Transcript Partial transcript
Machine transcription of the meeting recording. The words are the recognizer's, except where a passage is marked as corrected or machine re-recognized; most have
not been checked against the audio, so words, numbers and names can be misheard.
It describes what was said. It cannot establish who voted how, an amount or an outcome — the City's
minutes do that (above).
A time links to its passage, and “Copy link” copies that link. No recording can be started from here.
incomplete recording: The City's published MP4 for this event is truncated on its CDN: 2055995392 of about 3150429447 bytes (65.3%) were published and the file has no moov atom, so no player opens it. The audio of the first 7509 s was recovered from a scratch copy (frame walk of the mdat + libavcodec frame-length oracle); the rest of the meeting is not in any published file.; 453 suspect passage(s) marked in place; 3 stretch(es) where a voice was detected and no words were recognized.
How this transcript was made. New machine transcription of the whole recording, with 18 voices separated from the audio.
34 short machine repair(s) (51 word(s)) are labelled in place, with the original words beside them: an ordinary word was replaced only where two further machine readings agreed on a different one.
Checks run on this transcript: the recognizer's own warning signs, whether a voice was detected where the words are and a language review for likely mishearings.
A second, independent machine reading was compared with it word by word: the same words for 76.2% of 17,825 content words.
Dotted words (362 places) are ordinary wording differences: hover or tap to see the other reading.
453 passages (36% of the words) are marked suspect: their words are not shown ("unclear audio") and support no statement: numbers, amounts, negation or names differ; the language review questioned them; or no voice was detected there.
Agreement between two machine readings is not verification.
Voice detected, no words recognized (3 stretches). Something may have been said here that the transcript does not have:
00:15:31 (7 s) — neither reading has words
00:56:35 (6 s) — neither reading has words
02:05:07 (1 s) — neither reading has words
Speakers were separated by voice. A plain name rests on evidence tied to that voice; “provisional” is a name from an earlier text-only pass and is not verified; “Speaker N” is an unidentified voice.
We're going to call this meeting to order. We're going to start out with the Pledge of Allegiance. I pledge allegiance to the flag of the United States of

Yes, sir. And if we could divide him up and elect the chairman first and then elect the vice chair after and do them like two separate, it might be a little bit easier for the record. Yes, sir.

and I've had contact with the property owner. I brought this case before the code enforcement board as we have been working ‸ this case for 476 days and the violations have not been fully resolved. I sent the notice of hearing on November 3rd, 2022, and it was sent certified and posted on the property in violation.

Now that seems like something easy, but let's see, where's the disconnect as far as you're saying that you have your permits and what the officers are talking about?
Mr. Chairman, according to the building official, he has put a hold on the permit that was issued because the brackets that were installed for the awning are not represented on plans that were submitted when the permit was submitted. So basically, it's he needs new engineering or new information from the manufacturer on the brackets holding up the awning. So he is not doing any inspections or anything on the permit. He's put a hold on it because what's submitted with the permit packet must match what's on the job. So that all we're waiting on as far as the awning. And the reason why there's other pictures is because the first awning that were there became dry rotted and unsafe. And that's what drew us out there to begin with. And

Well, based on a testimony from Mr. Stefan, he's already got all that information. He just has to get to the building department, get it put through and have them reactivate his permit and then have an inspection done.

So you have a parapet wall that's like three feet, and you have a roof system underneath, and then you have the responsibility under the lease to make sure that their scuffers are clean, they're maintaining their property. It's their commercial business.

Yeah, the interior is all of these roof tiles and the wood and everything that's inside of the building and not on top of the roof. So that's what Mr. Davis is referring to as well as all this area on the interior of those buildings. So these are not current pictures? Yes, this is from December 15th of this year. And so is that one.

I did an exterior inspection today. The business was not open when I went through. I had spoken with the tenants as well and the interior has not been corrected. I inspected it after the storms in December when it was still leaking and the tiles were not fixed. There's
‸ Mr. Chairman, just for the record, since it was mentioned about the tenant and his lease with the tenant, that may be the case and that might be a civil issue between Mr. Stefan and the tenant. However, under Chapter 162, we have to cite the property owner and who's listed on the property appraiser, which happens to be Mr. Stefan. So if he has that in his lease, that would be a civil issue between him and his tenant. We

