Transcript Partial transcript
Machine transcription of the meeting recording. The words are the recognizer's, except where a passage is marked as corrected or machine re-recognized; most have
not been checked against the audio, so words, numbers and names can be misheard.
It describes what was said. It cannot establish who voted how, an amount or an outcome — the City's
minutes do that (above).
A time links to its passage, and “Copy link” copies that link. “▶ Play” opens the recording at that moment, as the City's file, in a new tab.
186 suspect passage(s) marked in place.
How this transcript was made. New machine transcription of the whole recording, with 12 voices separated from the audio.
18 short machine repair(s) (29 word(s)) are labelled in place, with the original words beside them: an ordinary word was replaced only where two further machine readings agreed on a different one.
Checks run on this transcript: the recognizer's own warning signs, whether a voice was detected where the words are and a language review for likely mishearings.
A second, independent machine reading was compared with it word by word: the same words for 90.7% of 7,940 content words.
Dotted words (195 places) are ordinary wording differences: hover or tap to see the other reading.
186 passages (25% of the words) are marked suspect: their words are not shown ("unclear audio") and support no statement: numbers, amounts, negation or names differ; the language review questioned them; or no voice was detected there.
Agreement between two machine readings is not verification.
Speakers were separated by voice. A plain name rests on evidence tied to that voice; “provisional” is a name from an earlier text-only pass and is not verified; “Speaker N” is an unidentified voice.
I pledge allegiance to the flag of the United States of America and to the republic for which it stands, one nation, under God, indivisible, with liberty and justice for all.

Thank you, ma'am. All right. So, can I get a motion to ‸ approve the minutes? Or make adjustments as needed? ‸ The first one is the agenda. Approval of the agenda. Oh, ‸ I apologize.

The applicable city zoning category is RU17. The underlying future land use category is very low density residential. This category allows up to four dwelling units per acre as well as residential dwelling types similar to those being requested.
when they're abutting a natural water body. So that's the reasoning for the red. That can look maybe negative on the screen, but it's ‸ actually not proposed to be impacted. ‸ Those areas will remain as preservation. You can see ‸ the lots are shown in the peach and yellow color. The site is predominantly the 40-foot wide lots shown in yellow.
as the portion of the north are the 50-foot wide lots. You'll also note near the Plucky Bomb entrance there is a red area that's shaded and that is their on-site amenity center for use by the residents. The perimeter buffers are 25 feet in width and as noted on the site plan, there are areas where there'll be some fencing and walls where the proposed homes abut existing development surrounding the property. I've covered most of these in terms of the lot mix. The site will and must meet our open space requirements in the land development code, which is just under 15 acres of open space.
our code for what can contribute to open space. It was noted in the staff report there are a significant amount of wetlands on the property. There is a significant amount of wetlands being impacted. There's also wetlands being preserved. We have worked with the applicant and requested additional information through the review process to ensure that the wetlands they're impacting are in fact low quality. So getting that data is part of the environmental report. And they also provided data from the St. Johns River Water Management District that also corroborated the idea that they're impacting lower quality wetlands that are not really contributing. To the ecology of the area and
So we were able to come to a finding based on the information they provided that this will be an overall enhancement to the area once they're done restoration ‸ of the preserve areas. They provided elevations within their package. You'll note for about six of the elevations.
door paint color so that we could ensure that all of the 70 elevations they provided are of a quality. that would be what the city of Cocoa would like to see out of the project so these are just a selection of some of the different 40 and 50 foot wide product types that they would fit on these lots. And
report and run with the project so then what comes back for final PUD and then subsequent approvals we would make sure that the elevations match what you're seeing here today. in our staff report, we did a detailed ‸ review of the project's consistency with the comprehensive plan. This is below the maximum allowable density in the underlying very low density

land use category. It comes in at three units per acre, whereas that court category allows up to four. It's also consistent in that it will not overburden the roadway network as required in your transportation element. There's water and sewer through cocoa and Rockledge to provide for the project and

they will have to pay mitigation or purchase mitigation credits through the water management district also to offset the wetland impacts. We are proposing six conditions of approval for the project. Just outlining that the project, when it comes back for final PUD must comply with the plans that you're seeing here today in terms of the layout the buffers all of the details. We also wanted to attach the elevations to ensure that the ultimate product will comply with what you're seeing and recommending approval of. Also, the

easement on the west side of the property to handle stormwater management and conveyance and then condition six is just another safeguard for the city that when this comes back at the final PUD stage that there is a full stormwater management design to the satisfaction of the public works director based on a methodology and inputs from the public works department to make sure that this site will not adversely impact the surrounding area in terms of water management so it's it's relatively atypical to have detailed stormwater management design at this early stage so we felt comfortable with this condition that we could recommend moving forward with the understanding all these details would would come forward at final PUD with that I'm available for any questions you may have
you I see the site plan here that you originally put on the top there, first showing, that's a little different than this plan that I see is that because there's a difference of lot sizes or water mitigation
that's I think page four of the site plan set this is actually the open space exhibit we cropped because ‸ it it's the same exact layout it just shows the areas where the open space calculation was done but it is the same layout the lot sizes are the same as what is represented in the site plan, which is exhibit A.

