuse, to twist. To deflect from the real issues. And it's not about personality conflicts, it's about issues. It's about respecting opinions. We need, as a council, to listen and respect, and yes, disagree when you have a different opinion. So, I will share with you a text message I received the next day. And that it's ‸ from someone that is just connected with the other people on this council, as I am. Probably more connected with other people on this council.
which I watched a few days ago. That attack had to be guilt ridden because you said nothing that wasn't truth. Rubber stamping, obvious so often. And that doesn't necessarily imply sunshine law infractions. It could just as easily mean embracing every staff recommendation instead of doing any digging. ‸ And the disrespect, especially on the part of the mayor, is just embarrassing to watch both towards you and audience speakers. The only point I do agree with is that interviews are hoping for discord and juice. And they certainly got that. They got a lot of it at the last council meeting. Sounds like here ‸ too. But, I believe there is a perception. I've heard from multiple people there's a perception of rubber stamping. That's something we can easily fix. That's something that really comes from all of us feeling the ability to express our opinions and participate in a robust deliberation. And that is really central to our democracy. And I believe in our democracy. I believe in democracy. ‸ I really want to see Coco's democracy work. To help Coco be everything it can be. So, again, I believe that we must engage with the public and manage policy development with robust deliberation. Talking about the pros, the cons, the consequences, the unintended consequences, the risks, to come up with the best solutions, the best legislation. Anyway. And that's all I have to say right now. But, Mr. Greenwood, you know, it's been going on for a couple years. And I know
‸ I know you were really upset when they put you under, when the Florida Department of Environmental Protection put you under the consent after the area was cleared. But my interest in that, first of all, I live in that neighborhood, just a few blocks away. And I know all the people that surround it. And so, obviously, that's why I was pulled in. So, there's no surprise there. But the whole idea that because somebody doesn't agree with you or has a different take on wetlands or development or whatever it is, that's not right and

I have the utmost respect for you. No matter how many times we may disagree on something, no matter how many times ‸ anything negative between us, it doesn't matter because we all have a job to do. We have a duty. But I'm not the only one that feels this way. When employees who cannot come to this dais call me and tell me, thank you, I didn't ask for that. They feel some type of way as well. ‸ They may not say it because we are their boss, technically. But they call me. And so, the perspective of one person may be different from you and the people that you hang around. Now, their view of your words is going to be totally different ‸ because, and I told this to one of your friends,
of your best friends. So, it's hard for you to understand my perspective because you don't sit where I sit. And when you don't sit where I sit, you cannot feel how I feel or how employees may feel. And so, my only point of even bringing that up two weeks ago was not an attack. I think sometimes we misconstrue accountability and attack. Accountability is not that. I didn't call you out your name. I didn't do anything I believe to be disrespectful. But sometimes when we ‸ are, we think it's called chastising. Like, I made this example last time.
I just lose my mind. In my mind, I want to wash it in the morning. It's only one spoon. I want to wash it tomorrow. But I understand I have to take that, right? That's my accountability. I use the spoon. I need to wash it.
do anything disrespectful at all. And no one that I spoke to said that I came off disrespectful. ‸ Maybe you took it that way and I apologize if it did come off that way.

‸ And so, again, if I did anything to disrespect you, I apologize for that. But I do not take back not one word that I said because I know I came off, in my opinion and others' opinions, not disrespectful. And so, that's just my opinion. And yes, when you say rubber stamp into somebody like myself, it's very disrespectful.

That's just crap. Just because we don't ask those questions sometimes on the dais does not mean we do not do our due diligence behind the scenes. That's,

That doesn't make ‸ sense. We, I believe, all of us do our due diligence. I believe every last one of us, we may do it in a different way. I don't sit down with Stockton on Tuesday for two, three hours. But when I have a question,
But, but sometimes just, just, we do things differently, but that doesn't make it bad. And when you say rubber stamping, it makes it, it makes me feel like I'm not doing a good job.

