Transcript Partial transcript
Machine transcription of the meeting recording. The words are the recognizer's, except where a passage is marked as corrected or machine re-recognized; most have
not been checked against the audio, so words, numbers and names can be misheard.
It describes what was said. It cannot establish who voted how, an amount or an outcome — the City's
minutes do that (above).
A time links to its passage, and “Copy link” copies that link. “▶ Play” opens the recording at that moment, on YouTube, in a new tab.
734 suspect passage(s) marked in place; inspection incomplete: language review; 2 stretch(es) where a voice was detected and no words were recognized.
How this transcript was made. New machine transcription of the whole recording, with 33 voices separated from the audio.
59 short machine repair(s) (76 word(s)) are labelled in place, with the original words beside them: an ordinary word was replaced only where two further machine readings agreed on a different one.
Checks run on this transcript: the recognizer's own warning signs and whether a voice was detected where the words are. Not completed: language review.
A second, independent machine reading was compared with it word by word: the same words for 89.8% of 28,170 content words.
Dotted words (793 places) are ordinary wording differences: hover or tap to see the other reading.
734 passages (23% of the words) are marked suspect: their words are not shown ("unclear audio") and support no statement: numbers, amounts, negation or names differ; the language review questioned them; or no voice was detected there.
Agreement between two machine readings is not verification.
Inspection is incomplete: language review.
Voice detected, no words recognized (2 stretches). Something may have been said here that the transcript does not have:
01:43:42 (8 s) — neither reading has words
02:38:09 (6 s) — neither reading has words
Speakers were separated by voice. A plain name rests on evidence tied to that voice; “provisional” is a name from an earlier text-only pass and is not verified; “Speaker N” is an unidentified voice.

Dear Heavenly Father, we thank you for this day. We thank you for this opportunity to be here. We ask you to guide us tonight through the city business. And, Father, we just thank you for everyone that's here that helped through that city business tonight. We ask you just prepare us and let us go about taking care of things as would be fit for our city. In Jesus' name we pray. Amen. Amen.

reason I'm up here is, as you know, at your father's funeral, which ‸ I was honored. And I thank you for that. Also, I want to mention the police action during that. The traffic control was outstanding. They did one heck of a job of keeping the traffic away from the road and just rolling us on, keeping us going. A very, very good job. Chief,
did a heck, your men did a heck of a job. And I just want to pass that on. And, of course, it's getting lonely here, Friday. And ‸ they're leaving me behind. Okay. Thank you.

Mayor, council, I'm very thankful for the opportunity to share just a little bit with all of you and encourage every person, not only on this council and in this room,

a part of the Martin Luther King activities. Martin Luther King made an interesting statement, but I think it's one that's very true. The statement was this. We may have all come in on different ships, but we're all in the same boat now. And he said that. I ‸ think it's very, very astute for him to have made that quote because he understood what happened to one of us affects all of us. I'm here really to encourage all of you to be a part of the march, the MLK march that will

the back of Provost Park, east and will come all the way east into the entrance of Riverfront Park. The reason this is so important is that, first of all, Martin Luther King did not just represent African American interests. He was concerned about brotherhood and love for all people. It just so happened that he understood that the situations and the conditions for African Americans were disproportionate and he wanted to do his very best to create an equal playing ground. I think that's very important now.
because of the challenges that we face here in the United States of America. So I want to encourage and challenge this August group to be a part of that march. On the 17th, if you would want to be a part of this, on the 17th of January, there will be a memorial service that will take place at the Zion

and you want to be a part of that. There's a new pastor at Friendship Primitive Baptist Church that will be the speaker at that event. At the event on Monday, there will be a wonderful ‸ young man that will be speaking. Rashad Wilson is his name. He's the principal, as most of you know, of Endeavor Elementary, and I think this young man is going to have a whole lot to say, not only to the adults that will be there, but to the young people that will be there because there's a great need to reach out to them. So I want to encourage you to be a part of it. In fact,
event. Council, we're asking that you would march with us. It's even though many times we've done this, it's festive, but it's very serious to me. I told my assistant today, she said, Pastor, am I going to be off? I said, yes, you'll be off, but you need to be on. And she said, what are you talking about? And I explained to her that this day came about because somebody had to die for the freedom and for the freedoms, many of the kinds of freedoms that we enjoy. So I'm just asking that you would march with us in recognition of not only the past, but to challenge the future. And as you do that, I'm sure you'll be blessed and the city will be blessed. Thank you so much.

Yes. Those who are not able to march, absolutely. We do gather for service at the very end of the march at 3 o'clock. Thank you, city manager. ‸ And so we're asking that the council would be a part of that particular gathering as well.

