Agenda (the City's wording)
The City's agenda for this meeting is on file (CE_Reg_Agenda_01_18_2024), but its item list has not been read reliably by machine yet, so no outline is shown.
Transcript Partial transcript
Machine transcription of the meeting recording. The words are the recognizer's, except where a passage is marked as corrected or machine re-recognized; most have
not been checked against the audio, so words, numbers and names can be misheard.
It describes what was said. It cannot establish who voted how, an amount or an outcome — the City's
minutes do that (above).
A time links to its passage, and “Copy link” copies that link. No recording can be started from here.
784 suspect passage(s) marked in place; inspection incomplete: language review; 1 stretch(es) where a voice was detected and no words were recognized.
How this transcript was made. New machine transcription of the whole recording, with 22 voices separated from the audio.
78 short machine repair(s) (97 word(s)) are labelled in place, with the original words beside them: an ordinary word was replaced only where two further machine readings agreed on a different one.
Checks run on this transcript: the recognizer's own warning signs and whether a voice was detected where the words are. Not completed: language review.
A second, independent machine reading was compared with it word by word: the same words for 91.9% of 32,651 content words.
Dotted words (703 places) are ordinary wording differences: hover or tap to see the other reading.
784 passages (24% of the words) are marked suspect: their words are not shown ("unclear audio") and support no statement: numbers, amounts, negation or names differ; the language review questioned them; or no voice was detected there.
Agreement between two machine readings is not verification.
Inspection is incomplete: language review.
Voice detected, no words recognized (1 stretch). Something may have been said here that the transcript does not have:
01:29:47 (7 s) — neither reading has words
Speakers were separated by voice. A plain name rests on evidence tied to that voice; “provisional” is a name from an earlier text-only pass and is not verified; “Speaker N” is an unidentified voice.

discharge of petroleum or any other polluting matters into the city's MS4 system, which is a stormwater drain system. The basin, which has high levels of turbidity and smells of grease or oils, prompted staff to seek a water sample. The water sample results revealed that a minimum threshold of 1.8 MDLs, which is the method detection limit allowed. The property has 210 MDLs of oil and grease, which is being discharged in the city's MS4 system. I visited the site 11 times. Through my first inspection, I found the property in violation of the above mentioned sections of the city code. I have attempted to gain voluntary compliance in this case, but as of my last inspection this morning on

trying to figure out exactly which part of what we're talking about is noncompliance. I have emails and such. The first allegation, I guess, is on the water drainage system. I do have pictures of compliance in July when I first got the notice of the water drainage system. And recently, this past January 2nd, also compliance. The little box that you were seeing up there, that's a runoff water system from the roofs in downtown Cocoa Village there. When we had the hurricanes two years ago, we were instructed with Scott Davis, the building official at that point in time, in preparation for the hurricanes.
and Mike DeChristopher with the building in the back. And we temporarily put in a 12 inch drain to drain it out to the street area. So that was done way back when. So
Flag: numbers, amounts, negation or names differ between the machine readings · 00:13:25–00:13:27 · unresolved: the words are not shown (unclear audio); listen to the recording
the kiosks were built. They complied. Every business has had their BTRs, business tax receipts since then. I do have copies of every tenant down there. You can't get a business tax receipt unless it goes through the building department and the building official comes out and confirms that everything is ‸ compliant.
So I'm not quite sure why there's something in noncompliance. Somebody actually had to remove that's the that's right there. That picture is a junction box. There's a cover on that junction box. So whoever made that picture took a cover off the junction box because it's not like that.
you go down there right now, there's businesses operating in these buildings. So nothing has been changed since the whole system has been approved. So I'm not quite sure what's in noncompliance there. General general conditions. Code enforcement has been out there with Pub Americana. They said we needed they wanted to ‸ paint the stained walls and ‸ that all has been painted. The streets have been pressure washed. You know,
Mr. Chair, if I can. The there's several cases tonight with different addresses. This is strictly the beer garden and the kiosk. Pub Americana is later in the agenda.
thing, ‸ we need to focus on what's available at the beer garden. So when he talks about the building with the public Americana, that's another address. That's a separate case.