I didn't mean any disrespect. ‸ I was just completely, just saying that we are a team and we should be on United Front. That's all, that's all it was. And so, again, this is not grandstanding. This is not about me at all.
the country, there are issues that happen on councils. And sometimes in the public eye, it looks really crazy sometimes, but we are supposed to argue with each other. We're supposed to not agree. We're supposed to debate. And sometimes it gets nasty at times, but at the end of the day, we should be able to shake hands. If we lose a vote, we lose a vote. If you win it, you win. I lost a vote. Me and Mike Blake argued probably for two hours over the museum. And what did I do? Did I get pissed off with him? No. What I did was I re-strategized. I came back two weeks later. I made another motion. And then I believe we end up agreeing on a certain amount of money.
It's not personal. And when me and Mike argue, don't take it the wrong way. Just so as we argue, when I ride by his house, we heart to heart. What's up, bro? It's not that serious. But politics today has become so weird and impersonal and not, it's just not right, man. I'm not that kind of person. And I don't want to be that person. I don't even like being called a politician. It's not even my world. But I just want to be a good person. I want to be able to make, sometimes I make bad decisions. And citizens call me and slap me across the head and say, why you make that stupid vote? And I, you know, so, but I ‸ just try to do right. And sometimes that may rub some people wrong, but this is, I'm off my soapbox.

And I'm coming on behalf of a rehab that I had at my home. I want to first off say thank you for allotting me the money to be able to get this rehab done. But at the same time, ‸ I have experienced all kind of bad in the rehab. The rehab was done in 2022.
I have texts, I've emailed, I've called. Uh, I want to say thank you to Charlene and Marcia because they have been trying to do something about it. Charlene has been in the game from the beginning of the rehab, but the rehab is still not finished. Because the first company that came in took advantage of me and the city had to go after them from what I was told and I'm stuck in between decisions because me and my husband are left to deal with the aftermath of the rehab.

Since then, the city has come out and they've helped me get things established with the roof. ‸ They told me I was on a go with the roof and all of that. ‸ But when they went in the house, the same electric box that the city's inspector came out and passed, they're telling me that there are wires that are not supposed to be together in this electric box, which could cause a fire for me and my husband. And I have asked them about it. I have told the proper people who I need to talk to about it, but I haven't had a response on that yet. And what I want to know is, will the city be able to go ahead and correct that since it was their inspector that passed the house with that electric box that they went in and inspected.
I still have things that needs to be taken care of. The floor by the bathroom needs to be taken care of. And it's a couple of other things I'm going to get off because my time is out, but I will revisit this again. Thank you for listening.

of introduction, my presence began in Cocoa some years ago when I attended St. Mark's Elementary School a few blocks from here. Since then, I went to school a little longer, came back and began practicing law here in Cocoa Village as my father before me did for 55 ‸ years. Since then, I've been practicing for a number of decades. My family and I have lived in two different residences and two different complexes and I've practiced in two different buildings. I'm aware of a few of the things that have gone on in the City of Cocoa in the last few years. And so tonight I was sent an email. Actually,

people who signed a petition in multiple buildings, including Whitley Bay West, Whitley Bay. So yes, I'm here as a resident. I also represent other people and other people have signed this petition just to give you an awareness of the people who are impacted by what we're discussing tonight.
For me? Yes, sir. Okay. Thank you. So I represent a growing group of residents who call Cocoa Village home, specifically Whitley Bay and Whitley Bay West, surrounding riverfront family communities. We are here in opposition, not in opposition to the business, but in favor of balance to preserve the peace and livability of a neighborhood where hundreds of people live, sleep, and raise their families. Our specific request is that the city deny exterior amplified music for a bar currently seeking a special exception to allow it. It's the amplified music, not the outdoor portion of the business. If I understand it correctly, the special exception on the second part of the application was in two parts. One is for amplified music and the other was for seating outside.
Flag: numbers, amounts, negation or names differ between the machine readings; a language review questioned the wording · 01:31:22–01:31:24 · unresolved: the words are not shown (unclear audio); listen to the recording
and the city took a chance. They took a chance on the riverfront from Oleander and what we now know all the way to 115 River Drive being transformed by riverfront condominiums that would also support the city of Cocoa, the city village, and all
and all the residents that are there. Today we have hundreds of condominium units and many hundreds of residents that live in these buildings. It is our neighborhood. This was not an accident. It was encouraged by the city leaders. It was codified in the city code and the CBD district. I'll read you a few of the ‸ provisions in the CDB guidelines for that zone. It indicates that it is encouraged for hotel, motel, multifamily residential development here. Also, quote,
to be promoted and encouraged. The developers and the people who live here were invited ‸ because we were encouraged to be here to have a neighborhood environment to live in that is so beautiful here in Cocoa right next to the riverfront.
I'm again reading from the CBD district zoning category. The district is intended to discourage uses which would create friction with the other uses. My contention is that is what we're talking about tonight. What this means is the city intended a riverfront area to become a livable neighborhood community, not just a weekend destination for those who want to go to the bars. High rise condominiums are not vacation homes here in Cocoa. That's not what's taking place. These are primary residences where people have their families and that they live. Hundreds of people live here. They're families, retirees, professionals.

