III. Delegations:
1. Lisa McDermott. 2231 Canterbury Street, Melbourne, FL 32935. In & Out
Liquors, Inc. on 1035 King Street, Cocoa, FL 32922.
i. General Manager. Try to get some support of May 12, 2023 Zoning
Verification Letter purchased 1035 King Street. Closed Sept. 23, 2023.
$450k for Liquor License. Dec. 13, 2024 to Dec. 23, 2024 Special
Ordinance. Denial Letter. $650,000 invested in the property; $450,000 for
liquor license; help with the Council to get a BTR. Zoning did not change
until after; feel they should be approved a BTR ‘grandfathered in.’ She has
all the paperwork.
ii. Agency Member BROWN asked if the City Manager can b ring us up to
date. This is the Old Hess Station, across from Wawa, on the corner of
Fiske and SR 520.
iii. Agency Attorney COLOMBO: The Agency Board lacks “ Subject Matter
Jurisdiction.” We do not have any action you can take, you can ask
questions.
iv. Agency Member BROWN: did you consider the church, King Street
Baptist, or his church, both less than half mile away and two other churches
and Provost Park – all nearby. At Wawa, they can purchase alcohol; they
come in and they leave.
v. Chairperson MOORE asked the City Manager for details.
vi. Manager WHITTEN explained that this location is the site of the o ld Hess
Station. Corner of SR 520 and Fiske. A Zoning Verification Letter was
sent in May explaining the current zoning and the future land use. Subject
to change. Proposed Project deemed according to Code; City of Cocoa,
disclaims any liability. Regulations could change; letter does not give you
authority to do a project. Change the Use of the Property, Site Plan
Approval Process. BTR says only that you have a license to operate. Not
issued. Advised by Staff, you must do a Site Plan Amendment. The
Ordinance is being modified. Policy direction no BTR be issued for those
properties want to redevelop next to those churches, etc.
vii. Rebuttal: BTR. Currently under review. Charlene Neuterman email; John
Haight email. Still awaiting reply. Manager WHITTEN: planners work
for him. Zoning allowed, at time, but Council changed that and notified of
the intent to change, as required. Minor Site Plan, gets approved by City
Manager. Allowed under Zoning, not Site Plan Review; it’s not done. Had
a year to start the process; they did not do that.
viii. She claims that is not fair.
ix. Agency Attorney COLOMBO reminded the Agency that she can speak, but,
no weight; unless Owner or Attorney; This Board can take no action. She
wants support with Council.
x. Manager WHITTEN: ordinance has not been changed yet; Notice of Intent
to Change it, you are governed by that notice.
xi. Chairperson MOORE: I will take the lead from our attorney; we appreciate
your dilemma, we have to follow the process; we are waiting as you are; we
suggest, follow those means, we can only listen, and we have.
xii. Thank you for listening.
IV. Presentations: None.

budget for FY25.

ii. Discussion.
1. Chairperson MOORE asked if the budget is okay?
2. Director NEUTERMAN responded that it can; funds
are available. We can discuss for one per year or if you
want to increase for FY26. This is also recommended
because Cocoa CRA already approved the same
measure already. This will allow both CRAs to match.
3. Agency Member FOX asked why the need for the
increase?
4. Director NEUTERMAN replied that it is due primarily
to the precipitous increase in material costs in recent
years. Too little of an incentive to use it at current rate.
5. Chairperson MOORE asked about the status of the
Commissary Kitchen that was working on an
application previously. Director NEUTERMAN
replied that they are still working with the Planning
Division to complete their required Site Plan.
iii. Vote.

calibrate instrumentation, package filters; perimeter
monitoring, off-gassing of waste sites, provide analysis.
How many employees? 8. How many live in DS?
None. How is Diamond Square benefitting? Would you
employ someone from Diamond Square? Ray,
responded, please send me someone! I’m short-staffed.

