The City's record

Transcript Partial transcript
Machine transcription of the meeting recording. The words are the recognizer's, except where a passage is marked as corrected or machine re-recognized; most have
not been checked against the audio, so words, numbers and names can be misheard.
It describes what was said. It cannot establish who voted how, an amount or an outcome — the City's
minutes do that (above).
A time links to its passage, and “Copy link” copies that link. “▶ Play” opens the recording at that moment, on YouTube, in a new tab.
454 suspect passage(s) marked in place; 1 stretch(es) where a voice was detected and no words were recognized.
How this transcript was made. New machine transcription of the whole recording, with 19 voices separated from the audio.
34 short machine repair(s) (39 word(s)) are labelled in place, with the original words beside them: an ordinary word was replaced only where two further machine readings agreed on a different one.
Checks run on this transcript: the recognizer's own warning signs, whether a voice was detected where the words are and a language review for likely mishearings.
A second, independent machine reading was compared with it word by word: the same words for 94.6% of 17,925 content words.
Dotted words (420 places) are ordinary wording differences: hover or tap to see the other reading.
454 passages (23% of the words) are marked suspect: their words are not shown ("unclear audio") and support no statement: numbers, amounts, negation or names differ; the language review questioned them; or no voice was detected there.
Agreement between two machine readings is not verification.
Voice detected, no words recognized (1 stretch). Something may have been said here that the transcript does not have:
02:06:29 (4 s) — neither reading has words
Speakers were separated by voice. A plain name rests on evidence tied to that voice; “provisional” is a name from an earlier text-only pass and is not verified; “Speaker N” is an unidentified voice.

higher than that. So that maximum acceptable volume then was nearing that maximum acceptable volume by FDOT and Space Coast TPO. New development requires traffic studies to be done. But there's an issue with how those traffic studies are done. Those traffic studies are done by each of the individual construction projects, but they're done in a vacuum. Meaning all they're looking at is the FDOT traffic, the latest that's posted, and what is occurring with their particular construction project. It's not looking at the broader picture. So I want to go over what has occurred during

was there before. Now they did a great analysis. I have to commend what they did. And their analysis, when they were looking at it, they looked at it, and they are on their own going to add an additional east and west turn lane to get into those apartments.
The other thing that's been added in is the Cirrus apartment complex behind CVS on 524. That's an additional 280 units, and per their traffic analysis, which is a standard, they use standard software to do all of this stuff, they show
is an added, 52.4 second delay at that traffic light on 524. That's going to be a problem. The other one is the ‸ one that you looked at there, which was the Cirrus apartments. That has no traffic study done. If you add all

And trust me, we're addressing that traffic control issue that you're expounding on. I know that's in Councilman Dow's district, and he's been attending the various meetings as well, in conjunction with other members of council and staff. But point well taken. All right.

So what I've decided to do tonight, I did write to city council, so you all have my written statement, but I want to make sure for the record that I say for the record that Mr.
contract clearly calls this out, that it's required on an annual basis. And so I'd like to read from his actual contract. What it says under the evaluation section is it says, the City Council shall review and evaluate executives' performance during each anniversary of the term of this agreement. Said review and evaluation shall be in accordance with specific criteria developed jointly by employer and executive. Annually, the city council and executive shall define such goals and performance objectives that they deem necessary for the proper operation of the City and an attainment of city council policy objectives, and shall further establish relative priority among these various goals and objectives that shall be reduced to writing. So this is ‸ required to occur in writing. It hasn't. This is frustrating.

nobody has responded. I believe this is a very important thing that needs to occur. And so I have told you and ‸ have given everyone the chance to respond, but
that the city of Cocoa city manager and all city council members, all of you, are derelict in fulfilling this basic yet essential duty of city administration. The citizens of Cocoa care about this topic and want to see it completed.

