Transcript Partial transcript
Machine transcription of the meeting recording. The words are the recognizer's, except where a passage is marked as corrected or machine re-recognized; most have
not been checked against the audio, so words, numbers and names can be misheard.
It describes what was said. It cannot establish who voted how, an amount or an outcome — the City's
minutes do that (above).
A time links to its passage, and “Copy link” copies that link. “▶ Play” opens the recording at that moment, on YouTube, in a new tab.
380 suspect passage(s) marked in place; inspection incomplete: language review.
How this transcript was made. New machine transcription of the whole recording, with 20 voices separated from the audio.
40 short machine repair(s) (50 word(s)) are labelled in place, with the original words beside them: an ordinary word was replaced only where two further machine readings agreed on a different one.
Checks run on this transcript: the recognizer's own warning signs and whether a voice was detected where the words are. Not completed: language review.
A second, independent machine reading was compared with it word by word: the same words for 90.7% of 15,225 content words.
Dotted words (509 places) are ordinary wording differences: hover or tap to see the other reading.
380 passages (22% of the words) are marked suspect: their words are not shown ("unclear audio") and support no statement: numbers, amounts, negation or names differ; the language review questioned them; or no voice was detected there.
Agreement between two machine readings is not verification.
Inspection is incomplete: language review.
Speakers were separated by voice. A plain name rests on evidence tied to that voice; “provisional” is a name from an earlier text-only pass and is not verified; “Speaker N” is an unidentified voice.
As they do business for this great city of Cocoa, we thank you for those that have come to help that go along well and the citizens that are here as well. So we ask for your blessings. In Jesus' name we pray. Amen. Amen.

This particular part of the statute is very short. It tells you exactly what you can do as far as safety, liquidity, and your return on investment. It tells you ‸ that safety prioritizes everything else. You should have everything liquid, so if you need to get to it, you can use it. And then, of course, a competitive return. We also follow for our investment policy 415. Now, 415 is a little bit.

But basically, 415 lays out the guidelines and tells you what you can do as a municipal government, what funds you can invest in, and what funds you should avoid. We actually... The statute actually talks about derivatives.
that is well-versed in derivatives. But everything else is kind of open to interpretation. We have our... We follow the guidelines of our investment manager. And so this just basically tells us what we can do with our policy. The city has money in four different banking institutions.
We use Community Bank of the ‸ South for our disaster funds. We use the State Board of Administration just to be able to diversify so that we don't have everything in just one or two accounts.

managed funds. Those are held in trust. And that's the piece that Mr. Whithome is going to talk about. At SunTrust Bank, we have it for operating payroll workers comp.

the fire stations. Right now, the approximate balance is almost $41 million at SunTrust. That will go down to about $33 to $35, depending on the monthly operations. That's normally about what we have at SunTrust. We also have disaster funds or hurricane funds at Community Bank of the South.

