Transcript Partial transcript
Machine transcription of the meeting recording. The words are the recognizer's, except where a passage is marked as corrected or machine re-recognized; most have
not been checked against the audio, so words, numbers and names can be misheard.
It describes what was said. It cannot establish who voted how, an amount or an outcome — the City's
minutes do that (above).
A time links to its passage, and “Copy link” copies that link. “▶ Play” opens the recording at that moment, on YouTube, in a new tab.
434 suspect passage(s) marked in place; inspection incomplete: language review; 1 stretch(es) where a voice was detected and no words were recognized.
How this transcript was made. New machine transcription of the whole recording, with 32 voices separated from the audio.
46 short machine repair(s) (65 word(s)) are labelled in place, with the original words beside them: an ordinary word was replaced only where two further machine readings agreed on a different one.
Checks run on this transcript: the recognizer's own warning signs and whether a voice was detected where the words are. Not completed: language review.
A second, independent machine reading was compared with it word by word: the same words for 93.7% of 17,434 content words.
Dotted words (429 places) are ordinary wording differences: hover or tap to see the other reading.
434 passages (22% of the words) are marked suspect: their words are not shown ("unclear audio") and support no statement: numbers, amounts, negation or names differ; the language review questioned them; or no voice was detected there.
Agreement between two machine readings is not verification.
Inspection is incomplete: language review.
Voice detected, no words recognized (1 stretch). Something may have been said here that the transcript does not have:
00:11:55 (1 s) — neither reading has words
Speakers were separated by voice. A plain name rests on evidence tied to that voice; “provisional” is a name from an earlier text-only pass and is not verified; “Speaker N” is an unidentified voice.

Yes, Mr. Mayor. This afternoon, I talked to Councilwoman Koss, and she is under the weather and unable to make it to this meeting, and obviously did not make it to the CRA meeting.
I'd like to make a motion to put reports to the end. I thought we voted on that four to one. They're supposed to be back there anyways at all times until somebody needs something to change ‸ to bring them forward. Okay. We would like to do that

All in favor by saying aye. Aye. Any nays? Ayes have it unanimously. Would you turn your light off for me, please, sir? Any awards and presentations? Seeing none. Proceeding on to delegations. We have a large volume of cards under delegation. And I want to give everyone the right to be heard. So I have something like seven, eight cards here. And normally, excuse me, normally and traditionally, delegations is about 30 minutes. Is that correct, Madam Secretary, clerk? Okay. So I'm asking you all to be heard, but can we condense it just a little bit to three minutes? Please, ma'am. Please, sir, so that we can hear everyone. Okay. All right. I have a card here that says D.

And I'm a witness to senior abuse by a landlord that is impacting taxpayers. And for both issues, I think there's too much evidence and witnesses to present at a three-minute meeting here. So I, on my card, if you notice,
Yes, ma'am. The meeting, you would like to meet with myself and the city manager, ma'am? Is that my correct understanding? Yes. Okay. I would be more than happy to meet with you in the event. If I can't attend, I think it should go through our city manager first, and then he will share the information with us as a council. But yes, ma'am, I can meet with you.
As long as you are given the complete information, because we have tried to go through other law enforcement personnel and never got a response ‸ through going through chain of commands. So we're really needing your follow-up
This young man, to my immediate right, your left, the city manager takes an oath of the Constitution as well. So, yes, ma'am, you can collaborate with them.

I'm here to request for a shade structure that is occupied on one of your properties. I'm asking to see if I can obtain that. I'm willing to pay to have it removed. I've noticed that it's been sitting there for a mighty long time, not being utilized. The shade part is missing. But I'm willing to pay to have it removed. It will bring beauty to my business.

