The City's record
What the City's record shows
Built only from the City's minutes (1450_CC_Sp_Minutes_02_23_2023.pdf). Page numbers are the minutes' own. Discussion is in the minutes' text; it is not summarised here.
The City's event listing names this meeting “City Council Special Meeting”; the minutes are headed “City Cocoa / City Council Priorities Workshop”.

Transcript of Recording of 2023-02-23 (City Council Workshop : Session1 February 23, 2023): 1,508 passages, 20,177 words
Machine transcription of the meeting recording. The words are the recognizer's, except where a passage is marked as corrected or machine re-recognized; most have
not been checked against the audio, so words, numbers and names can be misheard.
It describes what was said. It cannot establish who voted how, an amount or an outcome — the City's
minutes do that (above).
A time links to its passage, and “Copy link” copies that link. “▶ Play” opens the recording at that moment, on YouTube, in a new tab.
429 suspect passage(s) marked in place; inspection incomplete: language review.
How this transcript was made. New machine transcription of the whole recording, with 16 voices separated from the audio.
53 short machine repair(s) (61 word(s)) are labelled in place, with the original words beside them: an ordinary word was replaced only where two further machine readings agreed on a different one.
Checks run on this transcript: the recognizer's own warning signs and whether a voice was detected where the words are. Not completed: language review.
A second, independent machine reading was compared with it word by word: the same words for 92.7% of 19,586 content words.
Dotted words (530 places) are ordinary wording differences: hover or tap to see the other reading.
429 passages (20% of the words) are marked suspect: their words are not shown ("unclear audio") and support no statement: numbers, amounts, negation or names differ; the language review questioned them; or no voice was detected there.
Agreement between two machine readings is not verification.
Inspection is incomplete: language review.
Speakers were separated by voice. A plain name rests on evidence tied to that voice; “provisional” is a name from an earlier text-only pass and is not verified; “Speaker N” is an unidentified voice.
If you others, meaning council and staff, schedule is busy. So I'm asking that we invest instead of six hours, four hours, let's break it up two before lunch and then two after lunch. So I'm asking that you all consider that and I'll just go around and get

Yeah. The, um, there are several points in here where we are being asked to vote on and make decisions that are multi-million dollar, for example, the parks plan being a multi-million dollar program over many years that will impact us. I'm going to read from page 60 of the Florida Municipal Officials Manual. And these, of course, are the best management practices for legislation for municipal officers. And it's under workshops. It says workshops are not formal legislative meetings. Therefore, no official action can be taken. To allow some understanding of the status of a discussion of items, unofficial straw votes may be taken to determine the sense ‸ the council concerning each item. These votes are not binding on the council members at a subsequent legislative meeting when formal votes are taken. But they do serve as a reasonable indicator of council sentiment for council members, staff, press, and the public. So I would ask that, um, that we not be put in a position of after only having 48 hours to review document that will impact us by millions of dollars.
But in terms of the master plan itself, whereas I applaud staff for putting together the master plan ‸ for seeing ‸ the importance of viewing these projects within a plan.

without, this is such a minimal citizen involvement and outreach. I think that we would regret that in the long run. And so I am hoping that we will not, that whereas we can make our feelings known, the actual official votes on these things will be done in a legislative meeting, which are our council meetings.
that we can give our opinions, but that final decisions on the legislative items be at a formal legislative meeting, the council meetings. I ask for a second.

I don't want to bind us to that, that we don't make any decisions because I, there may be items in here where it may be time sensitive. I'm not saying that we have to make a decision on this whole master plan today or agree to it today, which

And that is the reason why we give the city manager direction and the staff. That's the reason why. So there is a, an opportunity to rectify, amend or make an adjustment. If an unknown incident may take place, something major out of the ordinary storm, earthquake, whatever, or something major that would have a direct economic impact. That's the reason why you can always amend and make the proper adjustments. And that's why we have outstanding staff. And that's the reason why I feel like we can make adjustments ‸ if deemable and necessary.