certificates of deposits. And then we have a little bit more in the money market account. That money would have been available to us for Hurricane Matthew. We made arrangements with the bank. If we ‸ would have needed it, we could have gotten to that money pretty easily. Then we have State Board of Administration or the SBA. The city uses this mostly because it's extremely liquid. These are all operating funds. And we use it just as an option. They actually have a pretty decent rate of return. If you remember, maybe about five or six years ago, the SBA ran into a little bit of difficulty. They've completely recovered from that, and we actually get a pretty decent return.
Nope. I'm going to have Dave come up and talk a little bit about the managed funds. He's going to talk about... We use a combination of passive and active portfolio management, and he's going to explain what that is. He's going to talk about the importance of diversification. I think we're very well diverse. He's going to talk about our investment policy and how that was written to keep us extremely diverse. He's going to talk about the market outlook. We've had, as you know, a rate in increase. The feds raised the rate interest rates ever slightly, but that does affect our portfolio because we're mostly a fixed income portfolio. So it has a pretty good effect on what we do. And then he's going to talk about what we do to strategize and minimize the losses for the city so that we don't have any losses.
Thanks, Terry. ‸ Thanks for giving me some time. ‸ You know, it's my first time before the council. The person who was here before me, she actually retired in January. So she had been with us about, I think she'd been with us 15 years. So I'm from the main office up in New York, and I'm with Insight Investment. And Insight is actually part of Bank of New York. ‸ We're one of their investment advisors that works specifically with the public sector.
So let me just talk about the market and the portfolio. I do want to quickly touch on some of those points that Terry talked about. When we look at the portfolio, one of the ways we help our clients keep their portfolio safe is by diversification, not having all of your eggs in one basket.
as Terry said, some of your funds are short, and some of your funds are invested a little bit longer term. And that helps insulate the portfolio from some of the market movements. Now, the longer term assets are the piece that we manage. And we want to spread those out so that they're not all in one chunk, but they're kind of laddered out across different maturities, so that you always have some liquidity coming due so you can meet the expenditures that you have at the city.
whole long verbiage on the market outlook. I left some books over for anyone who's interested in all the details. But things have changed rather dramatically, I would say, over the last year in the economic outlook for the ‸ country and for the world ‸ at large. Interest rates have finally started up. You can see where interest rates were on 12-31-2015 in that light green line in the top graph. And you can see they've all gone up all the way across the board from three months to out to ten years in terms of maturity. Interest rates are up overall. And the federal funds rate is driving that. And the Federal Reserve just met, and
Flag: words were replaced by a machine repair · 00:08:08–00:08:08 · machine repair: words replaced where two further machine readings agreed (not checked by a person)
talked about possibly raising interest rates as much as three times this coming year. That's something unusual because we haven't seen rates rise for a while. Rates have been down since the last recession back in 2008, and rates have been very, very low. You've seen that in mortgages. If you've refinanced your house, you know that the interest rates are really low.
are very, very low, and they're not getting a lot of income back from their investments. ‸ Now, all by state statute, as Terry was speaking about, all of the investments that we are allowed to go into for the city's portfolio are all fixed income securities. So they're bonds. They're varying types of bonds. Some are treasury. Some are government agency bonds. And they're different. And actually, we have a few corporates in the portfolio, high-grade corporate bonds as well. But they're varying types, but they can't go out too far in terms of maturity. And so that kind of limits the interest rates that we can pick up on those bonds. So it's really good news that the economy is improving across the country and really across the world, because that's starting to raise interest rates up.
next part of the year. Part of that is because gross domestic product or GDP, which is a measure of economic activity across the country, that's been up. And, in fact, it was up in the

making ‸ a lot of shipments? ‸ And they tell these people in the surveys. And so that's kind of a predictor of future economic activity. As you can see on that graph, on the top graph, that's been going up as well. One thing that we have to be concerned about a little bit is in the bottom graph, that's the Consumer Price Index, and that's a measure of inflation.
go back up again. So we are starting to get a little bit of inflation out into the economy. Both of those things mean that very likely we're going to have some ‸ rise in interest rates, which is good for the city's portfolio because that brings you up additional income, right?