grease and substances inside that water, which cannot be put into the city stormwater because it's creating issues with the city's pipes. And that's what brought us there on that. This is outdoor storage. He cannot store stuff in between the alleyways because then it blocks the egress. The electrical was discussed with the building official and Mr.

two pictures behind there. And yes, I met with them. The only issue they had and the last thing Gonzalez said was that there was grease in this water overflow waterfront. If you look at that picture right there, even though there's debris in there that you're looking at, the water level is not exceeding the three green pipes that go in there. That's like arguing to somebody. Hey, you've got leafs in your gutter system, but it's not clogging.

that system is up the hill and it's designed that way because it's overflow. It goes from that pipe down into the main basin where the tables and chairs are the beer garden and it goes into that reservoir you saw that systems working perfectly. You can see it right there.

cut their water pipe from their roof drainage system, which drained right behind the kiosks and it flooded out my kiosk did a bunch of damage and it floods Pub Americana all the time. They have to control their water and they're not.
No, no. We cited her because she cut the pipe to get runoff from the roof. She fixed the pipe back to the way it was. Did you or did you not go and be told that the drainage from that section is your responsibility? I'm
not responsible for her drainage. Every property owner. I'm an attorney. We do property contracts, whatever. Every property owner has to control their own water. It's been an issue since ‸ since the previous owner of that building. It's an issue today when we had the hurricanes. I met the whole city down there. We had everybody down there. It was me to Christopher. And at that point, the green apples. The only person that did what they were supposed to do was me. We directed the piping.

He stated earlier that when you get a business tax receipt that the building department somehow is involved and they come out and do an inspection, make sure everything's complied with. Is that accurate?
It depends on the nature of the business. If it's a brand new business, brand new building, they will go out there and the fire inspector. If it's a renewal, a lot of times it just depends on staffing and what they're doing at that time.
So you know people doing business in this facility would that type of thing have happened when they apply for their business tax receipt? This is an existing structure.
‸ It was initially opened. It's nothing that I've checked into because at that time everything was ‸ getting renewed. The business tax which needs for just getting renewed. A lot of times they're just paid for ‸ renewal. There are no other inspections after that.
And on this case here, I just showed you said that it was started on the in July of 23. Yes, sir. But here I have August of 22. Is there a reason why the dates where it says notice the

Yes. And even one of the neighboring properties has to use a sump pump to try to pump it out. There's a drainage issue. One of the drainage issues, whether it was approved before or not, is the fact that you're dumping this large pipe into this box, which then has to filter through these three tiny pipes.
Flag: words only one machine reading has (possibly not said); the recognizer flagged its own output; a language review questioned the wording · 00:23:58–00:24:16 · unresolved: the words are not shown (unclear audio); listen to the recording
That's his words. Fix in there to try to fluctuate the water that is not working now. It does not. When we get a lot of rain, it does not drain properly.
If you take a look at it. Okay. Those three pipes are six inch pipes. You add three, six inch pipes together, you get the bigger circumference and you do the large pipe that was engineered by engineers stamped and approved by the building department and Scott Davis. Actually, that system was better than the one that was previously granted for that area. And it's not just that, that whole beer garden property is a, is a, is a reservoir.
had to install in there because there's a permeable rate that the water goes through the grass into the soil. That was all approved and it's been approved and there's been no change that picture. Even though there's debris and stuff in there from other roofs and trees, it's still working. The water level is below the green pipes.
Flag: numbers, amounts, negation or names differ between the machine readings · 00:25:24–00:25:28 · unresolved: the words are not shown (unclear audio); listen to the recording
And Mr. Chair, I'll just debate that by stating when you take a large pipe and you try to filter it through three smaller pipes, there's issues with the drainage, especially with ‸ that much debris in there, which clogs up the smaller pipes.
Flag: numbers, amounts, negation or names differ between the machine readings · 00:25:57–00:26:01 · unresolved: the words are not shown (unclear audio); listen to the recording
Okay. But it's not working. Okay. And as a certified stormwater inspector from the state, I am giving testimony that that system does not work. Okay. And is not working properly, especially with debris that gets clogged into the pipes. It is not working the way it should. So he needs to fix that. Whether he has to put a strain on there to get rid of the debris or somebody has to do that. You cannot have debris like that on that and expect the water to flow properly. And there is a flooding issue. There
Okay. And I, I can't reiterate what the issue comes from. So I mean, the city and the engineers and every, um, uh, all the engineers from the city of Cocoa, we've been at the premise. So, Mr. Chair,
Flag: words were replaced by a machine repair · 00:27:26–00:27:27 · machine repair: words replaced where two further machine readings agreed (not checked by a person)
code issue with what we voiced a code issue because when I was the only one that did anything pursuant to our meeting with the city down there, Donna was the green apples owner at the time. She did nothing. Right. And the big problem here, since we had the pictures,
want to know is this has been a problem more than one day. And because you know, it's been a problem. Why have you not made more of an effort to get that particular problem fixed?