3. Request Agency approval of a Budget Resolution to Amend the FY25 Budget,
BAF # 25-035-A, in the amount of $10,000, to top-off the Contract Services
account, to allow it to contain full funding for the fiscal year for both programs
that it pays for.
i. Introduction. Director NEUTERMAN introduced the item. We increased
ANR (Alliance for Neighborhood Restoration) this year by $10,000 this
year; this cleans up for Contract Services, to add those funds.
ii. Discussion. None.
iii. Vote.

discount. One third would be approximately $1,200? Correct.
4. Chairperson MOORE asked what the height of the sign would be?
Director NEUTERMAN replied that is dependent on the visibility
for Right of Way for Traffic. MOORE: is this the correct
Coloring? NEUTERMAN: I believe it is a rendition of the
coloring.
5. Agency Member BROWN asked about lighting. Director
NEUTERMAN said that Habitat is looking into securing solar
lighting.
6. Chairperson MOORE:
a. 1/3 – DSCRA
b. 1/3 – City

Reverter clause; approved March 2010. Reverter clause states four
years if not developed, reverts to the City of Cocoa.
2. Agency Member BROWN stated that we should have been
informed; On Nov. 16, 2020, we paid a consultant $3,100 to survey
those two lots. March 10, 2014 reverted. Why did we pay for an
appraisal. Wants the $3,100 back.
3. Manager WHITTEN: that’s fair; we became aware looking at the
deed. City property, no problem paying back the $3,100.
a. Chairperson MOORE: concerned with the property itself.
She thought it belonged to DSCRA.
b. Agency Member BROWN: Rose Garden wanted it for
parking.
c. Chairperson MOORE: when did you become aware.
d. Manager WHITTEN: he had a meeting let me look at the
property – the DEED, 2014 – he happened to look at those
when he found it.
e. Agency Member FOX: is there a reason the City can’t just
give back to DSCRA?
f. Manager WHITTEN: property must properly dispose of the
property. Despite whoever owns it, the Agency will have a
say it was is developed on that site, because it is within the
Agency boundaries. If you want to make a Request to
Council to convey the property; and put a timeline on it, you
are welcome to do so.
g. Agency Member BROWN wants to withdraw the request fo
the $3,100 survey and instead wants to value of the property
back; estimated at $50,000.

the City, he believes already refunded the $50,000 to the
CRA. Accounting will have to verify to be certain.

Funds were transferred to the Agency.
m. Agency Attorney COLOMBO: not on anyone’s radar. You
can make a motion.
n. Manager WHITTEN: we wouldn’t make plans without

that. Its in the CRA district, so must come to you.

q. Manager WHITTEN: yes, it is helpful to get you to develop
it.
r. Director NEUTERMAN: reminder, the current sunset date

s. Agency Member FOX: is all of DSCRA zoned for single
family?
t. Manager WHITTEN: no; however, there is a lot to fix; the
visioning process – East to Fiske, etc. good place to discuss,
as it will involve a number of d iscussions on SR 520, may
involve Comp Plan changes and Zoning changes. RU 210 –
may be, the proper zoning when the time comes.
NOTE FOR THE RECORD: Agency Liaison GOINS joined the meeting @ 7:38 PM.

Transcript Partial transcript
Machine transcription of the meeting recording. The words are the recognizer's, except where a passage is marked as corrected or machine re-recognized; most have
not been checked against the audio, so words, numbers and names can be misheard.
It describes what was said. It cannot establish who voted how, an amount or an outcome — the City's
minutes do that (above).
A time links to its passage, and “Copy link” copies that link. “▶ Play” opens the recording at that moment, as the City's file, in a new tab.
378 suspect passage(s) marked in place; inspection incomplete: language review; 1 stretch(es) where a voice was detected and no words were recognized.
How this transcript was made. New machine transcription of the whole recording, with 14 voices separated from the audio.
35 short machine repair(s) (39 word(s)) are labelled in place, with the original words beside them: an ordinary word was replaced only where two further machine readings agreed on a different one.
Checks run on this transcript: the recognizer's own warning signs and whether a voice was detected where the words are. Not completed: language review.
A second, independent machine reading was compared with it word by word: the same words for 92.9% of 17,710 content words.
Dotted words (570 places) are ordinary wording differences: hover or tap to see the other reading.
378 passages (23% of the words) are marked suspect: their words are not shown ("unclear audio") and support no statement: numbers, amounts, negation or names differ; the language review questioned them; or no voice was detected there.
Agreement between two machine readings is not verification.
Inspection is incomplete: language review.
Voice detected, no words recognized (1 stretch). Something may have been said here that the transcript does not have:
01:46:20 (8 s) — neither reading has words
Speakers were separated by voice. A plain name rests on evidence tied to that voice; “provisional” is a name from an earlier text-only pass and is not verified; “Speaker N” is an unidentified voice.