Yes, I ‸ do. So, guys, I'm going to make this one brief. On the camera issue in the community, in the event that we have any new news, I wanted to make it clear. Outside of the cameras that have been publicly announced that are installed on my property in that general area,
Those homeowners, I mean, Chief Cantaloupe in the city will be notified where those cameras are at and located in the event that they need something from them. But I really don't want to put homeowners out on the 6 o'clock news kind of thing. Okay. We will be getting two more installations done between tomorrow and Thursday. Sorry, I'm working a little slow.
So we really need to do something about specific drug houses in Broadmoor Acres. We've done quite a good job at bringing neighbors together that's keeping an eye out and at least letting people know what's going on. But we've got houses in this neighborhood that it has to be obvious to different agencies what's going on. Because, I mean, you don't even have to live there. You can just drive through there and you know what's going on. I mean,
1055 just recently rented the place. And they almost actually rented the property next door to me that shouldn't even be rentable. But to have residents being woke up at 2 and 3 in the morning because people are banging on doors, you know, and screaming back and forth and doing drug deals. And, I mean, literally, this ‸ really is a drive-through market right now. And we really need to try to figure out how to curb it. Okay? Other than that, I would like to specifically

resolve an issue. I want to acknowledge Ed and Public Works for getting some signage fixed. That Olive Street and Park Drive, I remembered what we addressed that. ‸ The neighborhood's slowly getting cleaned up. And code enforcement's doing a pretty good job on their own, too.

And ‸ so the thing is, I know we don't have it worked out, but work with the city. And the attorney's going to come out with something at some point soon. Okay. And perfect this thing because we're going to do the same thing down at
I won't say which little birdie that is, but she's the prettiest one on the council. Although Mr. Blake's wearing the color of royalty. I had whispered something in my ear, and I don't know that Night Owl can afford to actually donate equipment.

Wow. Strong, right? But Emma and I just switched jobs, you know, so we can keep the continuity going. We've got some good stuff going on, and we plan on continuing the good work that we've been doing, the great events that are going on. We're in a little bit of a lull as far as events go right now.
This Saturday, that's a once-a-month thing. Then the next event is Sip and Stroll on February 13th. That's a Friday night from 5 to 9. That will be a wonderful, romantic thing for people to be doing together before Valentine's Day. And then after that comes the Spring Arts and Crafts Fair on March 5th and 6th. So we've got ‸ our usual full agenda for the year. We will

You're just awesome. We will continue our tradition of doing our very best to have at least one board member from the HCVA at every council meeting so that we can report to you, so that we can report back to the board on what is going on in the city. We continue to meet monthly with all of the other entities in the village with the city manager, and it's just phenomenal to be able to have that kind of interaction.

You're hearing a lot of us tonight. I wanted to just take this opportunity to commend the city manager and his staff on the success of the Economic Breakfast last Friday. Peter Kakayama was a fantastic speaker. It was really a terrific event, and economic development deserves full kudos. And the seminar that afternoon was also well thought out, well done, and a lot of fun. We had a great time. So I wanted to thank you and say, job well done. Thank you very much.
Thank you. Alan, before you leave, if I can, Mr. Mayor, kind of jump on to what you were talking about, about the seminar in the afternoon. And Alan and I kept looking at each other as that guy was talking because he was spouting something that Alan and I have been talking about for quite some time. And we just kept saying, boy, we're not so dumb after all. That's true. So we're probably going to try to push ahead ‸ with a little bit of that as we go through this new year. And if you were listening to Mr. what is his name?

on a trial to see if we can do two things. Number one, encourage more pedestrian traffic in the village. And number two, ‸ to see if we can expand that market into what it should really be.
So it's ‸ something that we thought about. HCVA is also working on an initiative to help expand some of the dog friendliness in the village that we'll talk about in the future.

that show opens January 29th and runs right now through February 14th, Valentine's Day. But we're hoping that we can sell it out and add a few more shows. So if people come on out and check us out,
we might be able to sell that out and add another weekend. But as of right now, we're going to have to close it at February 14th. Monday and Tuesday, February 1st and 2nd, we have another audition. Auditions this time for the show Sugar, which is based off of the old movie Some Like It Hot, the old Marilyn Monroe comedy. So that's going to be another fun show that opens and runs March 11th through March 27th. And then February 16th,

Folks who kind of believe in the mission of the Playhouse and want to support us, they will be hosting a series of Epicurean food-related events for the Playhouse. This first one on February 16th, it's a Tuesday morning from 10 o'clock in the morning until noon.
you'll get to meet some of the production team and some of the actors. We'll provide a nice little brunch there as a kickoff to that series. We just got these hot off the press, the brochures for that. I'll put a few in the lobby. You can also pick them up right at the lobby of the Playhouse also. And that's about it right now. We're just getting to it for 2016, having a great time, and looking forward to just continuing a really successful season that we've had so far. So we appreciate everything you guys do for us. ‸ Just

requesting code enforcement lien be forgiven for ‸ property at 1052 Mitchell Street. The code enforcement board held a public hearing on May 21, 2009, which time found the owner, the owner at the time, Richard Lee Brown, in violation of unfinished structure and a building permit. The lien ran at $100 per day from July 26, 2009, until compliance is achieved on October 26, 2009. The lien is $11,200, and the current ‸ owner is requesting the lien be forgiven. The staff recommended to the code enforcement board at its regular meeting on
December, and I had mentioned something to him about getting a speeding ticket. And we were just joking around, and I had made the comment to the mayor,
if I'm not responsible for something, I'll fight tooth and nail into the death to defend against it. I've asked for this lien to be forgiven for me because I don't know if you guys really know the history of how I bought this house and brought more acres, but I'm going to give you a brief synopsis. The gentleman that bought it from a tax lien sale let it sit for two years. He was noticed by code enforcement that he needed to bring it up to code,