So let's talk about the portfolio and how we've done performance-wise. And we're going to look at a number of different portfolios. And the first one we're looking at is the operating portfolio, but they all have sort of similar performance. The benchmark on this portfolio is the U.S. Treasury's one- to three-year index.
Flag: words were replaced by a machine repair · 00:11:56–00:11:57 · machine repair: words replaced where two further machine readings agreed (not checked by a person)
both since inception on a short-term basis and on a long-term basis. So that's good for the operating fund. And we've done the same thing in restricted fund number two. Very similar sort of results because it's got a very similar benchmark and managed in a very similar way. And also on the reserve fund number three. So the performance has been very good over time. That's primarily ‸ because we are not just a passive manager, but we are also actively managed. We shorten the portfolio up sometimes when we think interest rates are going to rise, and sometimes we'll go a little bit longer in the portfolio if we think then interest rates are going to remain low. So we might as well take some advantage of moving the bonds out a little bit further in maturity. But right now we've been shortening up that portfolio because we think interest rates are on the upswing. So that's part of our active management strategy. And, you
three-month treasury bill, which has been really, really low in terms of performance. And, you know, we've outperformed it for a long period of time since inception. I don't think we've actually had this portfolio open up as long as five years, as long as some of the other portfolios. But when interest rates were so low, Terry said, you know, I don't need to keep all of my money liquid, but I don't want to move it all out too far either. So we came up with the idea of the enhanced cash portfolio, which means it's somewhere between the long-term portfolio out in that sort of one-and-a-half to two-year area, and it's not overnight.
This account was opened up about three-and-a-half years ago, and it was due it's strictly utility fund. Utilities had an enormous amount of cash flow at the time. And so it was decided that we would open up this enhanced cash, which is extremely liquid but has a high yield to it. So it's been doing very well. We've been really, really happy with it. If we need to, that's the account we go to to pull to make debt service payments twice a year. So it makes enough money we can actually pull from it and still have plenty to make the debt service payments.
Because of the way that portfolio is laddered, it has a lot of maturities coming off all the time. So if Terry needs one of those maturities ‸ for debt service or something like that, it's available. So that's ‸ kind of a balancing act. That's why we don't want to lock it up too long into one of the longer-term portfolios. You know, just to close up, I just wanted to say, as I said about the economic activity, it is picking up. So when economic activity picks up, that means interest rates are going to start to pick up. Now, we haven't seen higher interest rates for a long period of time. Anyone that's gone out and done a car loan or anything like that, you know, rates have been very, very low. But we are going to start to see that. That will mean more investment income in for the city. Now, when I say more, you know, interest rates are still pretty low. So
Flag: words were replaced by a machine repair · 00:15:32–00:15:33 · machine repair: words replaced where two further machine readings agreed (not checked by a person)
be marginally more. But hopefully, if we can, you know, if interest rates go up and they double over the next year or so, we'll have double the investment income for the city. So that helps. That's really good.
Flag: numbers, amounts, negation or names differ between the machine readings · 00:16:35–00:16:38 · unresolved: the words are not shown (unclear audio); listen to the recording
‸ It's in a trust account that's managed through Insight Investments. ‸ And we talk with them at least monthly. We try to have quarterly meetings with them. We have an investment committee that meets with them. So with SunTrust, we do have daily conversations with SunTrust. But it's completely segregated. They have all the operating funds. That's what we need to make payroll and all that stuff. So what he has are, like, the restricted funds, money we have to set aside for bond covenants and then things. And then he also has surplus operating funds, like, ‸ for example, the utilities fund. That's all surplus operating funds. We can't earn as much as SunTrust would pay us to have that money at SunTrust. So we literally move it to Regents Bank where it can get managed and earn us a higher yield.

a lot of it was due to the election, believe it or not. People were just uncertain what's going to happen. Now, since the election, there's more certainty. All of a sudden, ‸ some of this economic activity that was held up and people now have at least more clarity with what they're doing and they're trying to figure that out. So some of that economic activity that was held up is now freed up and taking risk.

many discussions and reviewing other municipalities in terms of the composition, the ‸ purview, and things of that nature. So we're currently in the process of continuing to review those, and we'll be working with the city attorney. And at such time, we're ready to proceed forward, ‸ and we will endeavor to get it done quickly. But as you, I think,
aware, there's been many other pressing needs within the police department and immediate, and I'm not aware of any incidents where there's been complaints, and
where there's been any issue, as described in the memo, of, I guess, bloody use of force or police conduct. So we are committed to having a very transparent and accountable police department, one that responds to the concerns of the citizens and maintains law and order in a professional and respectful manner. And we will follow, continue to follow up on this, do our research, work with the city attorney to bring this matter back. It's an item that the city council and the community identified long. Again, we adopted the plan in May of 2016. We're in the implementation phases of many components of the plan, so we will get that done. I don't have a certain time frame.

Short report. Okay. This boulevard construction is nearing completion. We will be striping the road in the next few weeks. FPL has promised us they would get the LED lights up this month. I'm not going to hold my breath. They were supposed to already have them up, actually, and they were delayed on another project before this. So we're at the whim of FPL, but they have assured us they will get to them.

They're all on the east side, but ‸ FPL feels that it'll sufficiently light the whole corridor. Wow. So it'll actually extend from Ohio Street all the way to Dixon. I think we're putting 50 additional lights in there. So once they get started, it'll be noticeable at night once they're done, but we're ‸ still waiting.