Yeah, yeah you'd be happy to, Madam Chair. And so this is the old, if you've been around for any amount of time it's the old Hess station and the old Hess station is on the corner at the intersection of 520 and Fisk and so I'm gonna I'm gonna read for you the zoning verification letter because as Mrs. McDermott says they got that back in May and then I'll take you through the process and so this is about a liquor store in the old Hess establishing a liquor store in the at the old Hess filling station there and so I'll try to enunciate better than I normally do but this is the zoning verification letter

the process to actually get into this property, to reuse, to repurpose it as a liquor store would have had to go through a site plan amendment process. Well, they never submitted for that site plan amendment. And on the on at the meeting in December, the board decided as a matter of policy, and I don't need to tell you guys about Provost Park, but so as a matter of policy, the council decided that we don't want to cite liquor stores within,

And so, again, they're well within their authority to set that as a policy. They've set that as policy. They're in the process of changing the ordinance. The ordinance has not changed yet. And so it will go through two council hearings to actually change the ordinance. But again, that

back to us. um He was looking for a minor site plan amendments. And we haven't heard back from him yet. So we're still waiting on him. uh of the intent to change that. And so they're in the process of changing that. The minor site plan would have been due had they not changed any of that. A minor site plan is approved by the city manager. And so John working for the city manager can provide them no further direction because the council has spoken on the issue. And so they won't get a letter from John, uh again, advising them that this is the process for a site plan. Again, what's permissible on the zoning code means it's simply allowed under the zoning code. It's permitted under the zoning code. Whether your project ultimately gets developed has to go into the site plan review and approval process. They didn't get there. And if you really if you really want to talk about dates, they had a year to actually get in that process and start that process. And they didn't do that. And so, again, the letter is pretty clear. The letter advises you that you shouldn't rely on this because it's simply a zoning verification letter and not an approval to go forward with any project of any sort.

Thank you, Madam Chair. So the first action would be to um to make sure that the budget can handle whatever the request will be in the second action. Is that right what we're moving towards on this?
Yes, the Commercial Facade Improvement Program budget uh was recommended to be increased to accommodate, you know, larger requests for individuals who would like to make more improvements.

this uh request um being that amount and our next one is requesting that amount, the action does that leave us uh leeway to add to that particular uh ‸ program yes so choose?
Yes, Madam Chair. You have funds left in the contingency account that you can actually transfer. Should we get another request in for a Commercial Facade Improvement Program? We will bring that before you and and transfer the funds at that time based on the request. And then when we budget for next year, we'll we'll have that conversation with the agency whether or not to budget just for one grant per year or to do two or three grants per year.
No, the increase was actually brought to us as a request because the cost for services and for materials for a lot of these improvements are a lot higher than they used to be. And and so we want to be able to provide a better match to to hopefully generate some more interest. Yes. I mean, that's definitely something that we would love to see more interest in it and and see more of our businesses in in the Diamond Square and in

Avenue side of the property. There'll be four of those. um This is also an evergreen and they have very beautiful silvery colored leaves with small flowers and small cone-like fruit that the birds love. and This is a native tree of Florida and the thing about that is ‸ they they last and they stay beautiful and they can endure our weather and sun and and our soils. They have a beautiful um thick rounded leaf and they have um large white showy flowers and a light green fruit that the birds love. The last one is the Podocarpus. It too is an evergreen. um It's an excellent shrub plant. It has a leathery dark green leaf
So all of these plants that we've chosen are either native plants to Florida or they're very drought tolerant and have adapted well to Florida, which um will make this plan stay stay beautiful and easy to to take care of and care for. you know that could be you know obviously I don't think that uh the consultant and the rewrite of the plan, um he may or may not have considered what to do with that and made some suggestions, but we can certainly talk to him about that. well I think you should put yourself on the clock you know and so and so just to have it in Diamond Square I mean it mean you may not want to do the four years, you may want to do five or ten, you know, but but put yourself on the clock, you know, because because again, if the clock is always ticking, then there's a sense of urgency that's put in people, you know, and so so put yourself on the clock. um ‸ not sure that uh anybody on the council would object you know again because it's the Diamond Square community that we're trying to build up so the

know, I know we have needs in, um in our community, Diamond Square community. One of the big needs, and that doesn't sound like this can go in that particular piece of property. about where can we as a board. And since we don't own prop that's where you know when we we miss our opportunity when we don't own anything. You know, it's just like family. Family doesn't own anything. It doesn't have any heritage or wealth. We don't have any heritage of wealth.

instead of maybe, instead of a long way like a plaza, can you build the businesses on top of each other? Like if you go to Winter Garden or Orlando, they'll have the businesses sitting on top of each other along with, and then apartments on top of that. So you can knock out two birds with one stone, which will draw the community, you know, a new breed of people that we're asking for. Instead of just sitting here, I would hate for us to sit here and retrieve the property back, which I do want. But for us to have come back to this place, we can't come back to this same place again.