city. He was ready to let the city foot the cost, and I can assure you he had no intentions of reimbursing the city for that cost. He would have just let it sit there until the city did another sale on it. I can produce all the email communications between me and Mr. Davis with your building and zoning, trying to figure out how to get this property up to code. As a last-ditch effort, I suggested that I buy the property from the gentleman, and I knew that I was going to have a lot of work to do on it.
I'll be honest with you. At first, I didn't think he was ever going to even give me the permit to get going, but all the permits were obtained. All the drawings and the specs for the construction that's taking place on this property, I did myself.
All the wiring, everything that's been done on this property, I've been doing on my own. The first council meeting, I stood here and told you guys, for people like me that live on a limited income, you know, that fire assessment thing was kind of high. What people don't know is I really do live on a limited income. I don't ask anybody to pay my bills. In this particular case, this lien, this fine was imposed on Richard Brown in 2009, a gentleman that still to this day resides in the city, that at the time worked for the county of Brevard at the property appraiser's office. The lien notice clearly states that under Florida law, you could actually put a lien on any real and or personal property of Mr. Brown's. This lien is because Mr. Brown, a county employee, thought that he could thumb
and he pushed it. From all the notices that are on file, he pushed it. I didn't. Now, I haven't asked the city to pay anything for me to bring this property up to code. I haven't asked the city to pay anything for me to do anything in my neighborhood. But I am asking the city to hold them. If you're going to hold anybody responsible for this, hold the individual that created it. Hold the individual that actually is responsible under law. Not me. Because if you don't forgive it, if you take the code board's recommendation and drop it to 500, that means I have 30 days to come up with 500. 500 for something I had nothing to do with. But I will tell you now, this property is beyond being up to code. That's all I have to say. Okay.
It's normally my suggestion and the direction of this council to take the code board's recommendation. However, I'm going to suggest, ‸ Mr. Sinclair's case, that we not follow the code board's recommendation because

Yes, sir. Thank you. I just want to get it from a legal perspective. Mr. City Attorney, we're trying not to establish a negative precedent here. ‸ I don't want to open up Pandora's box.
So, you know, in this particular case, you know, maybe a solution is to just do a partial release of the lien, release Mr. Sinclair's property of the burden of the lien, but keep the lien recorded against the original violator in any personal and real property that they may own.

for clarification, so the lien in its full amount would ‸ remain against the original violator and then be held against any real property or other tangible property that we can legally attach the lien to, but it would be released from Mr. Sinclair's property. Right.
Actually, he answered your question the way I was hoping he would because I'm a firm believer Mr. Brown needs to be held responsible for this, and he is in this city.
Well, I mean, it's always an option to consider partial releases of lien depending on the circumstances, but ‸ my experience in dealing with these code enforcement liens over the years, every case seems to have its own little twist to it. So to throw everything in one box sometimes doesn't work.

Just wanted to provide you with some additional information to consider in my request for the lien to ‸ be forgiven, if not further reduced, per the code enforcement board's decision. I acquired the property in April of 2015 of this year, and the property records and deed were filed with the Brevard County Courts as of May 5th. This violation occurred on May 18th, as noted in the Code Enforcement agent's report. However, the notice of the violation was not sent to me. It was actually sent to the previous owner, which was Fountain Property Management Corporation.
to Fountain Property Management that's in Palm Beach County. I was not made aware of any potential violations until that previous owner contacted me in June of this year, where I then reached out to the code enforcement office by phone and spoke with an agent. At that time, the agent did not inform me that any liens or fines were currently occurring ‸ on the property, but he was able to describe ‸ the description of the violation. At the time, the house was vacant.
call, I thought was the issue. I took one extra attempt at resolving the issue because the fence, the violation is actually for a gate lock that didn't latch correctly on the fence that led up to the pool. I didn't come to find out that until later in July, but we did get that violation up to code as quickly as we could without having a proper notice delivered to us or a formal document that indicated what that violation was. At the time,
was actually sent to the wrong party. They advised me that because it was provided in a publication that that suffice the legal requirement. Subsequently, I have done some research and according to Florida State Statute 162.06,
notifying the property owner by certified mail, but not as a replacement to certified mail. Also, the proof of that posting in a public form was not provided to me, as my understanding is required by Florida State Statute as well. So I'm asking for the council and the mayor to consider further reduction, if not forgiveness, of the lien and the fines imposed on the property. As such, there's been no further violations of this property that we've acquired and the violation was brought to compliance in an expeditious manner.