thing that you feel like we don't need to vote on and just make that in your motion for those things? Like you said, the master plan for the parks or maybe just be specific because they are, they're things that may not be on the agenda that we may discuss.
So I, yes, we have minimal today, but if we do a workshop next month and say it's minimum again, what we're going to say the same thing again, we don't have a lot of people here.
I'm not arguing. My main point is not that we don't have a lot of people here. My main point is that as a best practice, the Florida League of Cities says you should not be making decisions in these workshops. These are an opportunity for us to talk informally. The actual decision, you know, is that a legislative meeting, a council meeting. Now, of course, so as the mayor said, we can go back and change things. Well, I don't have the exact quote, but at the last meeting, there was objection. It was either the last
Flag: words were replaced by a machine repair · 00:09:26–00:09:27 · machine repair: words replaced where two further machine readings agreed (not checked by a person)
the meeting before that, when I wanted to go back and change something. So it's not quite that easy. And when we're talking about a piece of legislation, like a master plan, this will impact our city for decades. This could be the reason that someone chooses to live here or not.
Yeah. So I'm not arguing that point. I think my, my point is just make, make that motion, but make it, maybe make it specific on the thing that you feel like we should not vote on. I wish I knew what I was,
‸ But I, I am willing to amend the motion. I'd like to amend the motion that if there is something that's critically time sensitive, that we make the decision here.

Thank you. Mr. Mayor and council members, I think we presented the parks master plan to you last year. And so we never got, um, an approval of the master plan and what we're calling the planning and priorities document. So we're bringing that back to you, uh, for you to take another look at that and to actually, uh, ultimately get an approved, uh, document out there.

Again, you've seen these things before. So, and I believe that was last year. I think with all due respect to the Florida League of cities that, um, a lot of their best practices are, are, uh, are, um, preempted by your policies and procedures. I think somewhere in your, um, operating procedures, you can take action at workshops. Um, ‸ and let me, let me give you the best example of, um, me trying to be transparent with you guys.

I have that on the agenda today and, and that is, um, millions of dollars. And, and, and I told you all, uh, from the beginning that I'm not comfortable, uh, as a city manager assigning out millions of dollars in fund balances.
That's probably one that we need to get to today because. Mrs. Bowman is, um, trying to wrap up the financial statements. And so she needs to do that as, as quick as possible. I have some recommendations. Um, you know, certainly getting to that today would be great. Getting to that on Tuesday. Um, if we don't, if you guys don't, um, want to approve that, um, or accept my recommendations, that would be fine too.
didn't anticipate getting to them all today. I can take them. I think we're at a point where we can take them in any order that you want to take them in.

No, we came back and made some changes to that. That is, this is a revision of that. So, so last year, I think we talked about the parks master plan. I think it was at a, it

and we'll, we'll explain to you the, the intent on, on the formatting and how we laid it out there. So, so. Whoever has the clicker, go to the, to the agenda slide for me. So today, again, wanted to talk about the parks master plan and update you on the projects.

you guys to give us some direction on a, on a couple of things with regards to the projects there. We have the planning and priorities plan review and approval. Um, again, you guys had a extensive discussion on that last year at the workshop. Um, so, and, and let me give you who will walk you through these there. So, Bryant, uh,

ordinance, the on street, uh, or slash outdoor dining. Uh, and then this ‸ Bowman will walk you through the budget overview and I'll probably take over, um, on the council priorities and the fund balance. Um, obviously, um, you, you, you, you're required to have citizen input and citizen, uh, participation at your meetings there. So, so a lot of things to cover.
If there's any modification, I'll be able to be the on street, uh, outdoor dining so that individuals from that area could come and have that opportunity.

Um, my question was for, uh, attorney Garganese that when, if we are voting on making a decision on something, don't we have to have public input? We actually allowed within a workshop because it's the workshop to do anything.

and so, you know, this is actually obviously designed to be a discussion between council, uh, and staff and, and, uh, for purposes of giving, uh, staff direction on, on the items that are on the list there. A lot of these things you all asked us to bring back. So as we start out the workshop, I just wanted to remind you guys that, uh, right now, um, we, we are, um, in the middle of

about the program, ask any questions they had about the program and we've gotten a few applications so far, but we're just short 20 days into it and we still have another 20 days left before things are due. So I think we've gotten a lot of phone calls and a lot of good feedback.
city. Uh, next slide please. And then also currently, uh, real time going on today is a job fair, uh, over at the, uh, Dr. Jolie Smith community center. Um, fascinating thing about that is, is that there are 20 agencies over there in addition to city government, um, and all looking for, you know, talent. Um, and we all have the same, same issues there. We have a, have a hard time recruiting and retaining people there.