So because they pressure washed it and done, that could be taken care of now because they weren't cited to get a permit or a new roof. They were cited to do roofs and drainage, as she stated. The only other items that we have left is the items, the wood, the different buckets and stuff that are laying between the carport and that trail on the side of the house. So that's where we are.

this time, I would like to change the recommendation. Let's table this case. And as I stated to Ms. Brown, I will be happy to meet her out at the property. I will be happy to look at her roof and point out the issues that need to be cleaned up. And we'll table this until next hearing. And that way, if she's in compliance, we'll close the case. looking at here, the two recreational vehicles, the two boats that are on a vacant piece of land, 200 North Cocoa, which is a violation of the ordinance.
From what the owners told me, ‸ the boats are just being stored in the property because he wanted to start a boat storage business, I believe, or a boat pair business. In this photo, we have a tractor and the boats. The same applies here. Is this his parking lot?
Yes. There was some erosion issues and a slab that was poured with no permit. I believe the intent was to put a building up and do a business, but it's just never taken off. And now it's just become a storage lot.

what I'm saying is those those site plans, because obviously there's an issue here. Something is not matching up. Have you spoken to our code enforcement officers or anyone within the city to see exactly what's going on? Because you have business tax receipts, site plan approval required and storage of recreation vehicles. So

I had the permits to do the swales that were in there and everything. And he said, bring them in. But I ended up, you guys wanted it all flattened out and back to normal the way it used to be. So I brought it back the way it used to be.
So he doesn't have a business tax receipt. He's storing recreational vehicles on vacant land without a primary structure. Just leaving them there. It's not even allowed to have outdoor storage because there is no site plan. There has been nothing given to what's going to be there. So he's basically using a vacant lot to just put his stuff on because he owns a vacant lot. The site plan needs to be done so that he can decide what he's going to do on the property, where he's going to put the building, and then how he's going to do things. He's got plans, but what he's kind of saying in a roundabout way is the zoning has now changed. So what he intended to do, he can't do because he hasn't submitted that. So he's not going to be allowed to do what he figures out, what he needs to do with his property. That property needs to ‸ remain vacant. He can't use

I'm just being in general that you can't use the vacant land until he gets a building and a site plan and parking and drainage and landscaping and then a business tax receipt. So that's what we're bringing ‸ before you today.
So, Mr. Chair, if I can just clarify it for the board. If he removes the items, removes the boats, then there's no reason for him to get a business tax receipt or a site plan because he's not using the property. So if he wants to cure all of these violations, removing the boats ‸ would take care of that. If he subsequently wants to put some kind of business on there, then he would need to get the approvals and do a site plan and get his business tax receipt.

and they told him that. He can still apply for a zoning change and he has to go before the board, and they could entertain that there. But I still go back to what the attorney stated. If the boats are gone, everything else goes away for now until he's ready to plan what he wants to do with the property.
I actually wanted to clarify with Mr. Gonzalez about the business tax receipt. Did you cite him because you assumed that business activities were being conducted there because of the boat storage? Because he mentioned they were his personal boats, and that's actually not a business.
Well, he mentioned his business, that he wanted to operate in there and get it going with those boats being two of them, so that's why he was cited for the business tax receipt.
for the building I was going to put there. Hurricanes hit, COVID hit, everything went to standstill. But I did pull my permits. I do have them here. Oh, I see

The notices you receive prior to this hearing are just warning notices, wanting you to fix what's there so that we can move on. We don't hold against anybody multiple violations. You're here because this case was started in August. There was a severe hazard in the front porch, which could have caused injury. Once

No. Exterior general conditions show the condition of the exterior of that property, and the roofs and drainage also covers the collapsing of that roof. The fact that you put the two-by-fours up without a permit is a separate violation.

if you go here and you're talking about putting a six foot fence to conceal that that would prevent us from taking pictures of it. It doesn't necessarily put you in compliance. The code doesn't say if you put up a fence and hide it, it's there. So you could put up a fence and then we wouldn't see the trailer. ask a question yes sir officer Bonacore yes you said you've worked this case for 717 days. Can you say why? Is this unusual for you to be working a case that long?
Yes, in this case, let me answer that because Mr. Bonacore was not employed here when this case started this case was originally started by officer Carver and she ran it through the system, but then she left. We went through some personnel changes and the case kind of laid dormant because of new officers coming in. Mr. Bonacore picked up the area thus picking up all the other cases He essentially, you know, it was started in 20. He essentially sent out new notices and kind of restarted the case, which is why I only put his pictures from his inspections up there