contact and re notify, re contact them to make sure that this issue is not becoming your issue because now it's your issue and not, not theirs. So we have to look at you and not them because it's
your issue. Well, the flooding started is because green apples, they enclosed an alleyway. They enclosed it without permits. When I bought this property, they enclosed and I own half of that alleyway.
So you should. So what I'm saying is the alarm should have been raised before now that ‸ this has been a major issue. And when it first started, like I'm just saying then something should have and could have been said before now. Well, we have,
I I've addressed it with the city plenty of times. And if David Lightholder was sitting up there as the contractor, he's addressed it. We've all addressed it. We've told code enforcement they have to do something about green apples. It hasn't been done.
If it has been, if, if Mr. Dennis hadn't done anything about it and ‸ it's still an issue. Now we're looking at you and you know, you, you're saying it's somebody else, but it should have been a, an issue that should have been addressed.
And I sent you pictures. I sent you pictures in July when I first got the notification. This picture is way before July. It gets cleaned, but that's what it's like a roof.

the environmental, um, authorities on the, the level of, um, sanitation or whatever going on in this hole. Do you have any idea what causes those numbers to be excessively high? Is it because of grease and particles being put down the drain inside the restaurant? Or is it because of things actually being poured into this hole? What is causing the, the levels to be so astronomically high and out of control?
Initially, what led, what led us ‸ to go get water samples was, uh, one of my observations and seeing a grease pot outside and the accumulation of grease on the ground.
um, spoke with the stormwater division, um, and realized that it was all flowing through there. So it's overall, it's in the, it's between the improper handling and the transportation, um, of oils and grease through there.
whether it's directly being poured in there or it's just cleaning pots ‸ outside or dripping or going in through sinks, it's, it's improper handling of it.
kitchen mats that they walk on in the kitchen that collects grease. If you take them outside and you hose them off the residue from the mats go in there. If you have garbage cans that people throw away and you rinse them outside. Um, you know, we focus on grease, but milk and dairy products are big proponents of, of these clogs and stuff like that. So that's that portion of the illicit discharge. And then there's the other drainage issues that are there.
Flag: words only one machine reading has (possibly not said) · 00:32:57–00:33:00 · unresolved: the words are not shown (unclear audio); listen to the recording
And it's a separate case, but we're talking about it and you're saying that the grease is from them doing something. They have to get up here and say what they think is part of the evidence. They're here and that's their mats that you saw a picture on and it's their corridor that there's that he's saying that there's grease in that doesn't exist anymore.
‸ Mr. Burnham. Thank you, sir. And I really do appreciate, you know, the amount of time that we've spent on this case is a little bit more than we spent on most cases. And I feel like we've really touched on this illicit drainage,

breeze through these other five that we haven't touched on. We spent a lot of time on this drainage. We haven't spent any time on these other five. I want to get this case settled real quick. So this is
This is an exterior wall, weather standing. That's also part of the illicit discharge, but it's also weather standing on that wall. ‸ This is throughout the property. There's just photos of some of those examples.