They are your residents. They are your taxpayers. And they are voters. The problem is the bar in question has a documented history of playing loud music that is amplified and is in direct conflict with this neighborhood that I'm describing that the city has promoted and that has now developed over the years and is in place. This is not about occasional noise.

Whitley Bay West is developing a reputation as being a noisy building. So why should people who come in to party from elsewhere into the night control the quality of life for people who live here every day? That is the question. Cocoa must prioritize homes over hangouts when land use conflicts arise. We are not asking the city to close the business.
about. We promote the businesses. We are people who go to the businesses. We are simply talking about the conflict that is occurring because of the loud noise.

and peaceful coexistence among the land uses. That is what we are asking for. Simplified, we are stating that we ask this council to respect both the bar's ability to operate, as we suggest, but also the neighborhood's right to peace. As was stated earlier, we are not contesting the indoor expansion. The indoor expansion is simply a representation of this business and their success in doing what they do. And

discussing. Two final thoughts. First, ‸ we were provided some guidance by the city manager who not too long ago came to us. At Whitley Bay and just discussed a few things. He said,
Flag: words were replaced by a machine repair · 01:36:01–01:36:01 · machine repair: words replaced where two further machine readings agreed (not checked by a person)
He said, we want to let you know that the city of Cocoa loves Whitley Bay. He had me on the edge of my seat. What's he going to say next? ‸ So I leaned forward

the numbers from the ‸ city manager, we didn't believe it ourselves. But those are, that came from Mr. Witten. So that's one final thought. The other is the city built a vision for this village. And this village would not be the same. You wouldn't have these residences. We wouldn't have this conflict if there was not a vision by the city to put residences all along the riverfront. It became, again, and I applaud the city for this.
when Oleander went up, we couldn't believe what was going on and our applause just went on day after day. What became of that is a walkable, beautiful, livable waterfront where people could live, work, and enjoy community life. We, your residents, bought into that vision. But now we need your protection to uphold it. Again, I quote Mr. Witten. When he was with us that day and he was, his concluding marks were, again, talking about all the love, he said, you let us know if you need us for anything. We're here tonight for that. We need you tonight to help us.
we respectfully ask that the city council ‸ deny the special exception for exterior amplified music at the bar location to protect residential integrity, to uphold your zoning codes premise and what ‸ the CBD district calls for, and preserve the quality of life that this city has established throughout this Cocoa Village. Thank you for your time and for your consideration.

One of my questions is, I know you said balance, right? And so are you, are you interested in no amplifier music citywide or throughout the entire Cocoa Village before and or after 10 o'clock? Because we have, and I think my great friend Alec Greenwood is the sound maestro. ‸ And he knows there are many issues, right, throughout Cocoa Village. So I guess my question to you, because I visit down here a lot. I spend a lot of money in Cocoa Village. I'm a nightlife guy. I love it. I love to let my hair down.

On a second level. Yes. Is that you're raising a question about the, um, the ability of the current noise ordinance to supply what it, the Cocoa Village needs.
And so, yes, I didn't make that part of my presentation. Okay. But I have many things to say that I don't think is appropriate for this evening because we're here regarding a special exception that's very narrowly tailored in our discussion.
Both as to its content and enforceability. There are numerous municipalities throughout Florida that are taking a strong look at this and doing some very aggressive things regarding, uh, noise and residences next to commercial establishments.
only, only response to that is so from, from balconies, right? There, there are so many businesses that have outside music. It makes it to me, in ‸ my opinion, very difficult to single out unless you are walking directly by.