I can feel it inside my house Four weeks in a row. I reported this to the police. We do not do we have a noise ordinance question mark question mark. I texted him On december 23rd at 11 51 a.m. He replied to me Yes, we do and i'm so sorry you're having to deal with this I will be speaking to the owner today and
Praying you are staying safe. I'm still working behind the scenes happy holidays and god bless you I have to um um Say again, he will be greatly missed Um, if I called him or texted him he always replied back to me um A lot of you know of my flooding issue since um The new construction behind my building it will still flood as matt knows it's a waterfall. It's niagara behind my building, so He came to my my store many times to see what I was going through three inches of water coming in the back of my building
I've called you a couple of times this week Um, I didn't hear back from you, but I would like to meet with you and the new city manager The back of my building was broken into this this week um The beer garden left a big ladder out so it was very convenient for them to go on my roof and bust through the skylight in my store
garden that they pried the back door open to the store next to me which is part of my building um So I want to talk about prime I want to talk about Um noise ordinances. I'm not against a good time but I can hear the bass in my house And that's just a little too loud and I love music, but that's way too loud. Um I saw a billboard on us one Are we really during a pandemic going to have a mardi gras in the village? That's a concern Um, and then there's you know, there's a few more things, but I know my time is up But there were fireworks on new year's eve that are still laying behind my building that they shot off That's all burned up That's just looking to set our buildings on fire down there. I mean this is ridiculous There has to be some ordinances To clean up the back alleys. I have Security cameras. I have an alarm system that saved us But we need a little bit of presence of the police department to patrol our area downtown Crime is up again. It's been a full circle

Just before before you she reads that I did talk with the uh city attorney About that because I was concerned about some of the language in there and I don't know If he wants to relay that conversation, but basically Uh, you you the council started the e-comments when the governor Issued the executive order on meetings and so We've accepted uh e-comments as just as though the person is walking up to the podium
and so um again, was concerned with some of the language in this, but uh after speaking with the city attorney, I believe to be fair and to to apply the rules the way we've applied it to to the previous um um um citizens who submitted e-comments
Yeah, and just i'm going to run the timer just as if the person was here so for three minutes Okay, yes, so this is an e-comment received from lawrence sinclair at 1052 mitchell street

development. Goins and Williams had promised city owned property to developers for Williams announced a call for an FBI investigation. I'm formally giving the city notice that any and all alleged information Williams is said to have ‸ turned over to FBI be made public without any further delay. i am formally giving the city of

I also have a real issue with individuals in the city injecting themselves in matters and setting meetings where they freely drop council members names in their efforts to accomplish a particular goal. This activity, in my opinion, can constitute sunshine law violations.

and a quick serve restaurant space of 2500 square feet with the drive-through facility, which based on the provisions of the development agreement must be limited to a nationally recognized coffee shop chain. two items of note one is that a drive-through facility based on our code requires a approval of a special exception from the board of adjustment the board met on december 16th of 2020 and heard that special exception voted to approve with a condition that the approval should be dependent upon council's approval of the development agreement

subject to the terms and conditions of the agreement And the other point that I would like to bring to your attention is that the Waterfront Overlay District requires additional conditions on a drive-through. They are essentially the
right-of-way on all four sides, makes meeting those provisions of the code very difficult. And therefore, we have before you this development agreement. Part of the provisions would be reduction in the minimum frontage build-out requirement. On the east, north, and south sides. And a change to the masonry wall requirement to allow part of it to be a hedge instead of a wall. And through the development agreement, the applicant proposes to provide public parking easement over the parking lot that would be after the close of business for the coffee shop anchor tenant. So here's a location map for anyone not familiar with the property. It's between 520 and East and 520 West. theI'm sorry. Clicker's gone away.
okay. I was going to use the uh the light, but it seems to have disappeared. um There's currently two access points on the north side of the property and two on the south side uh and one on the west side. And staff, as well as the applicant, have met with FDOT um in the past to discuss access points. I'm just kind of bringing it up while we have this slide up. um
The new building will sit roughly in the same footprint as the existing building, pretty much the same existing parking. You would enter either north or south, but at the east end of the property, circle through the drive-through up from the north side, down the west side, and out the east, south side. This is the east elevation, the front of the building, with the drive-through entry on the right ‸ exit on the left. So

from flying down. where they're it's a It's a turn lane for River Edge. uh Currently, people just use that to go straight into toBrevard. That's going to prevent that. That's going to help people slow down. They'll have to slow down in that middle lane to get into the site, which in turn slow down traffic at the bottom of the bridge, which we know a lot of people probably going 50 55 at least in a 35 there. The turn lane itself also helps with that. It prevents a driver from having to stop and turn into it, which helps prevent your rear end traffic there and allows people to safely get into the site. You also have the turn lane on the eastbound side, which does the same thing. You allow your traffic to to slow down and enter the site safely.

