The City's record
What the City's record shows

Transcript Partial transcript
Machine transcription of the meeting recording. The words are the recognizer's, except where a passage is marked as corrected or machine re-recognized; most have
not been checked against the audio, so words, numbers and names can be misheard.
It describes what was said. It cannot establish who voted how, an amount or an outcome — the City's
minutes do that (above).
A time links to its passage, and “Copy link” copies that link. “▶ Play” opens the recording at that moment, on YouTube, in a new tab.
463 suspect passage(s) marked in place.
How this transcript was made. New machine transcription of the whole recording, with 22 voices separated from the audio.
48 short machine repair(s) (63 word(s)) are labelled in place, with the original words beside them: an ordinary word was replaced only where two further machine readings agreed on a different one.
Checks run on this transcript: the recognizer's own warning signs, whether a voice was detected where the words are and a language review for likely mishearings.
A second, independent machine reading was compared with it word by word: the same words for 93.3% of 18,827 content words.
Dotted words (486 places) are ordinary wording differences: hover or tap to see the other reading.
463 passages (23% of the words) are marked suspect: their words are not shown ("unclear audio") and support no statement: numbers, amounts, negation or names differ; the language review questioned them; or no voice was detected there.
Agreement between two machine readings is not verification.
Speakers were separated by voice. A plain name rests on evidence tied to that voice; “provisional” is a name from an earlier text-only pass and is not verified; “Speaker N” is an unidentified voice.

have it unanimously. Moving on to awards and presentations. I'm going to just slide my mask down just a little bit, please. As you know we're celebrating ‸ Black History this month and we have a proclamation. ‸ Our illustrious, industrious Deputy Mayor is dressed to commemorate Black History Month. So I know I will let him make a motion later on on the reports to maybe ‸ next council meeting. We dress to impress, sir. If I may read this into the minutes. Whereas during Black History Month we celebrate the many achievements, contributions made by African Americans to our economic, cultural, spiritual, and political development. Whereas established by an American historian Carter G. Woodson, the original celebration of Black History Week was observed on February the 12th, 1926. In 1976 part of the nation's bicentennial the week was expanded to a month. Whereas Black History Month 2021 theme Black Family Representation Identity and Diversity explores the

past, present, continue to forage on through these items. Building our nation, improving our city, making it a better place for all to live and thrive. It is of importance to remember those civil rights pioneers like Dr. Martin Luther King, Rosa Parks, who broke down racial barriers and inspired our nation. As well as the Reverend C.K. Would you give yourself a round of applause please. Would everyone stand? Would everyone stand please, ma'am, and sirs if you're able. I just want to say thank you to you all because
All lives outside of this room matter. It's why? Because even though we come from different tribes, you belong to one race. And that's the human race and we're all God's people. You may be seated. Thank you very much. Next on the list. One, two, three, four. We do not have the three amigos but we have the head amigo here tonight for my fire department. They will do an equipment presentation tonight. And I am a man after his own heart because we have a lot of similarities. As you can see in the haircut.
with that presentation. Thanks. Thank you so much for allowing me the opportunity to come before you tonight. I would ask Mr. and Ms. Diaz to please come up and join me there with our local firehouse subs here in Rockland.

So as some of you may be aware, last year we started a three-year replacement plan for our extrication equipment. This equipment is the stuff that we use to cut victims out of cars when they've been entrapped or they've been entrapped in some other type of material where normal everyday tools would not work.
So we started ‸ that process last year and we said we're going to do a three-year plan. Each year we'll buy one set of extrication equipment and move forward until we have all of our front line apparatus with new up-to-date equipment. Last year we bought our first set pretty much like this set here in front of you. Heather with MES came out and gave us a real good demonstration on it and really told us the pros and cons behind it and ensured that we would be getting a set of equipment that would last and service the city for quite some time. So Chief Siebert and Lieutenant Slaughter did all the research behind the equipment to ensure that we were getting what we were looking for. So we bought our first set last year. This year we were getting ready to buy our second set and Chief Siebert and Lieutenant Slaughter said, you know, why don't we try for the Firehouse Subs Grant? Firehouse Subs does a great public service with what's called the Public Safety Foundation Grant. They provide equipment to organizations across the United States and certainly here in our local area from fire rescue to EMS all the way to our police department.
safety and serving the community. I'm proud to say that the two founders of that organization I actually worked with out of Jacksonville. So I've known them for quite some time and certainly every one of their ‸ stores embellish and really circle around what ‸ that whole grant process is about.
here in Rockledge. And they contacted us. We brought that before the city to say that we want to apply for it. They contacted us a few months later and said they were ‸ pleased to announce that we have been approved for $35,000 to purchase this extrication equipment. So not only did we shorten our three year span on getting this equipment on all of our frontline trucks, we were able to get two sets in one year and get our entire fleet up to where it needed to be with up to date equipment and the best tools that our city demands of our fire department.