‸ specific control, right? And so, point well taken I appreciate the passion that you have for this situation I just look at ‸ it it and I brought this up at our last CRA meeting that we need to have a discussion about um Coco Village and or City of Coco a Noah's ordinance as a whole right and

is 10 o'clock um several other businesses closed down at 10 o'clock and so I think by staff making it specific towards aqua Lounge, number one, is very aggressive towards one particular business and not sharing it. But they uh they didn't like it, but they accepted the the one through eight requirements. And so that's totally specific to one business to one business and so to me I think that is fair as far as for the city standpoint to say, hey, we're going to tailor this to you.

so with respect to me being here it has let's pretend for a moment that there was 20,000 amplified music places coming from the downtown Cocoa area and we didn't hear it at Whitley Bay I wouldn't be here it's because we are knocked out of our beds at night and we're disturbed at other times in the evening as well, that we are here. I would prefer to be home at night tonight right now doing something else rather than being here. But we're here because it's untenable. saying that I am not saying that we support them putting ‸ anything they want to do including the loud loudest decibel levels as long as it's contained within the building and they have an expansion now and that just means they're doing a good business okay
they applied for the special exception. We're going back months and months before that. There is a history that precedes the application for a special exception.
okay um and so the music that you're hearing now at 11 o'clock and later is coming from strictly inside the building that you're hearing this loud music at your place? no
I can't say I've ever heard anything that comes from the inside of the building so since since the appeal I don't remember when that was a couple months ago

the expansion of a bar and lounge with outdoor seating okay but and there's one clarification from staff the amplified ‸ noise is a condition of that special exception approval correct that's correct
Lucy that's correct just okay so so so the the condition on amplified noise that the board imposed was that the special exception should for outdoor seating should be approved, but no amplified music permitted in the outdoor seating area after 10 is a condition of approval. So what is your position as the appellant regarding that condition of approval
so I'm gonna state it because I don't know if if you and I are getting mixed up a little bit. Are you saying, are you indicating that the outdoor amplified music is tied to and one of the same with the application for exterior seating? Are you saying that?

Jacksonville dialect so so so so the expansion is to the outside in front of 120 and 116. So you can expand to the outside. The modifier on there, the but statement in there in there in that ‸ expansion is, but you can only have amplified music up until 10 p.m. so I don't know if that makes it clear so so you can it
10 p.m. or as part of the expansion for the outdoor portion, you can't have amplified music after 10. So that's just a simple statement of, of what the approval is.
Right, because the, because the current noise ordinance doesn't prohibit amplified music. It just says it can't be a disturbance or it can't be a certain decibel level from the receiving property
Okay, thank you. You've clarified what your position is. It's not the outdoor seating for Bar bar and Lounge. You are requesting that the city council place a more stringent condition than the Board of Adjustment placed just no amplified music outdoors. That's right That's your position. Yes. Thank you.

Well, actually, I don't even need all of it because it seems their stance has changed since ‸ Thank you very much. So I also sit in a video, um if you have that,
before the special exception, the Board of Adjustment meeting in May. So that was beforehand. That's why there were put those um conditions, which we agreed to. Since we agreed to them May 21st, amplification has not been outside from us. However, this video, June 5th, 2025, after the approval at 11 59 pm if you don't mind playing it, and
was not us. It was across the street. In the video, you can see where the music is coming from. Other videos, you're just seeing it from a balcony. So you don't know if it's us, a car, across the street, down the street, downstairs. Again, that video shows the music was not coming from us. Again, we have not had amplification since the approval. And them stating, uh what was it, that they're appealing the music, but I don't understand. ‸ you're appealing something that was set in place for you. Why would you appeal something that was approved for you?
Let's see. Again, um we can't control what people do in their cars when they're riding down the street, when they're out down the road. We're not law enforcement. We're not code enforcement. We cannot enforce anybody to do anything on public property. Unfortunately, that's not on us. But putting