explain your case, please? Sure. This is the bank building. It had a tenant in there. They were doing a Spanish restaurant. Those pictures were taken in, the ones that showed this violation were taken in July of last year when we received the notice. I addressed it with the tenant. All that new mulch, everything was cleaned up. We took pictures and everything. That tenant hasn't been there in probably six months. The places after it was cleaned, it's been vacant. We signed a new lease with Strange Fork, who's been in there working. So
they're trying to get open for business. So the issues that he was complaining were fixed last year in July. That's why you see all the new mulch and everything. There hasn't been any discharge or anything. ‸ All these buildings have to be, they're under the EPA and the Health Department of the state. They come out and inspect grease traps and things like that. They have to comply.

restaurants. ‸ We just lease property. ‸ So those issues were complied with last year. We have a new tenant that's opening. And ‸ when they open, they file their BTR, their business tax receipt. And then the city comes out with the building official to make sure the restaurant is compliant before they allow them to open. So once they get their BTR, then they're complied. So they're in the process of a new restaurant going into a building. The old stuff was cured.
When I get notice, I call my tenants. Hey, you need to do something about the situation. And all my leases, they are mandated to comply with city code and city laws. If they don't,

You know, I'm well vested here. We want to have a beautiful city, you know, ‸ but they're moving in. So what do you do with somebody that's starting their business? We have to, if that's what it looked like today, it has to be addressed with them. And, and, and these, these parts are not open to the public, by the way. You know, they're not open by the public. But, so there's no discharge. I mean, that's not even my property. That picture right there is not even my property.

pump isn't working, guaranteed I am getting water inside my restaurant. So for code to tell me that I cannot store that outside I think is unfair and it's causing undue burden on me because if I don't have that pump out there I will be flooded. The first, before I put that pump out there, I had, we had a real big rainstorm years ago and
my restaurant all the way to, uh, to Delanoi. I had to file an insurance claim that time. It hasn't been as bad since only because I have the pump out there 24 hours a day just to make sure.
Mr. Chair, if I can just real quick for the record, this gentleman has not been cited by code and this gentleman is not responsible for the property. Mr. Stefan is. He is the tenant. So when he makes the comments that he was cited, he was not cited. Mr. Stefan was cited. ‸ I also want to clarify the sump pump is not considered the outdoor storage, but the sump pump regulates the fact that there's flooding and drainage issues.
And he has to use a sump pump to pump it away from his kitchen door, which is also what causes illicit discharge because the grease and stuff settles in the back of that area. And then it's being pumped out, which is also an intertwined problem. But I wanted to ‸ specify that the sump pump is not the cause of outdoor storage.

doing what we're doing. Because we're going by your word and his word. And we want to get it fixed. But we don't want to penalize anybody. We just want it fixed.
We have had public works. We have had storm water. We have had the water department that does pipe cleaning and stuff. This has all been out here. We've had the state come out here and look at things. Actually, this complaint was actually initially started by the state who found grease issues. So this is a culmination of years of discussing this, trying to work on solutions and getting things fixed. And even in Mr. Stefan's earlier testimony, he talked about trying to put in temporary. Temporary is not good forever. This problem needs to be fixed. And it needs to be fixed correctly at ‸ all times.