I think it is an industry standard term used when speaking of native vegetation so exotic means it's not native to Florida and has a tendency to overtake native vegetation so we can use different terminology certainly but you're spot on

Marcus when it does rain without this property being developed yet there has been issues that he identified that I've had other people that were bringing the same subjects up for another project that

it's in that area and they satisfied the water issue there have and I don't think there's been problems since they got approved for that so that's something I'd like to ask later but I'm curious you know what the ratio is because with it being vacant it does hold water and then eventually it dissipates just like Marcus had asked ‸ so with being on-site retention you know that helps to support what the property was doing there already before it was developed

We are required to meet what's called a pre-post condition, so pre-development condition versus post-development condition. We are not allowed to exceed that amount of water that currently today discharge is off the site in our post-development condition. So we have to retain all of that water on site and only release at that particular rate. We're working on the calculations right now to give you an idea of what a stormwater ‸ area size is relative to the overall site.

‸ Is that better? A little bit better? Do I need to start over or was I loud enough? That's okay. So ‸ about 33% of the site. I feel like I'm really loud. And we're already in for St. John's River Water Management District permitting.
time they're going back in through minor of the final set of comment reviews. Our wetland mitigation components are nearly complete. You would ask a question about their low quality functionality of them.

So they're exceptionally low. And in fact, the reason that there's wetlands on site is because in this project's previous life when it was as it operated as an agricultural operation for about 80 years, it was pumped. And when those pumps and everything turned off, the wetlands came in. It's based on a hydric soils condition. So there's not actually any kind of flora or fauna there. There's no
No, sir. Now, that being said, I can't stop someone from buying a home and then renting ‸ out. But no, it is a fee simple home ownership structure, not for rent community.

really is just identifying how we calculated the open space requirement. But below that there is a green space there. So there will be a buffer to an extent in that area. It's required by code. We do have plans to landscape that. And we are going to be, I'll call it softening the backside of the plucky bomb. We call it a ditch.
And so we do want to enhance that area to make it look more presentable. And so there will be significant landscaping that's installed along that area. And then the other portion of our open space component, or one of the open space components, is putting a trail system there. And that's probably the one thing that I didn't mention, or that ‸ was left out of the presentation. I just want to point out that in addition to there being a cabana and a pool and a beachfront area in that kind of central location there on the site, there is a pedestrian trail system that's proposed. In addition to that, there will be

But that's what the amenity center will in fact look like. We've constructed that one before, and that's what we intend for this one to look like as well. And because I'm standing in front of the other one, I'm just going to bring it up here and hold it. This is an example of a recently constructed trail system with the signage that I'm talking about. There's like a trail map and then there's, you know, indication of the native species and what you're going to see there. This project was recently constructed in Palm Bay. It's called the Timbers. So if you ever wanted to take down, take a drive down south and see a really ‸ nice product, this is what it looks like. And then in addition to that, we're going to have a floating dock in one of those lakes. You can see it on the exhibit. And just wanted to point out some of those amenity systems.

believe, ‸ a four to one side slope. It'll be sodded two feet down below the water's edge. So during the dry months, you don't see an eroded lake bank. But they will be significant stormwater bodies, lakes. They're also going to be stocked with fish. That's one of the other amenity features that ‸ folks like to fish. Kids like to ‸ go out there and throw a pole. And
The amenities. So I see there's a pool, there's a clubhouse, and ‸ I assume there's going to be, you know, stuff for the kids, swing sets, things of that nature.

there is a tot lot in that same vicinity around that parking area, as you can see centrally located. We recognize that, you know, families and kids will, you know, we hope flock to this community and call it home.
it to me, I thought, yeah, that doesn't sound like a great idea. There's alligators in those lakes, snakes, things like that. But really what they do is they bring in some sand. They put some Adirondack chairs in that, they're back to the lake and face forward. Sometimes they ‸ put, you know, some sand related games, bocce ball, things like that, that just add a different flavor to the community, palm trees, things like that. And that's proposed ‸ for this particular location as well.
Correct. It's going to connect to the existing lake, or I'm sorry, the existing sidewalk that Lakeside Palms constructed. We'll pick up from there and bring it south.

about the trees. The city's known for its oak trees and I've been already labeled as a tree lugger, but I just was curious if, and I know the code has certain requirements.
respectfully, the Lennar has a very robust planting system. The majority of the builders I work with, they definitely outshine everyone when it comes to landscaping. So I think you'll be very pleased in what is proposed, at least along those perimeter buffers, and then in their building packages on their homes as well.