that we did notify the previous owner and when it was returned, we did post the property as ‸ is proper procedure. So the property was posted ‸ with the notification and as indicated, there were workers there so ‸ everybody was aware that there ‸ was a violation.
know they typically take photos of the posting of the property, ‸ and that is part of the record. Correct. So ‸ they can validate the fact that it was posted. They have a ‸ photo.
Flag: numbers, amounts, negation or names differ between the machine readings · 00:42:50–00:42:50 · unresolved: the words are not shown (unclear audio); listen to the recording
how much of a lag time we're talking about with that? Because I mean, I've seen some where the property hasn't been updated or changed hands in months. Right.
That's typically what we use. And again, if the notification that we send certified mail isn't received, then we do, and we usually do anyways, posting the property itself.
‸ Okay. But we don't have another source besides the property appraiser to find a legal owner of a piece of property. So if their information is not updated, then we have an issue. Okay. Correct. Thank you.
mean, even Zillow or realestate.com will indicate the clerk of court's filing as of May 5th is when it was posted as the transfer property from the previous owner to the current owner.
I mean, speaking from a resident, I don't know about you, but I mean, I don't check recent publications to determine if my house is in violation of a code or not. This one.
mean, ‸ that fulfills a certain legal requirement, but I mean, a simple record search in the clerk of court's office would indicate that the previous, that the new owner ‸ has acquired the property and would like to be adequately notified of such violations, especially occurring at $250 a day.
Flag: words were replaced by a machine repair · 00:44:14–00:44:14 · machine repair: words replaced where two further machine readings agreed (not checked by a person)
referring to posting, we were talking about placing a orange placard on the front door, that is, provides anybody on the property notice that it's subject to, correct?
There were workers there. I was not made aware of any of those workers. as a third-party company that we used to renovate the property. that was not notified that the violation.

Uh, just, uh, We would have to renew the contract for five years. We would also prepare or propose to adjust the time that, uh, we calculate the CPI. The way it's done now, it's, doesn't give enough time to do the budget.

a very high level of service at one of the most competitive rates in the county. This chart shows residential single-family home rates for about three-quarters ‸ of our municipalities.
These rates are only residential single-family homes, not commercial or industrial. Every service level and contract specification in every municipality is different. For example, Cape Canaveral and Brevard County have no franchise fees, which you would expect to result in a lower single-family home rate. Some areas have a very basic level of service or different service altogether, such as

that the council direct staff to put the contract out for bid. unless you go out for bid, how do you know you're getting the best price? It's a worthwhile process, and it is good stewardship. Thank you.

I'd like to congratulate waste management on a fine presentation. I have just a few points that kind of relate to today. ‸ We reviewed the 2015 waste management report that's in the agenda package, and ‸ I'm not here to be negative. I'm just here to speak as a matter of fact, and I'm reading off what was printed. When we reviewed this report, Bob Hires and I behind me kind of had the ‸ consensus that it was more or less graded out as a C, maybe a C+. ‸ So with that being said, let me just read,
the whole thing, just a few things that I'd like to bring to your attention. These concerns, and this is under a number of complaints, these concerns stem from dealing with Waste Management's customer service directly. This has been an issue with the residents for the past two years and does not seem to be improving. ‸ Residents keep calling the number, the waste management number, numerous times, and

Again, I'm not being negative, I'm just stating facts. The point that I'm trying to make tonight is that if this contract were to go out to bid, the Brevard County contracts that we hold have nothing but a very good to superior rating. Not once have we had to go ‸ to council to apologize, to give improvement programs. We currently have enjoyed since 2009 an exceptional level of service. So, with that being said, I think it's safe to say that we support option three and we just respectfully request that you consider this.

since there has been an RFP. And to correct the presentation, most recently in Cocoa Beach, Waste Pro was a low bidder. So, with that being said, one last thing, there was an economic development update breakfast last Friday that I attended. Very good, open-minded presentation, but the main theme was look outside the box, consider other local resources. You have one right here in your backyard. That's all I have to say. Thank you.

And all of those have been since 2009 through today. And we've had consistent service with them since day one. Some of our elected officials that we've talked to said they expected to drop off in service as the years have gone on. Over the last three years, a transition's taking place. Waste Management invested in a lot of new technology, a lot of new trucks, so it's been a process.
through that process, I think there's been success from the customer service side, from our side, and everybody's getting to be on the same page. I wish we could make everybody happy every day. That would be a perfect world. Not our world, but that would be a perfect world.

And I can tell you that the one thing that I learned is that competitive bidding of all these contracts pays dividends. And when we're talking about contracts like this, I think it's something that we certainly should consider because there's a lot of money at stake. and I think when people,

know, it's where the rubber meets the road is when you're willing to put down what you're going to do and what you're going to do it for. And I believe that's something that should be considered in a contract right now is that we consider seriously going out for a more competitive bid on this proposal. that's all I have to say.

since 2004. Worked on a few campaigns and in the great state of Illinois, I was a township supervisor for a couple of terms in some large areas. The reason I'm here tonight is because Merritt, one of the residents in my building, called me and said that you were going to be talking about a contract proposal for waste management. And he said, the contract has been the same for about 30 years. I said, that's unbelievable. I can't believe that. I said, they don't put it out for bid? It hasn't been for 30 years. I don't believe it. You can't be running a contract as large as this and not have competitive bidding. I don't know how you manage your cost. Who's in charge of the cost?
They say, well, whoever I talk to, a name here, says that'll be taken care of when they bid the next contract. I said, well, good. ‸ My comment would be recorded and passed on to the council. Maybe, maybe not. But the thing that made me feel good is that when the lady says it would be part of the process when they bid the next contract. I understand that because that's one of the variables that have to happen when you look at a new provider.