sir. um So um if anyone doesn't know, the Chief does a periodic uh walks in the community. And um and so that's the opportunity for the citizens to speak out on things that may theythings that they may like and also things that they don't like. um And sometimes we get both. But we and he encourages both interactions.
um But he was they were able to speak to a code enforcement officer on the spot with an issue that he had. Another person had an issue um with a police department, a police interaction, right? So now he has the opportunity to speak to the chief about that situation. And was able to have that positive communication. uh So again, uh thank you, Chief for doing that as well. um You know, good, good time out

haven't been doing it before. I mean, seems like a great idea. It should have been doing it. um I can't imagine though why anyone would think that getting rid of the town halls is a good idea. The town hall meetings are a fantastic way for citizens to interact with their council person and their neighbors in a personally relevant way.
meeting where you stand in front of the dais in a room full of people and you have three minutes to try to state your case and you talk as fast as you possibly can. And you may or may not even get any acknowledgement that you've said anything much less any sort of a discussion. And as far as this, um each district will be highlighted during the new that will be folded into the new State of the City meeting. You know, that kind of sounds like it's more like a summary of what has happened, which is great, but it's not a town hall. So, I'm curious to know who decided that the town hall should be eliminated. um Was it council members? Because, you know, why even run for council if you don't want to deal with your constituents?
member of staff? And if it was, I mean, that's kind of it doesn't matter who, um because basically everything has to go through the city manager, um whose job, as I understand it, is to implement the policy that council makes and not the other way around.
staff has decided to do this, um you know, why are you wanting to remove what is arguably the most effective and efficient way for citizens to interact with their city council people and learn what is going on in our own neighborhoods? You
make no mistake, folks, that's what's going on here. Getting rid of the town hall meetings takes away yet another way for citizens to interact with our elected representatives. It's another step in shutting down the citizens voice about what happens in our city and our future. And that's not how democracy works.

won't go to other meetings. In fact, the first time I ever got involved with the city was in a town hall. Neighbors just stopped by ‸ said, let's go to the town hall. And the reason is there's there isn't that formality. You don't get into the legalese language and that sort of thing. So I think that, um you know, defending that that venue for citizen participation, um I understand her point. And this was,
they've been well attended. People have been very grateful to have that opportunity to meet staff, as well as councilmen, to ask questions in an informal environment rather than a formal environment where you're standing before a raised dais.
Nobody said you couldn't have town hall meetings. If you want a town hall meeting, you have to come in and plan a town hall meeting. that's that you know And that's my thing. Sometimes uh people are persuaded and not really informed, sometimes known as a false narrative. not an item that's placed by council. um Sometimes there's suggestions from staff. um Myself, personally, I'm in favor of town halls, even though I've had one in the past. And I think maybe we had maybe four people and it was large largely advertised. Only four people showed up. It was in a public place. However, I'm still in favor of town halls and
halls. um And I just wanted to let people in the audience know that when you see something on the agenda, that doesn't mean that's something that council put up. Sometimes they're just

not running from that, and this item, I do not feel, says that um town halls will be outlawed or banned or we have the power to do as we choose as a body. That's our job. We sit and we make arguments about things that we want and things that we don't want.
either run from it ‸ we want to remove it from the agenda, but at the end of the day, it's our job to argue our points. That's our job. That's what we do. That's why we have dialogue. That's why this is the only opportunity for us to have that dialogue with one another about those items when the agenda when it's placed on the agenda. um So i so I'm definitely for, just like deputy Deputy Mayor Hearn um is for town halls, for sure. it Red Table Talk. I don't know. I don't know what I'm gonna ‸ call it. But we're going to have times where a community comes together and have the conversation. We do it all the time. It's not about one time per year. We do it every day. This is what we do. So that's my comment.

If it's the boards if it's the council's direction, we will certainly go through that process for this. If there's no uh plan to actually utilize that. I think we had a recent discussion about
center. So we'll hold off on that until further action. I believe part of the donation we have to give it an evaluation to see what it's worth and and that would be part of that donation. um