not have been, we would not have been able to make this accomplishment and get these tools as quick as we did. So my hat's off to Firehouse Subs. Certainly again, I'm going
in Rockledge truly is amazing in what they do for our first responders and support them in any way that they can. So this is our equipment here in front of us. This is $35,000 that you're actually looking at. Over to your right hand side, your left hand side, my right hand side is what's referred to as the jaws of life. Those are the spreaders that we use to actually open doors, move things, all that. Over to the left hand side, my left, your right is the cutters and then some other tools that go along with that. So I just wanted you to see not only what $35,000 of taxpayers money does, but what $35,000 of a joint relationship with a private organization does to protect our community and certainly support the fire service. So this set specifically was a set did not

So thank you, Mr. and Ms. Diaz for all that you do. Certainly thank you to our representative from MES because she ‸ has been a godsend and working with us to ensure that we get the quality of equipment we need for our community.

boldest, and the baddest civil rights organization in this country. So I'm here tonight to thank the city of Cocoa for doing an outside search for a new police chief. Because as of right now, this is Black History Month, and there's not one black police officer that's a member of the Cocoa Police Department that's in leadership position. And that's despicable. So I want to encourage you to keep on with your search.

great city of Cocoa. Thanks to the foresight of City Fathers, a number of years ago, here in the city of Cocoa, we have something called Riverfront Park. And Riverfront Park is one of the best event venues there are around the state of Florida. And we're going to put that to good use here this coming Saturday with an event called the Cocoa Village Brewers Bash. It is the second annual event. An

come and rinse your cup off before you go to a booth. All the booths will be equipped with sanitizing dips so that we can keep everything as safe as possible. We're going to do registration in what we believe to be as no contact as we possibly can.
We will have cash tickets available at the door. We will handle those with kit gloves. Please all come out. Come one, come all. Very few good events around the state of Florida right now. We can do one here.

zoning map designation of one parcel of real property totaling 15.74 acres more or less and generally located on State Road 524 directly south of State Road 528 and west of East Industry Road in Cocoa, Florida. More particularly depicted and legally described on Exhibit A attached here to from the general commercial CG to plan unit development PUD providing for the repeal of prior and consistent ordinances and resolutions severability and an effective date. This is first reading and also a public hearing item.
But before staff gets into the presentation, I just want to note there's also ‸ a proposed development agreement that's running along with this ordinance. The intent is that the development agreement would be considered for final approval during second and final reading. So there is a draft that's substantially complete. There's a few minor revisions based on a conference we have with the developer on Friday that would have to be made. But I just want to note for the record that the ‸ agreement is not subject to final approval tonight. It's going to be subject to final approval during second reading.

There is, as has been alluded, a larger project involved with this. And so you will next next meeting be hearing from staff with a binding development agreement, the second reading for the rezoning, a final plan unit development and also a preliminary subdivision.
large scale site plan at their meeting last week and recommended approval with conditions, all of which are in your your staff report. So the property is in the red box here. It is, as has already been stated, the former Winn Dixie.
The rezoning to mixed use PUD would apply to not all of the site. So I just kind of wanted to point out that area. This is the potential subdivision, which would create two parcels.

They have to replace at a certain DBH based on that. It's just kind of a sliding scale, if you will. So some of those replacement two and a half inch trees need to be larger in order to satisfy that part of the, of the code requirement.
right? And the other things we're doing are great. They're on the outskirts, but actually taking a neighborhood inside. And when we see that start happening, it's just, that is, it's the first project since I've been here, I think that has been in.

we got a, uh, inspection passed every six months that we would, uh, our permit would still be good. But as we moved along, the last $40,000 permit inspection, I got passed.