on the opposite side of the entry and exit points of it. So even if you were to queue up into the parking lot, you do have the turn lanes that you could queue traffic into. That'd be well over 20 cars. That's pretty significant for any site toto need that much queuing.
February 15th is the date. so those are It's a resurfacing project, which includes safety modifications from Aurora to this location, the bottom of the bridge at River Edge. Part of those are traffic calming techniques, uh lane reductions, uh more of these kind of bulb outs here that prevent people

is uh that right turn lane, people use that as a merge lane. So there's going to be some modifications that should help prevent that in the future. That project is scheduled for um kind of mid to late 2022,
And we should see those modifications that make a pretty big impact in the area as far as your traffic speeds. It's not just traffic improvements, but it's pedestrian improvements as well. I know some some talks about the traffic generation with this type of site. It's a coffee shop with a drive-through. Generally, your trips

what's called pass by traffic. That means the traffic's already on the road. uh Only 10, 11 of drivers are actually going out of their way to come to the site. So that's one thing to take into account on that. I believe it's roughly 300 net trips on the site. And
This is where you're ordering. Even if you queued out into here, this is another 10 to 12 cars. And if you were to queue from cars coming this way, they could queue out into this turn lane. that That's not very likely. That's, like I said, over 20 cars. You would more than likely see people queuing around and here as well, which keeps that within the site. But this is generally a pretty quick serve type thing. You're not sitting in this more than a minute or two.

Yes, sir. Thank you. Real quick to honor what you had asked mayor and the council. I'll be concise and to the point. uh We basically have a situation here where
You have two city boards that supported it. You also have the commercial property group unanimously supported it. There are landlords in the downtown area. The only negatives that basically, as was stated in the newspaper today, are concerns about competition and accidents. Now, the accidents have been addressed. Competition. Well,
So I really feel that this is something that we need. and it'll put Coco on the map because when you do see a franchise locate in any location, it usually means, hey, there's something going on over there. You need to check it out.

Thank you. uh First, I'd like to say that I think we're very fortunate to have the Shaw family uh involved in this project uh because they are people who have both the vision and means to do something with a key property within our boundary.
and I think that what they're proposing is a good development. That said, I have concerns about traffic safety. uh I know engineers have looked at it. uh I have read the engineering report that was attached to the application. I read ‸ beginning to end. It was not a pleasant read, but I read it anyhow. and
and it's doing that on both the ‸ eastbound and the westbound. I consider that a problem. The uh traffic study shows that in the peak hour there'd be 55 cars approximately westbound and 53 cars eastbound, a total of 108 cars in the peak hour. That means that every 33 seconds or so there'll be a vehicle from a dead stop trying to merge into 50 mile an hour traffic in the left lane. uh This is exacerbated by westbound traffic that might want to leave that property and head north on
uh Traffic eastbound that might want to leave that property and cut across three lanes of traffic to get onto River Edge Drive ‸ come back to the village. So there are issues that are worthy of consideration and further study. uh I've looked at a an email that was received by a friend of mine from the project manager at FDOT regarding the uh corridor study that has been mentioned. And when you look through the corridor study, it's a 34 page document and you look at the document, ‸ you look at the drawings at the end. It is apparent that this what is known as the final study uh doesn't have any of the improvement features that were shown previously by

18 months or so to improve that traffic flow whatever is done with this property needs to be coordinated with the FDOT. It needs to be incorporated and we need to take a long, hard look at how we are going to safely get traffic in and out of that site. And that I'm sure we can do. I'm sure that a a solution to be found. And I ask the board to not move forward tonight, but to gain whatever information is necessary to address and mitigate those problems. Thank you.