wanting to do it that way. ‸ just simply a suggestion of uh of myself and staff there. You know, one of the things that I would ask that if we're going to do the town halls that we obviously give staff some time to prep for those and that those go on the calendar so that each year they're on the calendar so that, you know, we don't have to be uh accused of uh putting them on there for purposes of uh politicking or anything like that. So, so again, that was changed to uh just simply state that, hey, there's a suggestion that we do a, uh a, uh a,‸ state of the city meeting. um you can do that at the civic center. And if that's an issue, um for folks in terms of attendance or, our willingness to attend a meeting down, uh downtown, then we also know that, that, that, that can be at a site determined by the council. So
Obviously the mayor doesn't have a district, but again, simply a suggestion as is, uh the workshops, as is the cancellation of primarily most of the meetings in June.
And I tell you that that works out really well for, uh finance staff and for departmental staff in terms of going and prepping and building the budget just to have that time without,
of the city meeting being in lieu of town halls there. Again, I would, uh ask that if you are planning a town hall that you give, uh staff plenty of notice on that. And so, um again, two workshops in the month of February and we don't have dates for that to actually cancel the second, uh meeting in March there. again, we've given you the reason for that, um because we have to have by charter, um a meeting, uh once a month, then we would only have the one meeting in June. And then we would cancel all other uh council and board meetings. I think maybe the board meetings are different than we had last year.
during the month of June, um there'll be no meetings of council. And uh advisory boards there. So that's a little different this year. You may want to have some discussion on that, uh
and then, uh as is probably your practice to cancel the second city council meeting in December, because that is uh close to or close around uh Christmas. So, uh at the pleasure of the of the council. Okay.

Town Hall for the last 12 years that I know of since I've been going. um I also, usually, a state of the city, we've had state of the city meetings. They were the ones that, at least the first couple of years that I was in office, they were the ones that the mayor did in January, which is usually when you would have a state of the city meeting, or it's when you have a state of the state or a state of the nation.

So there's a calendar year and there's a fiscal year. And so if you want to advise the community of those things that are in the new budget, then October would be the month uh that you would do that soon thereafter the adoption of the budget there. the It's been a mixed bag with town halls, but again, we're not resistant to that. um And so, you know, to to have a state of the city after you've adopted the budget, uh which comes uh budget year in October 1st, seems reasonable that, you know, the state of the city would be October 1st. uh Sometimes you've had the state of the city in January. Sometimes that's been the economic development practice. Actually, the economic development uh event is tomorrow night, correct? And so we've been trying different things. You know, last year, remember, we we tried the different things with the school kids and with the two speakers there. And so, um again, um

‸ in March. So does that mean if, um andand that's an obligation, um a good thing, traveling for the FM, that's the Florida Mayor's Conference, I think, the FMIT. we increased the local preference from three to five i mean i thought that it might help but apparently it is not helping at all so what what can be done to help the local preference for businesses to receive those bids is that should we increase it more um or is the
um it would appear that a lot of the work that we're requesting bids for is beyond the capability of companies that actually exist in the city of cocoa and or they're not submitting a bid and so we do use a um software program called vendor link where vendors can go and register to get bid notifications um we could possibly put that out on the uh city's website i know it is on there on one point but perhaps we can do a social media blast just to ‸ put it out there that um there is the opportunity to register so that they would get an automatic uh email notification based on their type of business um to try and attract more local businesses. asked Chief Lamb for a response today so we can make sure we have it on the record and I also let Commissioner Tobiah know that we will be doing this because he did it this morning so I want to make sure that we have a rebuttal for for that
and I had several questions with it so I called back to the county's representative on this and said you know my job is to protect citizens of the city of Cocoa and certainly our council and one of the things that worries me is there's nothing solidified in writing anywhere that says this new committee will be in somewhere else. You're dissolving one committee, but also in ‸ the same breath, you're saying it's being handled in a different situation, but you're not solidifying that in writing anywhere. And it certainly was a good time I understand why they did it but in order to protect us to say that we would still have a say so in that committee as a city of Cocoa where is that going to be solidified in writing? So we went back and forth with that with their representative for a little while and I said well until that's in writing somewhere I'm not comfortable with putting it before my city council to say, let's dissolve this other committee. There's no protection for our community or there are citizens so on December 6 I guess they didn't like that answer, so a letter was sent