pump because I have a flooding issue. But I have earlier testimony saying there is no flooding issue. So, yes, we need to get together. And to answer your question, we have with multiple city departments. This has been ongoing for years. Part of the problem is before the beer garden and the kiosks were built, that was a big vacant lot. You may remember when Ryan's pizza was there, it was a vacant lot. So when that water ran down, it all kind of swayed into the vacant lot. And nobody cares if there's soppy wet dirt in a vacant lot because it wasn't affecting anybody. Now you put in more obstacles. The water has to be redirected. It's not going in the right places.
Just a comment on that, ladies and gentlemen. You have to bring in all the property owners. We control our water sufficiently through code, through engineering and everything.
her roof drain. Her whole 10,000 square foot roof fills up with water because it's a parapet wall and was coming in the back of the alley. You have a picture of that.
The other issue is that alley right there. The water wouldn't be going behind there if that alley wasn't built without a code. That property owner needs to come see you guys. They need to go after that. ‸ Give me the permit that shows they enclosed that building. They caused a problem for the drainage. Mr.
Stefan has been directed to the building department. That building has been there for years. And he can request that as a public records request from the building department. Again, the alleyway, the kiosk, all that area belongs to Mr. Stefan. But ‸ I did not own
Do you see the alleyway up there, ladies and gentlemen? The simple fix to this whole problem is to have her roof drain connected. It goes around that corner.
this is what the plumbers that came out there for said. This is what the plumbers said she needed to do to fix the problem. It's this big of a hole. You run one of those big water lines down there to Delanoi. Like, Pat, we had to do that for the second floor to the alleyway. We did that for the city. That's all that needs to be done to fix that flooding issue. But they refuse to do it. I can't make them do it. But that's what the city engineer said needs to be done.
And that's why we asked the code to get involved. Make them fix their water. Our site has been approved. And it contains our water. The problems exist because Green Apples Building does not. And it's an easy fix.
I gave it to you guys last two, three years ago when she did it. I gave you pictures. Donna's out there doing plumbing work without a permit that's causing me problems.
So we're not talking about your neighbors. We're trying to talk about this case. And you've got a little discharge. ‸ Is this correct, Mr. Gonzalez? That

to state something on the record, make sure it's correct. That is incorrect. What wound up happening was we are forced to bring our garbage as well as our used cooking oil three and a half blocks away ‸ to put it in the reclaiming and the garbage area. That's an undue burden in itself to have to bring that material three blocks away.
it in a garbage can, took the garbage can, not realizing that the garbage can had a hole in the bottom, and the lid popped off. So he left the trail. I saw that.
still, there was nothing I could do about that. I have since bought steel containers that have screw on lids. So now while I transport it, I load it up inside my restaurant. Nothing is done outside. They have stated on the record and in their violations that I cleaned things outside. I do not clean things outside. There is no more storage of any mats outside. The mats get cleaned inside my restaurant. They get put through a dishwasher. They are not outside anymore. I do not clean. This is not the 18th century. We don't clean pots and pans outside. uh I guess for the past couple of months going on and off with things. um He brought this property to my attention recently. My husband and I went out there and assessed it. um ‸ I did file, we initially filed for a, just like the other day, to do demolition of the front of the property where all the wood is because there is a block building behind it, and Mr. Silver said that he'd like to keep that structure and decide what he's gonna ‸ you know, how

of the structure. What I'd like to do is get a demo permit to pull off the front, clean off the property, see where we're at with the property and what can be done to fix it. So um by the time we get an engineer and well, we can bring in demo right away uh once I can get on my guy's schedule um and then bring an engineer to assess the building and then uh go ahead and file for permitting to, you know, to fix it. ‸ Staff doesn't object to 60 days. um if she's getting an engineer though, I don't know that 60 days is going to work for her. um because engineers take time. So in my experience, it would probably be more of a 90 day fix. If she's actually getting an engineer, she can start the demo part of it. But then for the engineer and the permitting and the plans that she's going ‸ to ‸ draw, it's probably going to take an additional amount of time. So 90 days would probably be more appropriate. oh

in terms of investing into this property versus demolishing the whole thing and selling it. So we were kind of weighing out those two things. So now he's decided that yes, he wants to invest in it. So we'll instead of demolishing the whole thing and just leaving it ‸ as a lot, we'll go ahead and clean it up and, you know, make it a functioning business. I
think that there's some agreement here on the board to give you more than 30 days um because to do all that, I think you would you would definitely need the 90 days um and that would be if you got on it tomorrow.

um Well, just to clarify, the board can't address your issues about fireworks or anything like that. That's not what they're here to do. So that's a separate issue.
um The actual lighting off of explosives and fireworks is a state statute, um which is enforced by the PD. um From what I understand is they're still investigating it and they're aware of it. um We decided as code to go ahead and cite it once the graffiti and different. I mean, we've already towed a vehicle from this property for her and
with the graffiti. And then, like I said, she has other items hanging all over the property, which are just meant to, you know, aggravate the neighbors. So these are our violations. These are city code. That's what we can do. The