Yeah. I'll just provide a quick waterfront update for you. We've been receiving some requests from some of our citizens and interested parties regarding the state's grant funding for the derelict vessel removal. As you may recall, during the last year's legislative priorities for the city, we had advocated for state-level support for derelict vessel removal, which they approved. And kind of divided up into two grant submission processes, of which one has been completed.

which the county is following up with FEMA and going through the process for the funding and removal of that vessel. Now, there is a ‸ second ‸ grant ‸ is opening, and it closes April 30th. And it's my understanding the county will be submitting another set of vessels for removal. We may I'll get with them and see if we can get the vessel that sunk during the hurricane in that process as well, so we can see more immediate action on it. Of greater interest to the city, though, may be with the conclusion of the anchoring and mooring pilot program that's been going on for a number of years, there are a series of recommendations to the state legislature to implement in this upcoming session. And those, you know, provide local governments enhanced ability to enforce ‸ ordinances related to vessels, whether it's derelict or those transient passengers.
They didn't solve all the problems within that study, but there are a number of recommendations that kind of tighten up the registration and sale process as well as actual mooring. So I guess we'll look to the session and see what happens.
council, I have a couple items. First, as many of you are aware, this past Tuesday, the ‸ county commission at its meeting considered two, at least discussed, but, you know, considered one. One was tabled, but considered one resolution related to CRAs.
over some expressed concerns regarding the content of the resolution. The city has since, I mean, there is a, I should say that they did announce on April 13th that they intend to have a meeting,
workshop at one o'clock, which is a Thursday that morning. There's a TPO meeting. The city has received public records requests from a member of the county commission, and we have, I believe I copied you all on our response to that. But I did reach out to the county manager to verify that they received it because I didn't get any return receipt from the county. So I just want to advise you on that. It's then kind of related to that. I did have an opportunity to speak with our state lobbyist, Jerry Sansom, and we talked about a number of issues. One, the future of Enterprise Florida. Two, local business tax receipts. We recently received some information, and
tax receipts to $25, you know, statewide, and what that fiscal impact would be to the city. And so it also offered up some maybe alternative proposals that he'll discuss with the appropriate, you know, members and or staff. And then we discussed the issue of CRAs, you know, as you all know,
then at the state level. So just that reminded him that we wanted to be kept prized, and if there is any committee meetings at which the CRA legislation was going to be contemplated, that he just, you know, can keep ‸ us informed.
mean, while at first look, it doesn't appear to be, you know, overly onerous, but there are some additional requirements, such as requiring easy access to local government boards, voting records related to tax increases and issuance of tax-supported debt,

Expanding public notice requirements for local option tax increases, something that this body, I don't think in my 15 years here I've seen, we've done a local option tax increase other than property taxes and new tax-supported debt issuances. Again, I don't see that in my 15 years, we've not seen that. And requiring local governments to utilize debt affordability metrics and budget statements, so much of those used by the state governments.
You know, we received it. ‸ It was ‸ from the Ways and Means Committee. It didn't indicate that there's any specific member that was pushing it. Actually, the bill doesn't ‸ have a number to it. So it was a workshop. They discussed it. Jerry and I discussed it. We're going to evaluate it, work with the finance department staff. You know, I mean, I think that last item, I think the other stuff is already out there. We can make it more easily accessible. If it's not, I think it is because our budgets for every year is there. From
all of our budgets are online. So they're there. And it has all the information. But notwithstanding, the requiring local governments to use debt affordability metrics and budget statements, so much of those used by state government,

I did receive a letter, and this happened in the prior years as well. The Brevard County is asking, you know, for their mosquito control district. They normally ask an annual basis. This year they're asking for it to be a two-year time period. They're seeking authorization to essentially, you know, in their mosquito control operations, the FAA requires that written approval be obtained from the governing body of a political subdivision over which spraying operations are conducted. We've you've approved this in the past, you know, just through general consensus. I sent a letter to them. They are asking for a two-year authorization. And again,

to provide effective mosquito control and mosquito-borne disease prevention. And so in order for them to operate their aircraft over our jurisdiction, we have to provide them a letter to that effect prior to May 31st. So if council has consensus, we'll get the letter ‸ drafted ‸ and send it off to the county.

I was very proud of our city manager in the manner in which he conducted himself at the Brevois County of Commissioners meeting the other night in regards to the CRAs. He did an excellent job.