this contract 28 years ago under another company many years before we started Waste Pro. So that's kind of some of the history of why it's been so long is because there was no competition here for many, many years.
Seven years ago, got our first contract with the city of Cape Canaveral. It's gone on from then since then. These bids have occurred. People have saved money. You've heard, I know for a fact, from the mayor and city council members of our cities we serve. They've told you we have excellent service. They told you

improved when they switched to Waste Pro. The thing is also, I want to make some clarifications. As far as the most recent bid was the city of Cocoa Beach. It can be a little confusing when you saw the slide where you're looking at the numbers for residential service. Again, that's only a single part of it.

have to look at that again. The spec sheet, the Excel spreadsheet provided by the city of Cocoa Beach showed that we were the low bidder on the overall spec sheet.
when we take over a contract, the first thing we do is offer the jobs to the existing people that are there. We don't want to displace people. We are also located in the county area of Cocoa on Range Road. We have a lot of Cocoa people that work for us.
But I just wanted to ‸ bring some of these points to your attention. WastePro itself is the largest privately owned waste collection company in the southeast. We service over a million homes in Florida. Just to give you some size and perspective of the company. I hear my beep. So that's my information I'd

Represent waste management. I'd like to clarify a few statements that were made here. Number one, I'd like to start out with ‸ Cocoa Beach. WastePro claiming that they were the cheapest is not true. I've got ‸ the city's spreadsheet that was done by their financial officer right here. The way that the bids come in, for all services, just not residential, just not for commercial, this included beach cleanup and the whole ball of wax. Our bid came in at
So we were low overall bid. The other point that I want to make too, I ‸ respect Mr. Coswell. I worked with him for many years at the county. But I was intimately involved in that process. And I know what those numbers were. And I can tell you

the city of Cocoa. So when we're looking at nickels and dimes, we also need to look at the dollars and what that's going to cost. ‸ And clearly, everyone can see this, there's nothing overly bearing that will say yes, yes, yes, but then again, we want to be stewards of the taxpayers' dollars. So, I may ask you all just to see until that fifth person, if you all decide, it's up to you, to postpone this, postpone this, to make sure we have that fifth individual here, I think it will be feasible. If it's something that we must burn that issue tonight, then I'm ready to take a stand.

When you look at the process of bidding, one, securing the contractor to evaluate, you know, bids, and then subsequently having all the vendors put their bids in, evaluating them, committee, ‸ you know, and then bringing it back to council. So, there is time involved.

even think John could tell us what that is right now, but there still will be quite a bit of work for the staff to do. ‸ We have to, I think, put that in our little brains and let that cook a little bit too. All right.
Thank you, Well, this might make it easier. Waste Management has done a great job and ‸ every company that's ‸ been here for any length of time probably ‸ has a few problems here and there. I don't consider ‸ five or six calls on green waste

But, on the other hand, ‸ I work for the citizens of Cocoa and what you do ‸ is you work on their behalf and what I've gotten in emails and calls and then tonight, wherever that score was, was to ‸ really go out to bid. ‸ My gut says that and I'm hearing that. did not count anything anybody from waste pro said or anybody else, just citizens and business owners in the city. It was 13 for waste management and six for bid. That's what I got. You may have gotten something different.

anybody else? Well, my concern right now, sir, I just want to give our cohort the opportunity to come forward. That's what I'm saying. I think that could be the determining factor.
Yes, ma'am. I concur with you. I think this is something that ‸ we can deal with in the first month. I think it will give us ample time because I don't know the severity of his situation right now, but I think it will give ample time to ‸ collaborate and communicate with all parties, with our city manager, our city attorney, and our constituents, and then we can make a determining factor, a determining decision based on that.