So, uh, per council's direction at the priorities workshop, uh, we initiated ‸ negotiations with waste management on a possible extension of our current contract. With that, we're seeking to continue the negotiations for a two-week period with waste management for solid waste services for customers within the city of Cocoa. I know representatives from waste management are here as well if you all have any specific questions.

paying. And that will not change because we said that we would keep the service the same. However, we would take a look at some of the costs. One of them is fuel. I don't have to tell you where diesel fuel is going. It's going to go sky high. We are running all of our trucks on CNG. That is a huge savings in itself. She was able to see firsthand what we're talking about in terms of trying to reduce contamination and keep recycling viable. So we really appreciate her time that she spent with us. But she's absolutely right. There have been dramatic changes that have happened with regard to recycling, not only here locally but ‸ globally as well. And as a company, we have heard from the top down that waste management is absolutely remaining ‸ committed to recycling. It is something that we pioneered back in the 1970s. ‸ It is something that we remain committed to because our customers want it. So we are doing everything we possibly can to keep recycling viable. And hopefully in a couple years, Councilwoman Koss, I'd like you to bring back through our MRF.

We are looking at ‸ the grassroots effort to try and reduce contamination at ‸ the consumer level. What can we do to help our residents understand why reducing contamination is important? So that's one avenue. On the other side, we are looking at different technologies, either technologies that have already been developed or are in development now to really put together the next generation of the MRF, of the material recovery facility, to develop technology to get the contamination out of the recycling before it even hits that ‸ pre-sort line. So we're looking at it from both ends. So absolutely, we are fully committed to maintaining recycling. And we know that you are a fervent recycler, and we really appreciate all your support with that.

brought this many times before Council. I would imagine some of you becoming experts, I hope, but to refresh your memories, it's simply, as easily as I can state, it's a soft fiberglass sock that's inserted into an existing pipe without digging it up, using heat, chemicals, and pressure, hardens inside the pipe, becomes like new, increases the velocity in which water or ‸ wastewater can flow. A real big savings for us was about the seventh year, I think, or sixth year that we've done this.
the city of Cocoa, and we're looking to do about, we average about two miles a year. And so this is a multi-year, so we would be relying on this contract for another two years and then coming to Council, obviously, to allocate those funds each year. So I'm here to answer any questions you might have about the process or about the proposal.

guess two items. I guess yesterday, if you hadn't been paying attention, the news, there was a fairly large story that hit national news about a water plant that had a security breach in their IT cyber system. So I'm here tonight. I believe we've already released a small press release on our website. But
who are listening that we have a very robust cybersecurity program that's in place and has been in place. Actually was approved under your leadership, Mayor, when we did the expansion and the replacement of the SCADA system, if you remember that,
when you were still on council. You were the mayor. So we have a number of layers of security that we have in place, and we are very confident that that system was actually designed with the Homeland Security and their survey that they had done when they come to our plant. And, of course, we followed all the NIST guidelines through ‸ the IT department for that execution and that architecture.
We have a number of protocols that are in place that will protect our plant from something like that happening. The second item is simply we're starting to put out in the mail, ‸ in the actual bills, the notification on the chemical change that we had talked about. So I'll probably remind us over the next four weeks as

have about four cycles of notification, which will take us about a month. And then we'll actually make the change the first or second week in March, and then we'll maintain that for about three to four weeks and then slowly go back to the chloramine system that we'd previously done. Those, that's essentially, if you have any questions, I'm here to answer those as well.

doing a Black History Celebration at Riverfront Park on February 25th. And so I wanted to, this event is typically held at the school. ‸ They were looking for an alternate site this year for COVID restrictions to get it out in the open. They have the chorus and the orchestra performing on the main stage. We'll have some chairs ‸ outside for them. We do have a concert that is planning on coming in that weekend. They'll have a tent up that they said they could use. So we'll put the chairs underneath the tent. So as you, some of you may not be aware, as our current ordinance is written, any fee waivers must be approved by Council. We are looking in the future to eventually change that and give some ‸ discretion to the city manager. But for the time being, we do need to get a consensus from Council on waiving the fees associated with that event.

Wonderful. Okay. So my second item is, um, I wanted to just bring to your attention, um, and get also kind of a consensus from Council. Um, back in July 2019, um, the Rosa L Jones family had reached out to us about doing, um, originally it started as a traffic signal ‸ box wrap, similar to what we've done for, um, throughout the city. They wanted to do one in honor of, um, Ms. Jones. Um, and, um, so they raised, they did a GoFundMe page and they raised the 1500, originally it was the $1500 for a traffic box wrap. They actually raised $5,000.

Um, they would work closely with our public works department to ensure the safety, um, of motor vehicles and pedestrians in that ‸ area. Um, we also, the other thing that we talked about is making it so that it is movable because there are plans to redo that area in the future. And I would hate to see something that would have to eventually go away. So it would be something that we could put back once that project has been completed. Um.