I should also say I serve on the board of adjustment and I was one of the two negative votes for this project as it is currently devised and presented. Presented to the Board of Adjustment and also to planning and zoning was a traffic study developed for a nationally recognized coffee shop chain. And yet tonight, on the first page of this document that you all are being asked to approve, it's called a quick serve restaurant. Two entirely different things. It's one thing if we're talking coffee shop traffic. If all of a sudden we're flipping and calling it a quick serve restaurant, we're talking McDonald's traffic I don't think that a traffic study that was developed for a coffee chain should be used if indeed we're talking about a quick serve restaurant. Can we make that language a little bit more consistent mr. attorney sir

bridge it's something that I've had concerns about owning 226 King Street as well as some of the bars have opened up on King Street where people exit the bars after they've had several drinks on to a public sidewalk which is right there at 520 I'm concerned someone's gonna ‸ get it by a car so I've been working on this for a long time to try to change that and they're they're receptive to that. for this ordinance mayor it's not necessary to read in. It's already been approved. The only issue for the Council is whether or not the Council desires to terminate this emergency ordinance. And in addition,
affidavit to the contractor that the contractor has to keep on file stating that the subcontractor does not employ contract with or sub contract with an unauthorized alien. And that contractor, as I said, has to keep that information on file. So that's something that as we go out to do some of our bids,

And uh you had spoke of a survey that needs to be sent out to the residents. I was wondering if ‸ we were to move forward that way, is there a timeline you have in mind if those surveys will go out?
So typically the the person or the people making the request would initiate that survey. The city staff would not in the areas that the speed bumps or humps are requested. Usually when we receive that survey, if there's enough positive response, then we would start that speed study that I had mentioned. We're going to go ahead and do the speed study just to stay ahead of it. There's no reason not to do it. So once we get the survey and if all the check marks are are completed based on that, we would come to council with the request to install the speed humps in that location. And council would have to approve that. i believe I believe you need 70 or 80 percent in favor within that segment of roadway. And in that particular segment, you would need multiple speed humps for it to be effective. ‸ And we'd also pull in um uh

And currently within the city limits, the number of active cases that we have reported by the department of health are at 93. as you can certainly see with watching the news and if you've been watching the Department of Health's website, just as they predicted, starting about Thanksgiving time, we certainly trended in an upwards motion. uh Everything that I've gotten from our state EOC call that we have on every Thursday is the predictions are right where they were deemed necessary. We saw all of our state sites for testing saw a rocket of number of people coming in and being tested right around the holidays. So the numbers are right where we figured they would be about this time. We're certainly ‸ nowhere close to being out of this storm yet. uh The vaccines are going out. They're starting to get out. You'll see more and more of those. uh State sites start to transition from uh not only testing sites but vaccination sites as the vaccination becomes more readily available. uh Certainly there's a lot of work to be done with that still but we're staying vigilant on that on our end

amount of money, the amount of time, the amount of equipment that it would take for us to be able to receive the vaccination and then turn around and be able to give out the vaccination in a closed pod to city employees. So we chose to go around with partneringpartnering with Rockledge Medical Center. Rockledge was identified as one of the sites that would be getting the vaccination along with some of the other area hospitals once it was available. That was an easier distribution point for us to be able to send our employees to go there. One of the biggest challenges that we had, and
Emergency Management, was I had a real heartache with the governor's plan in the beginning of health care workers being able to be given the vaccination first, but first responders were not included in that. They lobbied the governor's office, actually took a rescue to his office to show him what the working environment ‸ was. He loosened that, allowed EMTs and paramedics to be allowed to be vaccinated at that point, But I was still worried about our police officers. They were certainly just as uh as susceptible to be exposed, more so as we were. After speaking with him, he said, you know, you work it out with your local hospitals and we'll allow that to happen. So we included