Mr. Mayor, council members, officers, staff, good evening, thank you Thank you for letting me talk about this This is very exciting This document is great It addresses some concerns that we have Those of us that are in tune with what's going on at the waterfront
detriment to us I'd like to take this opportunity to say thank you to Steve Belden for initially hearing me out and Being available and accessible and incorporating some of the input that I had as an end user I'm a lifelong boater I'm an
I've been in the marine business I'm a licensed Coast Guard captain and Steve was nice enough to take my input seriously and incorporate some of these ideas. We know that Riverfront Park is a special place through referendum the citizens know that too They made it a special scenic and recreation landmark Which it deserves to be To preserve the scenic vista and the recreational amenities That park in conjunction with
as a wonderful place Not only for the local citizens and ‸ you to be used as an effort to draw the citizens back into reconnecting with the river But also for attracting tourists and traffic passing by on the ICW to come in Which gets us to the point of it's also about commerce economic development and tourism And as a member of the historic cocoa village association that is what I would like to address at this point We know from interviewing cruisers both here and on other others at other cities on the ICW that
Flag: numbers, amounts, negation or names differ between the machine readings · 02:02:29–02:02:31 · unresolved: the words are not shown (unclear audio); listen to the recording
of possibility of theft or being run into by a vessel that's dragging anchor These are things that absolutely hurt us you can go anywhere and hear people talk about cocoa and say those things What a shame for what a wonderful place we have So with this great ordinance that we've got here I have gone through this and we have come up with about 30 different areas that are questions comments suggestions and a few specific requests I'm going to talk about a few of those just on the high level here And I will distribute these afterwards for your reading pleasure
Flag: words were replaced by a machine repair · 02:03:38–02:03:38 · machine repair: words replaced where two further machine readings agreed (not checked by a person)
places where specificity is needed But they there is not a clear meaning and it has implications as to what ‸ the intention is That's one item Another would be for the use of the waterway There's an item in there and we want to make sure that there's no restriction for an eight-hour anchoring for people that are legitimate in the park for ‸ legitimate ICW
Flag: words were replaced by a machine repair · 02:03:57–02:03:58 · machine repair: words replaced where two further machine readings agreed (not checked by a person)
Somebody should be able to come and anchor in our area and not have an eight-hour limit There's also as it's written there appears to be it's unlawful to cook or sleep aboard a boat if you've been there more than eight hours
Use of the T-Doc There's a restriction for running a generator Most of these cruising boats are self-contained and generators are an important part of keeping their operation going for air conditioning heating battery charging cooking Running small appliances If the noise is the problem, let's put a decibel limit on it like the state does for boat motors But not just do a blanket you can't run your generator We've made a tremendous improvement.
The dock limit is now proposed at eight hours We would like to propose that a cruising boat coming in Eight hours is a whole lot better than three But if you're talking about needing to rent a car or get on a bus and go do provisioning Go to a medical clinic, whatever
the dock would be even a preference Eight hours is not bad for the local day boater For a cruising boat, perhaps a designated area, whatever Where if you're a cruising boat you can stay more than eight hours is ‸ highly desirable And in particular Here comes the punchline We don't offer fuel We have a bad reputation What can we do to bring people in to spend their money and spend their time and create a solid impression? How about offering one of the handful of cities and we would not be alone in Florida on the East Coast That offers free overnight docking for a night or two We have the facility. It's not over capacity I suggest that we evaluate that pros and cons and look at it seriously and consider doing that as a offering to get people to come here I think that would work That is it for me And at this point I will say if you have any questions I'd be glad to entertain them More importantly as this is reviewed I would be more than happy, willing, able and available to work with the city to expound on any of the things that I have either mentioned this evening or are in this write-up We went from six pages to ‸ nine in my version So there's definitely room for discussion and input and I would be more than happy to be involved in that process If you're so inclined to request me to do so Any questions?
My greatest concern is a couple of things you highlighted on several things ‸ The similarities potentially for this ordinance and I think we can tweak them as time progress

St. Augustine's one of the pilot programs for a mooring field And looked at their verbiage of how they do things There are similarities. There's places where it's a little bit different, but we're on the right track here. We're absolutely on the right track And especially if we look at this as a measure for now that is a living document that could be amended as our facilities Change or improve or we gain experience and go forward incorporating items from the master waterfront plan of 2008 And
I utilize Leewanna Park a lot. I'm happy to say so we bring the family we come in We eat at the local in the restaurants in the immediate area Also the thing when when I took my family out they saw those two derelict boats there on the side right there And my thing is trying to get them off the banks just like everyone else I know there's an issue potentially leading up to patrol Leakage of petroleum into the waterway, but the question that I'm saying I want to be proactive and as time changes we will adapt I do thank you for your commitment and dedication sir When I'm bringing in my yacht, my yacht, golly, my pontoon boat It is an oversized Redneck yacht

10 of those could be, uh, multi-day type street closures. Uh, the ordinance also recognizes that certain street closures would have minimal impact on the community and therefore do not rise to the level of requiring council approval. Uh, temporary stoppage of traffic, uh, without rerouting vehicles and street closures that are not located in the CBD and located on local roads could be approved by the city manager, uh, as part of a special event application. Uh, with that, I'll return back to mayor and council and be happy to answer questions.

And I know that they, the one item that Steve had mentioned that would provide some little bit greater ‸ administrative flexibility with the city manager approving was only those circumstances where,
Like the other, for instance, the Cocoa Village Playhouse, there was a film crew that came to do filming and they had to close like one lane of the, uh, of the Brevard Avenue. And we brought that before. And then they contacted us and they said, ‸ wait,

And I'm actually speaking for Emma, who couldn't be here tonight. So these are her thoughts about this. Um, with the way the ordinance is written now, streets could be closed any number of days on one street closure. So with 20 street closures, the village could essentially be shut down for 20 weekends a year, almost two times a month.
Suggestion. Make the number, the total number of days that the street can be closed a year. So if there are 24 street closings, for example, that would be 24 days, not 24 weekends or 24 three day weekends. So each closure is a day and that would save having to tally how many are weekends, how many are singles, how many are just a few hours. Okay. That's

suggestion. Number one. Number two is, and this is something that Steve has already spoken to redefine street closures to be as a closure that significantly impacts the flow of traffic and downtown businesses.
So that if someone needed to say close the Porsche house loop for an event, that wouldn't count. And I think that's the intention that Steve explained. Um, those were her thoughts. And she, I may be, am superfluous since it may have been covered already, but I felt tasked to present because I answer to this child.