As far as the constant violations that they claim we've had, at that meeting, I stated we only had one call regarding noise complaints, which was cooperated by Planning and Zoning, who confirmed it from Chief Collier, who confirmed there was only one call regarding noise violation. And they can confirm it here. Other than that, there hadn't been any other calls to CPD regarding noise to come and address us. Again, no knowledge. And again, the music is not always us. There's other businesses that are open till 2 a.m um as far as that go
changed from the outside space to just the noise, which we had already established and agreed to at the BOA meeting. So again, we're here for no reason. We've already agreed and confirmed it. And

no more concerts downtown? Because technically, that's amplified music. Way amplified more than any of the businesses down here. So will there no longer be concerts? Because, again, like he he stated, it it I guess it conflicts with their television time during the day. those concerts go on until 10 p.m so are there no no longer going to be concerts because that's amplified music. A whole lot of amplified music. Just a question that I have. is So will that change? Will there be no more concerts? okay I

to be kind of a, we don't have a family, but you know, quiet, peaceful restaurants, places to go walk, all that sort of stuff. um And I've enjoyed watching the village steadily grow and become partly residential over my life in this area. um So it's a little bit of confusion over the past few people on exactly when the noise is. like she's admitted that they were playing amplified music until some point, and then we aren't. And so somebody is clearly playing amplified music out there that comes from that general direction. um When I'm ‸ I can hear from some of my rooms. I don't directly face it, but some of my rooms sort of do. um And as we've been told, it's so loud that you can already hear it through some of the storm shutters. um So in addition to being bothersome at night for current residents, I believe it's a very real possibility that this will impact the interest in future residents come this way. The council has recently approved a kind of complicated development over there at the old Barnett Bank, which I think is going to include residential, um maybe a lot of residential, and um some retail below that. kind of across the board throughout the city and readdressed. But there's clearly a lot of loud stuff coming from the direction of the Aqua Lounge. um And this does impact the future sale price of my unit whenever I decide to get a little older, um and also the interest of others moving in because the realtors and the community members do come to recognize that it's loud there and that isn't where you want to be to spend your uh you know extended periods of time. You can already see that happening in places like Orlando, Melbourne,
where the downtown is loud music, outdoor bars, marijuana dispensaries, tattoo parlors, and we can have some of all those things, but they don't need to all be crammed in the downtown place where we're trying to have these hundreds of residential units. So again, thanks for your attention. uh There's been some confusion as ‸ what's been said. uh to the environment that we have. um I think my only issue and the only thing that I'll speak to is um inequity. uh Obviously, um there are many businesses that operate uh past a certain time that have music. um And my issue really is simply that a certain type of business that appeals to a certain demographic um is the one that is is getting the most trouble at the moment. um And when there are other businesses within uh uh ‸ close uh proximity that also play loud music uh and that play equally loud music.

Thank you all for your service to the community. I myself am 36 year military and civil servant. So I get the service. I'm here as a concerned resident of the community. I love living in this community. We bought here two and a half years ago because we love to be able to walk downtown and go to the restaurants and listen to music, see shows and just have a nice place to go to. But when I get back home, usually by midnight because my grandmother said nothing good ever happens after midnight. I like for this city not to follow me into my residence. and
a.m and i'm hearing music blaring again through my storm shutters into my home and disturbing us, it's disturbing. So I went out on my balcony a couple times and looked out, and I saw a car sitting out in the parking lot, like in front of uh

out to get ready to call, PD pulls up, puts his lights on. This was at midnight, I believe. And I saw him walk to the door. They told him, no, it's the truck. I saw him walk towards the truck and it went off. So my point is, is you've got all the people out there. You've got the patrons doing their things out there. I think it doesn't matter how many seats are outside or how many tables are outside because there's going to be people out there anyway. I think what we need to do is just stop all the loud noise after those late hours in the whole city. Yeah, that's all I got.