Yes, sir. Currently, the police department, um, participates in a program through the drug enforcement agency, and it's a drug take back initiative. Uh, this is a program by which, uh, community members can bring in their expired prescriptions, prescriptions that belong to deceased family members that they, they need to get rid of. They bring it to the police department. They bring it into our lobby. They place it into a locked box, and we dispose of it for them safely. Brevard County has had 31,006 cases with 681 deaths. The city of Cocoa has had 2791 cases. To date, we currently have 77 active cases within the city limits. That's the ones that fall within that 10 day timeframe. So talking about total vaccinations for the entire state of, or sorry, entire county of Brevard County, 72,849 vaccinations have been given out.

City Hall. We'll be running the program again from 10 o'clock in the morning to one o'clock in the afternoon to help our citizens who need help signing up to get on the waiting list for the vaccinations. So we would encourage each and every one of you. If you know that there's people in your districts. I know that there's a phone number and a website, but they are really struggling with it. Please do not let them struggle. We had some great volunteers that came out and helped us for our last one.
a.m. to 1 p.m. We will actually be doing that again to help our citizens get registered or get on that list. So they'll be notified as soon as vaccinations are available and they're ready. Many of you may have saw that the governor came out with a press release talking about the Walmart and Publix will start giving out vaccinations now. So that program will start later on this week. They haven't announced the official date of when that's going to start this week, but we're staying diligent on top of that.

It will be our Sam's Club. Samantha will be working hard to push out that information once they say signups and registrations ‸ are available, but you do not have to be a Sam's Club member to register for a vaccination. That's very important. I pulled it up on the site this afternoon when that announcement came out and
That was work through Brevard County Emergency Management and the governor, and that's to reach out to our population and areas that really need to get the vaccination, don't have any other means, and that's through five of our local churches here. So that

And more importantly, it's a tough time for our local ‸ leaders because people really want to be vaccinated. They want to get that vaccination. They want to do the right thing. And it seems like that it's not coming out fast enough, but I can assure you we're not going to take it laying down either. ‸ We're pushing every single day, eight, nine hours a day to do whatever we can as a city to try and get those vaccinations here in our community, especially to those who really need it and can't get out or they can't go to a public. They can't go to a Walmart. They don't have the means to be able to get on a computer and sign up. So I'll get off that soapbox, but that's where we're at.

Yeah, I think I had a discussion with a couple of people in the neighborhood. They don't have access to computers. And I think sometimes we assume that people have that access, and some people just don't know how to use the Internet. ‸ Tomorrow we have a, with the police department,

know your feelings on it, city manager. So if my city manager, you know, when he started speaking about this project, he has displeasure even talking about it. Um, so I feel like we're wasting our time. In my opinion, I do believe in opportunity to give them opportunity to see the proposal. Mr. Garganese or Mr. City attorney, Mr. I mean city manager, if they cannot meet these guidelines, is there a certain amount of time since we, we, we've given the parameters to abide by, if they do not meet that, then we would automatically go out to ‸ RFP. the previous draft versions, but again, that's sort of front and center here. If it was, then, you know, that's that sort of standard hat for, for these sort of deals there.
again performance bond is there. The project timeline, theirs was open-ended It was three phases and open-ended Well, never should have been open-ended But as we sit here going on three years later, it certainly shouldn't be open-ended at this particular point in time and
it in one phase and we think that you can do it within 18 months. So those are, those are the differences, are not between what was previously discussed, negotiated or written in draft form, but again, never presented to this council and so ‸ I don't know how the developer could claim that there is agreement that, at this point can't be changed because again, the only agreement that's in place is the agreements that you would have proved you would have seen. And as, uh Councilman Dial mentioned, you know, there is, there is a catch if, if you were to go to approve this action. And that is, you know, the city is not going to incur the costs for the removal because they're going to be borne by the individual who's going to take and use this. And, and, and also there, you know, there's an economic development repurpose of this surplus property. So there is an economic benefit to a local business related to it. So, you know, if you, if you approve this motion, um the record needs to reflect that it is surplus, um that the city is, uh not going to incur the cost, to remove and dispose of it. It's going to be borne by the private individual and further that private individual needs to use it for the economic you know purpose that, um she represented to the city.
i don't want to set a negative precedent because the key word again is surplus and you all are all correct. If we remove it, it will cost us our arm and two legs. So with that, chair's going to call the question. All in favor by saying aye. Aye. Any nays? I have unanimously. ‸ Okay. um