Here's my greatest concern. A couple of things here that I'm concerned about. One, um, we are held by standards of the citizens that elect us to uphold and make decisions for them. Um, my greatest concern is if the merchants that may disapprove of this, is it

in the tradition. Um, if you surrender your rights, sometimes it's hard to ascertain your rights back. So I think it's important that we still continue to keep that line of communication. If they ‸ have a unique situation that requires an additional day or early morning, well, it will not have an immediate traffic.
Then I think we should support it. And what I mean by support it, let it come back to council. If you do a telephone call, I think that works well. Normally we trust your decision. It's been good. So far, Mr. City Manager, but my greatest concern is making sure that we still continue to hold the reins in our hand and that it will continue to come before council.

when lanes closed, you know, not officially by the city, but there's still a lane that's impassable. But yeah, I, I do have a problem with, you know, the weekends, the days, it's kind of confusing. A street closure should be a day, you know?
Zero street closures. So we have plenty of events that don't require street closure. There's events that closed, you know, just that little section of Harrison, like the stuff that the village idiot does or whatever. You know, to me, that's a street closure because that has a serious impact with people crossing the bridge and, you know, coming into the downtown. So I guess it's, to me, it's more defined what a street closure actually is. But I, I don't see any reason to change, you know, the dates. I agree that the street closures that we really need to be talking about are the ones in the village. Somebody wants to close down, you know, a street in their neighborhood to have a block party. That shouldn't, this ordinance should not apply to that.
I don't see that we're that far off on what it is we think we need to do. I don't see any reason why we can't pass it on first reading and, and tweak it between now and then like we're doing the other one.

it's an American thing and that's what I love about it. And I think if we have to close that small stretch to think outside of the box, I'm in favor of it. If it's going to promote the, the village and the merchants, I think it's a great idea to think outside of the box. Especially when you have everyone's cooperation. I understand.
So just, just to get clarification. So we're going to, we'll come up with a maximum number of days where there could be a closure. And whether that particular event is one day, two days, three days, each day would count.
a closure. So if we're saying, just pick a number, 40 days, then I have a, ‸ that, I have an event that's three days. There's, that's deducting three days from that event and so forth.

However, we would further, you know, after the acquisition of the property, do a more comprehensive ‸ environmental site assessment, you know, phase two, you know, that really gets into it because as we prep it for we or
you want to be able to while the city doesn't ‸ want to step in and be a developer, we can our position is that we can be a pre-developer, get the property ready, serve it up on a platter for somebody to come in and develop the property. We can set the conditions and all that. There was an appraisal done on the property. The appraisal did come in at $600,000. It is important to note that the appraisal did not consider the contributions of the billboards within the valuation of the property because they did not have the information as it related to the billboards. The asking price is $800,000. That's what the sellers are requesting. The future use or rather the reuse or the redevelopment of the property is the intended purpose and the property specifically should be noted, specifically contemplated for redevelopment with a higher density and greater economic use and more compatible and beneficial land use in the Waterfront Master Plan Section E, Number 1.

So there's clearly an opportunity to have a commercial component along with a residential component of about 120 units. So I would offer that up as ‸ one of the reasons. And then the final thing I would add to city council, as it relates to the contract for sale, we did receive a copy of the survey today, and there's a little bit of a I mentioned earlier an issue whether ‸ that one small piece of property that has the two billboards on it is located in Rockledge, is it located in the city of Cocoa.

And everybody in general pitched in, you know, in terms of getting the event done and having the all-day activities with the annual Economic Development Breakfast. It's really evolved into more than that.
other organizations that participated and brought people out and our partners. Uh, it was really, I thought, an excellent, you know, uh, event and we really appreciate it. So,

No, this will be quick. If ‸ council recalls, ‸ the city was presented a list of concerns, you know, through Parks and Rec and through Cocoa Little League highlighting some of the concerns with the, uh, over at the, uh, where the Cocoa Little League plays. Well, they took it upon themselves and they already did the batting

But they'd like to, for the, the city, while we appropriated $45,000, they did it for far less. That was the amount that the county had indicated that they thought it would cost.

We'll take a close second. So to also, we attended the Terry Black Magic Show. You recall? Yeah. And we were, all three of us, four of us were judges. So we had a wonderful time there. ‸ I want to say congrats to Principal Wilson. The mayor and city manager and staff was there. Council members were there too as well. So I want to say thanks for that. Congrats being the ‸ community school. Also, um, Mr.
sir. Just quickly, just want to refresh your memory. I know you're addressing it, but I promised him that I would tell you about the south end of Brevard Avenue.

Yes, sir. We're talking about the same thing. I want to say great job to city manager and staff for the economic breakfast development. Heck of a speaker. Unfortunately, I did, was able to say some of the time, but not all of the time, but it was,
and I was glad to see that. Coming from the Space Coast League of Cities, there's a resolution that was presented to the gas hike by letting them, uh, the newspaper reported one thing.