throughout the city. I mean, can you imagine having the same issues in the neighborhoods west from here? I mean, loud music is not something that people need to live with. That's, it's that simple. ‸ Okay. ‸ But, not once has it been mentioned that up until 10, when you're supposed to cut off the music what's the decimal radio reading that you're going to be playing music up until 10. I mean, that's the deal right there. The way to solve this problem, and it's easy because
You can burn people's eardrums on the inside, and it doesn't travel like it does when you're outside. Wind plays a factor. Water plays a factor. And the tall concrete block buildings, it rolls right up to the 12th floor. The way to solve all this negativity and the negative statements that have been said, ‸ I don't like it, is no outside music. Now, there's a couple of businesses that have been in business already that have outside ‸ music, and they've never kept it at what the noise ordinance states, which is
Now, myself and the other people that had the appeal put together on another situation that wanted to do outside music, we have been calling for four years, meaning me and my neighbors, about the loud music in
It's not being enforced. And we don't need the ‸ decimal meter reading anymore. Because I can tell you now that when we hear it, by the time we go there and take the reading, it's 70 or 80 decimal meter readings. That's unbelievable. You cannot talk to each other while you're in the building. And that is how we know it's too loud. Because if we hear it, it's in the 70, 80 part. Okay? If it's 63 decimal
readings like it's supposed to be, we don't hear it. Because it's not blaring. It's not like uh you you, I've had people driving in their car calling me up. What is, why is the music so loud? I think it's wonderful. I owned my own business. I sold it. Our problem is consistency with noise. End of story. That's it. We still have a problem with the Georgian Dragon. I still make phone calls to the police department. You know, you have to enforce the laws that are there. They're entitled to run their business and have a business, but you've got to enforce the law. That's the problem. The ordinance is the problem. Nobody pays attention to it. Georgian Dragon doesn't pay attention to it. Nobody does. So, back it all up. Get code enforcement out at night, and let's do something about it. Start finding these businesses, and they will pay attention. Hit them where it hurts. Thank you. thank

for a list of information regarding calls of this type, this type, just a number of different types of calls. And the city responded to one out of seven or six, six or seven uh ‸ requests. So I don't have that information, although I requested it back in May. So, but we know from the people in our building that there are dozens of calls that have been made all in the same evening. Some of which are made by my children who are woken up before me. I have two of my five children that are living with me and they get woken up. Their bedrooms are situated a little differently, so some of us will hear it differently. But
and they initiate the calls because they're so disturbed as well. So this one call to the police department. uh Chief, are you aware of how many calls have been made?
that I received from our police department, we're not seeing where we're getting an astronomical number of calls there over the years. ‸ when we look at ‸ it's like a normal, any type business that's out there that may have some type of music or some type of crowd that may be there. We're not seeing nothing out of the ordinary, just to be fair.
yeah I was asking about the numbers, and so i I can attest when there's a statement that there is one call to the police, it's just simply not accurate. My household alone would be dozen to two dozen. So um also there was a question about the source of the noise. Question, how can you tell where the noise is coming from? That was a speaker after I spoke. And so I think I addressed that, which is that there are other folks who have testified having gone to the place, and
hearing it. You can tell because there is either two sources, because they're not playing the same music. ‸ when two sources are playing, it's different. It's mixed up. And when it's one source, you can hear it. It's the same. You're moving towards it. You don't even have to see it yet. You get there. You know that's what you're seeing because it's loud, very loud, and you're hearing it the whole way you're walking there. And then finally, you're at the source. There it is. So that's my testimony. Mr. Garganese took my hand raised, and I said that I am going to testify as to what I heard and saw. Also,

there are a number of people there is because they are attracting people to what they do. They're‸ attractive business. People don't come to businesses that aren't attractive. And so to that, they have a niche. They're fulfilling a niche. And I think that's wonderful. But there is a need for there to be peace, and there's a need for consistency, a need for there to be harmony amongst uses that are so close to each other. And so
were going to blare music. I don't know how the city did it, but basically shut that whole thing down a couple years ago. So you don't have to be a bar. You don't have to be a certain ethnicity with respect to owning your business.

alarm being triggered because a door got tugged too hard and it triggered an alarm. So looking at that, those are simple calls because obviously ADT is going to call the police to make sure there's not a theft in progress, which it wasn't. A kid was going to the hall bathroom, which we share a space, which some of you know about in that building. And when looking for the bathroom, they tugged the door and it triggered the alarm on multiple occasions, which the police then had to come out, file the report. beginning in regards to uh in order for all the eight things to be done before the approval, it was one of them stating, um ‸ I think it's what the proper licenses have to be done before it takes effect. There was a paper we did submit that do need to be signed in order for us to turn into DBPR in order to get the license. um so the steps, so the special reception was appeal first. And that's why we're here in the hearing to see if the, the, the expansion of the bar and lounge is going to go be extended to outdoors or just unit 116. After, uh we have a decision from today. you have to do a site plan amendment to address the expansion because it has to be reviewed by DRC for fire building.