Just to reiterate, the code enforcement board can only hear the violations that are brought by these officers. This is not a public hearing where people can just issue complaints about other people. It has to be directly related to the violations at issue. And there's no violations for fireworks. So you have to find another route. And this board can't tell you what route to go.

um so basically your roof must maintain its drainage purposes based on the code. So if you have shingles up there that are 25 years shingles and you haven't pulled a permit in 40 years to get a new roof, those shingles are no longer up to the building code. if you look at this particular property, you can see around the chimney area, you can see up near the front where there's where you can also see in ‸ other pictures where water is being retained underneath the shingles. So it's not based on whether or not it leaks into the property
soak into that shingle area and drip into the attic type area underneath and take a while. So the goal of roofs and drainage is not to get it to the point where it leaks inside of a house. um so yes, to answer your question, the building code does require proper shingles with proper amount of grit per shingles and the life of the shingle is only good for so long. And basically in the state of Florida, we've had a few hurricanes recently and several hailstorms and you can see on this roof where it's worn, where the grit is gone. um I'm not asking you to replace it. You just have to make it suitable. Some people use membrane products to coat their roof. Some will do a shingle over ‸ shingle, which you can do once in the life of the house. um so you were not cited basically to put up a new roof. We're just asking that you fix this area.
runoff from underneath the tar paper is getting old and the water runs and that's where it is. So that's how we base the fact that this roof is not draining properly and it's causing the issues and doesn't meet our code of roofs and drainage. But we do consult with the building department and the building code of Florida because they have their own. And that's how

There was a window. There was some other stuff up by the front, and there's all the leftover debris that's out front that's been sitting there. That will not be picked up by waste management because it's construction debris. So it's just been sitting there that has to be removed. And then the permit required is for all the new windows that he installed on the house. Okay.

he does have a siding permit, but he needs to get a fence permit, and then he needs to get that porch looked at from the wood that was replaced. And you can see the new wood in this picture on the porch section. That needs a separate permit.

had contact with the property owner after several attempts. It should be noted that this case was brought to staff as a citizen complaint, and there is also an active case for
discharge and other various code violations. So that that time it was determined ‸ that this is a repeat violation for the above mentioned sections of the city code. I brought this case for the code enforcement board as I've worked this case for 57 days. The violations were resolved on January 4th, 2024. I sent the notice of hearing on November 8th, 2023, and
Due to the severity and the repeat status staff finds in case 23-1229 that the owner was in violation and a fine of $250 to be imposed for each day. The property was in violation. Uh, this property was previously found to be in violation April 21st, 2022. Uh, I brought this case to the code board at that time. Um, when the case was complied, I did also make mention to the property manager at that time that if it did occur again, uh, it would be a repeat offense. Uh, it remained to be a blight in the area. Uh, at that time, the tenant moved out. They brought a new tenant in and ‸ same violations occurred.

taking over management, at which time I found several violations, many of which were mentioned. I discussed that with the tenant and told them that he needed to be in compliance because it was also a violation of our, um, lease agreement. And, um, not only did he not comply, but he was not paying his rent and he was evicted. He no longer lives there. The house is now vacant.

Okay. So that was not that long ago. So as you can see, the, the property is no longer, um, in violation. Um, what he mentioned, I was not the manager at that time. So, like I said, I've addressed the, the issues once I took over in July ‸ and that didn't happen overnight, but here we are.
So the original, um, case, which was brought to the board, didn't, uh, get fines. They, they were found in violation. There's a finding of fact, uh, they complied and fixed everything prior to the noncompliance date.
But the proposed fine was $75 a day for that first time. Generally board. It's just a, not a hard and fast rule, but oftentimes doubling the original fine is, is a reasonable repeat violation. That's just something to consider. Thank

amount of the original fine. Um, however, we do look at severity and the reoccurrence and the fact that it's a rental property and it's only been within a year since it actually re offended. So, um, that's our recommendation, but the board is, ‸ can find anywhere up to $500.
said, I did the math too. I know, but yeah, I agree with Mr. Bonnet. It's obvious flight on the community. Um, those 57 days is not the only days that this property was a problem for the community. You can see here that it's been ongoing since 2021 off and on with these people.