cities presented one thing, and it was kind of opposite of what the newspaper reported. So, we are going to have our newly elected President, um, ‸ Stuart Glass, go back and
could use some of that CRA ‸ road money. There's a statute that says you can't put it at the tail end of the fiscal year. If there's any funds that's left over,

police department's time, and, uh, I thought we were going to go off and come up with some kind of a plan to make that a little bit better or something, but I haven't seen one yet. I think the sheriff's going to help us.
and every time, and I know I've been riding with officers, and you get a call to Crosswinds, that officer's tied up now for two hours, four hours, whatever, where he could be out doing something, uh,
far more important in my mind, but I really think ‸ we were supposed to, we said we were going to come back with a plan on that, but I haven't seen one, so I'd like to see it. Okay, here's the one that everybody's, what are we doing on Mrs. Corby? I think pretty much all of the council, or at least the majority of the council last time, said it didn't feel like we treated her right, and that was supposed to come back to us, and I kind of expected it was going to come back at this meeting. It didn't, so have we done anything with Mrs. Corby?
Mrs. Corby submitted some information, a request for information that the city complied with to provide information. I forget the agency, but with regard to the pension issue,
board chair, um, and, uh, because, as we articulated previously, the city doesn't have standing in terms of a case that was litigated in the courts between the pension board and Mrs. Corby.
sometimes you just got to do the right thing, and not just get all hung up in, oh, well, you know, it was, I don't see any reason why we can't live up to, if that document that she showed us was correct, I don't see any reason why we can't live up to that document.
liked him, did a damn good job. It just seems like, to me, that we have, I don't know what it was in, I don't know if it's in the charter or what the heck it's in, but said she ought to be getting his pension, and somebody shafted her out of it, and I think we ought to just make it right.
the city. Well, but the, it's, the pension ordinance is set up and establishes the parameters by which the pension board administers the pension, and they are, in fact, responsible for administering the pension, and they have a fiduciary responsibility to administer it consistently with the pension ordinance. She challenged the, I guess, the benefit provision.
and if somebody else failed to do that, I don't know how they failed to do that, but they obviously did, then don't we have, then, a responsibility to step up? We, the city, have a responsibility to step up and say, we'll take care of that. Because we said we were going to.
And I understand, I completely understand the, ‸ I think it's a complex issue, especially since the issue was she went to court, lost, appealed it, and law that gave her a specific ruling, you know, and so she litigated, based on the pension ordinance, what she thought the benefits that she should receive. And it's, we have no control over the pension funds in terms of the disbursement of pension benefits.
Well, ‸ council appoints, you know, two members. ‸ The respective collective bargaining units appoint two members, generally, and then combine those four, appoint a fifth.

we've just told people that you can work your 20 years here, ‸ whatever, and we're not going to honor what our, what our obligation is by the document that is a city document. We've just said somebody else can make a, make that decision, and then we're not, you know, just because we said we were going to do this, that doesn't mean anything. I mean, it just, it just really bugs me that this can be allowed to happen. I don't know what the heck we can do about it either,
mean, ‸ he just, excuse my, excuse my language, dropped dead at 50 years old, you know, and, and he certainly wasn't expecting to do that. And then we have this document that says she should get his pension. Well, what's something like, something to that effect.

All right. I've been getting some inquiries about the waterline work on, on Indian River Drive. And some people have, I talked to city manager about this, but I just want to, I just want to bring it out because I told people that I would. They're putting in new fire hydrants. And I'm being questioned as to, some of them are putting maybe three, four, ‸ five, six inches further away from the curb than some of the other ones. I saw two of them like that.
I've also had several complaints about the AEG concert last weekend and not so much about the concert itself, even though the police did get some noise complaints. What about the after party in Lee Werner Park, which was making more noise than the concert did, so I'm told. And it was like one o'clock in the morning, I'm told. And I think we need to find a way to, to keep that from happening in the future.
think police chief has got a plan to preclude something like from happening in the, in the future where so a bunch of people took the party down to the park. They were probably parked down there and just kept on partying, but they were disturbing the citizens at one o'clock in the morning. And so we just need to be aware that we don't do that to people. And then next to last is, as I mentioned, when Alan Chapman, Chapman was speaking, he and I have been digging on this thing for a while and trying to figure out how to do it, how to do a pedestrian zone. Because having lived in Europe for 10 years and him being a Canadian, we know the value and we know what I

When he showed the picture of the streets being closed off just by putting chairs out there. What an idea. I mean, we would have put up a big barricade and, you know, hired a cop to stand out there and say,
mean, ‸ so ‸ I think we'd really have a really beautiful area if we did that. ‸ And then, so I'd like to see if we can't work something out. If you can work, sit down with the ‸ HCVA and the Main Street and whoever else all.

Exactly. But, you know, a lot of them will be, ‸ we don't like any sort of a change. But other ones will say, hey, yeah, I can see the value in giving that a shot, you know, and see what's coming.

I'd just like to thank the staff for doing a great job. Last Friday it was really probably the best economic development breakfast to date, and everybody that I talked to really enjoyed it. A lot of great ideas. I really enjoyed the workshop in the afternoon. I'm glad to be able to participate. It was a lot of hard work on everybody's part, but it was well worth it. And that's it.

it's not too much of a struggle when you make these kind of votes, when you see the outcome down the road. Again, John, thanks a lot for the breakfast. That's your baby.

think about something. I boobed up. And he didn't really ever, he watched every meeting, but he never really gave me a hard time. And when I thought he might say something, he'd say, hey, it was a pretty good meeting. You know, but that's one reason I didn't watch the meetings because I let him watch them for me.