And the whole mixed use concept, that's a sort of mixed use concept okay you can have, where you can have uh uh ‸ commercial retail office on the, on the ground floor. have a question for the city manager. The pictures that were on the website of the Lamar homes. Are those the ones that you're looking at to go into the ‸ Diamond Square?
I thought did we we I thought we showed you the elevations. Elevations. Yeah. Yeah. Yeah. So we we did show you the elevations there. And again a different concept.
know the beauty of that is is that there are 17 remaining lots there. They're going to split those into their paying per split for those. And so the proposal on the table was 15,000 per split. And so they'll get 32 homes on it.

you know, they were requested because of the school and the church and other things. So they finally got installed. The last few got installed last this week. Um,
no, Friday was it was the last day. Um, so they got installed. Stop signs on stone street have the flashing lights. Um, they got installed on. And if you know, those who haven't been on, um, diamond square board, you know, in the past, the diamond square board was charged to pay for a lot of those upgrades. Um,
the city took on that effort instead of having a diamond square pay for it. And so I'm sure I know you remember those, those days when everything that had to be done through diamond square. So, uh, I want to highlight that. So appreciate the council for, uh, agreeing with me on that to get that done.
Um, another opportunity to ‸ try to negotiate some things inside the community. Um, I am working on trying to convince the council to, um, to really support the museum. And I need you guys help. All right. Um, I don't know what this conversation is going to be. I don't know where we're going to go with it, but I'm going
try my best to try to get the museum to be functional open. Um, and so I don't know what that may look like as far as the diamond square, uh, partnering with the city. Um, I know it's going to be a cost. Um, we've

a part of diamond square. It's in the heart of diamond square. And so I'm asking for you to consider later on, just keeping in your mind that I may come back and say, Hey, look, uh,

hopefully. And so we want to try to get something done within the next few years. Uh, we, we know with help of staff and Charlene and everyone else getting grants where we're getting there. there. And so I'm saying that one more time, there's power in the motions that you make. And so if we decide to do the five, four, whatever it is, you as a group need to make that motion for whatever it is that you want. And let's get this thing done. We don't have a lot of time. And I said this in our council meeting too recently. Um, I'm not going to be on council. I got maybe another year and a half, two years. The things that we need to do. We, I don't know who's going to come behind me. I don't know who's going to come behind anybody else on council.
So whatever it is that we need to vote on, let's vote on it. And let's push whatever amount that we have. We need to just get it done. Just, I'm just trying to help you understand that.
Uh, if you have things inside of your district or where you live, shoot those emails to those council members. Um, because it may be some things they put in their priorities that may not be what you want. And so we have March 4th coming up and I,

Um, I think we have a lot of good conversations. I know Mr. Brown has been talking. Um, hopefully people say what they're going to do, what they say they they're going to do. And that would be good. It was unfortunate that it happened.
All right. Staff, do you have any additional information we may need to know tonight? No, Madam Chair. Okay. I passed out the booklets that I had before. I wanted everyone to have it. There are a lot of good ideas inside of that. We talked about murals. We talked about, um, street art. And you'll see examples of that inside of that booklet as well. Uh, so just, uh, future projects. We got visioning coming up.
in our plan. We want to have things in our plan that, you know, low hanging fruit, so to speak, that says we're doing what we're supposed to be doing to a beautify, uh, diamond square, and moving it forward, uh, as well.
ones, so I'll make sure you get one. Okay. Okay. All right. But, um, some excellent examples of what we were thinking of when we went to our, um, to our conference. We saw some of those examples in that book where there was, um, neighborhood art, uh, on the walls, murals. Uh, and also, um, I don't know if we saw a mural in the street. I think, I think we may have seen one or two down by the, um, I think there was a museum, um, that had some art on the street. But,
CRA projects. Um, I will share that with city so that you can see what I saw, uh, because PNC is right across the street from my house. And so I was thinking about, you know, going over and just sitting down with someone and seeing if they knew about this particular,
it before we make those inquiries. Uh, but it was a, it was a mandate that came down from corporate. The PNC banks have, uh, dedicated a certain amount of money towards all
If we can gather that information, that would be great to involve them in partnership with us and some of the things that we're doing. That's all I have. Any, uh,