Thank you. So obviously I haven't been the manager from the beginning of these violations and my understanding from what he said, there was a previous tenant who was in violation prior to the one that was just evicted. I'm just going to bat for my client. For what it's worth. When tenants violate the code or the lease or anything, there's only so much that we can do as homeowners and property managers. Our hands are tied.
We can't change the locks because they're not paying the rent. We can't turn off their utilities because they're not paying off the rent. Like we have to follow certain guidelines and procedures per the Florida statutes and the Florida Landlord Tenant Act. So for what it's worth,
but the reason that they're not managing anymore is because they weren't doing their job. So I don't know how much that took into effect as to what was going on and what was not being done. But I know that the homeowner does care about the property and it being in compliance. And that he when he hired me, he said, do whatever you have to do to get this property where it needs to be. So, you know, the tenants were the ones that were not in compliance, not the homeowner. I know that in in retrospect, he's still responsible for his tenants. So if you could just take that into consideration when you're considering your fines, I would appreciate that.

I had contact with a property owner on the morning of November 13th, 2023, advising him that extensions would not be provided as he had passed his 10 day appeal period and ‸ staff contractor was already notified of the abatement. But if he began abating the property prior to our contractors arrival, no invoice or lien would be recorded. Fortunately, our contractor went and abated the property. The property owner here is present appealing the cost of that abatement.

So by the time I came, I never saw this letter until I have noticed the sign I drove by the property notice sign. So the letter came ‸ few days after, uh, even after the, the, the, the abatement happened. Uh, I understand that it is my responsibility to keep the information updated. Um, ‸ but, you know, we all have limitations and, uh, it was a recent move and I had several, uh, situations. Uh,
Flag: words were replaced by a machine repair · 02:47:11–02:47:12 · machine repair: words replaced where two further machine readings agreed (not checked by a person)
that happened at the same time. So I, my third page is you will see, you know, I'm not just making a sad story. That was a travel dates. I basically collided with the same time of the notice. And

to our contractors. Extension for abatements cannot be provided. And then I said basically go on trying to explain, uh, and, uh, in the past I received extensions. I only had had really in all the years that I owned since the 2020, a handful of, and the two of them were basically duplicates that were given one day. And then after that, uh, some other officer came and gave us

the grass already. So I don't know if by contacting them at the office, I did myself a disservice because if I would have said nothing, I mean, I think, I don't know what the call that I was trying to get them to make was give me a day or two and I'll take care of it. And I, I've heard other cases here of, uh, extensions of 30 days and that are long winded. And I was asking the opportunity to take care of it and I will always take care of this property, but there have been occasions that I have been,
Flag: words were replaced by a machine repair · 02:49:30–02:49:30 · machine repair: words replaced where two further machine readings agreed (not checked by a person)
uh, it's just something that I could not comprehend. What, what is a overall objective and purpose here? Uh, if I am pleading to try to give me a day or two, I'm not asking for a week. I'm not asking for a month to, to, to take care of this. Uh, now it's two lots that I own there because they're contiguous. So it's all one big piece of property, two lots. And I usually take care of it. Uh, $300 each is $700. Uh,
I was hoping that one day I could develop them. But I tell you the truth, uh, based on my experience, I am really hesitant to do that now. Uh, we continue to maintain them. Uh, but if that is a way the city of Cocoa is going to be doing business, uh, I am not really, uh, all that positive and

schedule because we didn't send him just Mr. Hernandez's property. We sent him any abatements that were done in that timeframe and they go. So once he sent the abatement, we have no idea when he's going to come and cut the grass. And what Mr. Hernandez isn't mentioning is this property has been cited multiple times. In the past in 2020, he brought up an argument about not getting the letters and everything else. And we waived internally his fee at that time. So he's fully aware of the abatement process and what needs to go on. And also based on the pictures, the property is not cut or maintained on a regular basis. The sidewalk is covered with grass. There's trash there. This is a residential neighborhood surrounded by houses.
Mr. Hernandez needs to get a contractor on a regular mowing schedule and cut the property on a regular basis. Um, we don't control the cost of the contractor that's done by contract. So because he had to remove debris and use a different type of mower to cut through the grass.