Uh, I think we are, you know, we were at that point in the meeting where we couldn't do much more, but, who or how will we address this? Can we revisit that? Or is staff working on a way that we will be able to monitor and enforce rental rate restrictions? I mean, first of all, the afford,
got in office the first time that I was called by someone from the Clear Lake Isles, uh, project that the city participated in. I think that was affordable senior housing. After six months, the rent had been raised and the complaint was, what do we do about it? And I remember at that time,
remember vaguely, I remember a conversation with Charlene, but our hands were tied. Um, so, I want to make sure that we're not caught in that position again. And I know, um, staff had this concern. So is this something that we can agree, we can ask staff to think about, bring back some potential solutions so that these affordable housing projects that we're approving that fall into this category, um, um, because there isn't state funding involved, um, that we maintain them as affordable housing stock.

we have staff that, for the most part, the professionalism, the excellence is there. And accountability. You know, to some degree, all of these things, you're held accountable. For us, it's the elections. For staff, it's evaluations. Staff are evaluated by their directors. Directors are evaluated by

previously, with Dr. P. Early on, there were no evaluations. She was only here two years. And with John, there were, I guess, a couple of evaluations. And one was as long as three years.

mean, what, I'm not, I think that was to say that it doesn't matter, but it's a contract. So, I mean, I think we have to know if that doesn't matter in the contract, what else doesn't matter in the contract? Because we are a year and four months beyond when the first evaluation by contract would have taken place. And I'm glad that you have these conversations with the city manager. I would like to have these conversations with the city manager and feel like we're moving forward.

uses as a model. I'm open to doing it anyway. ‸ That is a part of the contract that it has to be an agreement between council and the city manager. But I think it needs to be addressed. Either that or you've got to amend the contract.
you know, I really did not want to bring this up in a public meeting. Because look at that accountability. It says citizens, staff, and city council. One of the big fears up here is something like this will be hijacked for special interests. And that's not what I want. An evaluation is a tool. It's a tool to make things better. And so, you know, we do not want it used that way. But the issue does need to be addressed. This is,
‸ that can either be addressed privately or, you know, but it needs to be addressed. So, I expect to be having that conversation again then. And I have one more slide. And that is that the Zen room, which has provided Zen for more than 15 years in Cocoa Village. Probably 300 to 400 women that have taken classes there is closing. Their rent was doubled during that building right behind where the hotel was going to go. And I just want to say thank you to Kathy Johnson for providing that solace to the ‸ community. I think

I should have gotten a golf cart and came back. Because I already practiced once. It was a great time. Everybody enjoyed the speeches. And I'm glad I got to attend. We got a lot of things we need to work out in the city of Cocoa. And we're going to get them done.
when we go to the workshops is when I'm going to go ahead and give more grievances and more points of order, if you want to call it. Those things I've seen and noticed. I think that's a better format to do it in here instead of the council.
staff is doing a great job. ‸ Every time I've asked for something or needed a question, it's been answered immediately or next day. But I've always got my answers. So I have no complaints with staff ‸ all across the board. Thank you.

So that's some positive news. Something I've been dealing with in District 2, for those that's familiar with 800 North Fisk, it's a condominium located off of Fisk. And there's a

of the year to replace their roof. It's a real tough situation. And, you know, something I've been working with with those folks is trying to come up with a solution is looking like we're going to probably have to try to come ‸ raise some money from some donors out in the community.
So for anyone listening out and you're willing to lend a hand or have some expertise to help those residents out, I ask that you reach out to me and I can put you in contact.
there just to observe and check out the area and I saw a Coco PD officer patrolling the area. So PD are being responsive to those complaints going on over there. We're working with the property manager to try to handle some of those complaints as well. Something else I want to talk about is the crime.
stats are out there. There's been a decrease. You're never going to stop crime 100%. I don't care who you are. ‸ There's going to always be crime. What the goal of our police officers are to catch those back bad actors and get them off the streets. And I think they're doing a good job at that. So I commend the chief and all those police officers that work for us.

had zero murders. And that's pretty big. And I would put those numbers against any of our neighboring cities. And you go to pull their stats, check your stats. Like I said, this is not saying that we're not going to have crime. That's the police officers job to catch those bad actors when those crimes are cured.