staff conditions in there and we just want to, uh, we've talked to staff ahead of time. Uh, we still need to coordinate with your public works department. There's two comments on there, specifically the sidewalk along Plucky Bomb and then the width of the drainage easement along the western boundary line. We're not opposed to either of those. We just need to talk through those a little bit and modify, uh, and get comfortable with those conditions with staff. So I just wanted to let you know that, uh, we will be working with them and we've met with both or spoken with both, uh, your city attorney and, uh, planning director to discuss those items.
Alright, ‸ thank you very much. Absolutely. Alright. ‸ Any further questions before we can ask for a motion maybe after that? Anybody have a motion ‸ to propose?

there is, um, two items that I had, uh, done some reading on that. It really plays into what this board, um, has been presented and we had to deal with. And I thought, well, you know, I don't want us to look like that. We're the only ones on the planet that have issues when it comes to trees and being removed, probably, you know, incorrectly or without approval, things like that. So, ‸ and I didn't have enough funds to make enough copies for everybody, but I'm

another private individual, uh, ‸ cut down. And they had hired what they called, uh, an expert and stated the tree was, uh, dying and that it was good to go ahead and remove it. So they started doing that without approval. And yet
uh, which was another subdivision. The tree is not dead. It's an ancient tree. So it's in the later stages of life, but it's in good condition. And they also saw that it was branching as well. So, uh, these live oaks, these trees can live up to a thousand years, but you can take one down in a half hour to an hour. So, uh, the idea that I thought was interesting where we've had before. Before the board where someone would say that the tree was dead and then once the trees removed, it wasn't dead. So we're going to have to be real careful, uh, if to avoid something like this. And I thought I'd just share with the board an example of what's happened with other cities. We're not the only one that's having these unique points brought up.

I'll just say the city does have penalties in the city code for removal of trees without a permit. There can be fine and we have this laid out in the landscaping code, but basically there

per tree that is removed. um And that, because that tree is gone forever, it's an irreplaceable violation, right? So, and those, though the code board does hear those cases on occasion. So, I just wanted to provide that information to, in response to your, to your comments.
And I'm very familiar. I'm glad that the city does have those guidelines. But it's situations where even though we had the guidelines, we've experienced where trees have been removed and it was not following the right guidelines. And it can get messy like those two examples. So I just want everybody to know that we're not the only city having to deal with this type of experience. now I'm very proud of this board being that strong about trees. I'm very happy that this board is like that because

correct. The, uh as we've talked about before, many of the applications that come before you are quasi judicial which means that you are required to make your decisions based on the record of evidence that's presented to you at the hearing. There is. So, yeah, there are some legal aspects to this. So, um again, most of the decisions that we make are quasi-judicial, which means that when, uh well, even those that aren't quasi-judicial, the the record that we build and we create,
the documents that are given to you are part of that record. And it's important that you are given all of those because otherwise, um you know, let's say, for example,
If that traffic impact analysis is not given to you, it's like it doesn't exist, basically, because it has to be in the record and it has to be given to you, the board, which are the decision makers. The staff are not the decision makers. But in the same context,
if you're going to give it to me, then there should be an onus of responsibility you need to have time to read it. You can't give it to me on ‸ Friday and expect me to be well prepared on a Wednesday and think I'm going to know all this stuff, for example. You're overloaded someone with with information. I mean, and that's just true. I know there's a certain turnaround time cutoffs, and but but if it's going to be, and maybe this is what I'm employing to move forward,
is being given, not saying this is complex, if we all uniformly agreed on it, but in terms of the data that's being presented, then maybe the data needs to be given to us in in meeting A, and then decision is allowed to be made in inin meeting B, because that way it gives someone time to actually,
‸ if you're saying to me, and I do it at work all the time, well, it was in here. Not my fault you didn't read it, but it was in here. That's what you're really saying. Well, thanks for letting me know it was in here. Didn't change the situation that's already occurred. So

Well, I guess the only other thing I would say is, and I know you addressed the staff reports. The staff reports are intended to essentially give you the high level you know summary of a lot of these documents that you're getting. um And so if there's something that you have a concern about, then you might be diving deeper into some of the you know into the technical reports. But there is, um again, you know, the staff report is there to try to provide some analysis to you of all of the all of the documents that you're being given. I don't know. Can
I add something else to this subject? Yes. One other thing that you could possibly do, Marcus, if anybody on the board is not comfortable with exactly what you're talking about, you could bring it up for discussion and ask to have it delayed and re-presented, if it's that way when it's being presented. uh Because that's another possibility. I've seen that done before, where the council said uh on the issues that come up, we need more information, more time. Can you bring it back again and table it? Am I correct about that, uh
or a motion can be made to postpone. I i mean, if it was if that were the case, that we would ask that you do it to a time certain, right? Because most of the things are advertised and that preserves the advertisement. um But if if it becomes an issue where a majority of the board feels that they need additional time or additional information, postponing to a time certain is always an option. um Yeah.