fee. So this is not new. And as I stated, this property has been cut in the past. And since Mr. Hernandez owns it, he's been cited as well. Um, it just needs to be kept up in a regular basis because it is surrounded by houses and there are kids in the neighborhood. And this is severe.
36 inches in areas plus trash. So that's staff's defense. And then once we do, if you come to us after we would, he sent it to the contractor, it's very hard to get a hold of him and say, don't cut this give time. Usually people will contact us on the seventh or eighth or ninth day.

some of them not. He was actually bringing a car carrier into the neighborhood and loading and unloading cars. So it's not just like somebody had one car. The gentleman who was renting the property at the time was running a business. Who
I told my tenant I said are you running a business out of your house? he said no ‸ I've got my business in Orlando So we were kind of going back and forth saying he is not running a business out of his house. and it was kind of an you know argument so I went to a very good friend of mine who's been an attorney for 30 years here in Brevard And he sent a letter to the city attorney saying, could you please give us some evidence and some proof that he's running a business besides a neighbor that doesn't like him that
arguing back and forth, calling the police all the time and saying he's running a business. So, then when, we sent the letter, we got no reply, nothing so I kept talking to Vince saying he's not running a business He said, just go get a business tax. I mean yeah have him go get a business license tax we went down there she said no we can't do that he
and I wrongly assumed that when the case because it was closed without incident we didn't do nothing we didn't we didn't do anything we didn't non comply we didn't comply

the case so because I asked for evidence or proof that you that my renter is running a business where's the proof you can't just arbitrarily say somebody's doing something with no evidence and proof and then slap a lien on my property because of it. also on the business tax receipt on my end I was told after 65 you didn't have to have one so anyways he closed the case and
but that that was wrong so the lien stayed on there I didn't even know it until I went to sell one of my not that property but another property they said you got a lien on her and so then that's when all this started started happening it's been a learning experience for me
from the military he he did it for years my husband had a massive stroke and so I I not only took care of him but I'm taking care of these properties too so it's been a big learning experience for me I've tried to comply everything they've asked me to do every time they came over for an inspection
at all you need to replace the fence I cut I had East Coast fence come down they said you really don't need to replace this fence and I'm like well just do it just replace it because it would look a lot nicer I'm really trying to work together and comply with all this stuff but it's been quite a bit that they've you know one thing right after the other finally got everything I think in compliance I did my best and Vince was gone and so I guess somebody else went over inspected and said we're good finally
this case was like any other code case notices were sent time was given for compliance ‸ when it didn't come into compliance it came before this board testimony was heard evidence was shown it was found to be in violation given time period that passed

January after the BTR lady said they're not running a car sale business ‸ they can't do it in that zone I said they're not selling the cars they're transporting them she said why are you told me they need ‸ a BTR I closed the case at that point because that was the only violation left open and if they're not going to require a BTR then we'll close the case at that time but when her and her tenant went there they said they were selling vehicles that they needed a light BTR to sell vehicles so that's the whole story of the case in a nutshell ‸ but there's other cases that transpired preventing her from coming here for this meeting tonight
and I didn't receive information in the mail I would like to see your the signature on the certified letter because I got one way after I told Vince that I hadn't hadn't gotten anything ‸ but I wish you would have told me what you're telling the board when I talked to you on the phone because you didn't and I assumed when you said I'm closing the case you the the whole thing was closed I

and I found out what was happening that I didn't know any clue I didn't get any letters since I found out I have complied with them I have worked with them and you can see it in the property
is gonna ‸ reduce your lien today and that we are gonna ‸ work with you the amount of reduction is what we're debating we're not nobody here is suggesting ‸ appreciate
little background about it is this board ‸ has reduced lanes before and then it goes to the city council for approval and the city council has ultimate authority and when they don't approve what we put through it makes us look foolish yes we have to put something forward to the city council that we think that they'll actually accept