If you look up any municipality, including the county, every department is hiring for officers right now, because no one's at full capacity for officers. Yeah. And

and, and certainly, um, Mrs. Bowman has, uh, issues, uh, hiring, um, professionals on the finance side. So, so we're, we're all suffering, um, in the various disciplines that, that we have here. I, I, I, I wanted to, on the next slide there, we're gonna, we're gonna roll out our crime statistics for the year that just finished up. And so, um, again, you know, crime statistics are,
great news about our, our crime statistics. And so this is dual purpose there. This is to, to, to tell you about how we finished up the year, but it is also to address the misinformation that's out there. And in some respects, actually, again, put them on notice that what they're actually putting out that affects your brain. You know, I mean, when, when you talk about, uh, the misinformation on the crime statistics, that affects, uh, economic development, that affects the quality of life there. So, all the things that we're trying to do there, and you'll see that the information that's out there is just not accurate there.
this out, uh, after you, you guys look at it today. We'll, we'll have it out there on all the social media outlets and everywhere we post stuff up there.

Cocoa Police Department. I'm responsible for managing the criminal investigations division, which includes crime analysis. Today, I'm excited to share some great news with our residents, business owners, and visitors about crime reduction in our city. ‸ I hope this will also clear up some misleading and incorrect information on our crime statistics that is being presented by certain individuals. I want to first give you a little background on this data and how it is collected and submitted. Our crime data is collected through officer reports and documented in our records management systems database. Our records division is required to carefully review all reports and make sure crimes are accurately reported to the state as required by law. Each year, we submit this data as part of the uniform crime report to the Florida Department of Law Enforcement. The state reviews and certifies this data. In addition, our crime analyst, who is certified through the Florida Department of Law Enforcement, is trained to review the latest crime statistics, identify trends, and develop strategies to determine what is driving criminal activity and how to effectively deploy resources to drive crime down. Due to the great efforts of the men and women of the Cocoa Police Department, crime is being driven down. In 2022, we experienced another decrease in the overall crime rate in the city of Cocoa by 4.1% compared to 2021. This is the second consecutive year we have seen a decrease in the crime rate in our community. For the first time that I can remember in my 27-year career, we had no murders. Reported property crimes are down 7%.
2022. Sexual assault and rapes were down 66.7%. Robberies were down 17.1%. And as I mentioned earlier, there were no murders last year in our city. That is a 100% decrease. Unfortunately, because we had an increase in aggravated assaults, the rate of violent crime increased by 18.9% in 2022 compared to 2021. A closer look at the aggravated
Flag: words were replaced by a machine repair · 00:28:14–00:28:14 · machine repair: words replaced where two further machine readings agreed (not checked by a person)
shows that these are not random crimes. In a majority of these cases, the victim knew the offender. It is important to note that of the reported aggravated assaults, we made arrests in 68% of these cases.
aggravated assault crimes. Let me end by saying we wish we could prevent all crime. But we know that is unrealistic. We want you to know that when crime does occur, we are working hard to ensure
to have a positive impact on reducing crime. We have a number of initiatives in place, like our Chiefs Community Walks and Watch Programs, along with our continued community engagement efforts and outreach. This gives citizens the opportunity to become more involved and take ownership of the safety and security of their own neighborhoods where they live, work, and play. We have also taken advantage of new technological opportunities to enhance our crime-fighting efforts, including the addition of officers on electric bikes to be more visible in our community. These efforts are already yielding positive results. When we work together, we can continue to reduce crime and improve the quality of life in our community.
again, as Lieutenant De La Torre said, and he's in charge of the unit that handles crime statistics. Those are FDLE certified. FDLE certified analysts that was here before. Chief Collier came and again has to certify through the department to FDLE those numbers there. And so, you know, you can see where they're down, you can see in the one category, aggravated assaults, which is not the entire violent crime category, that those are up there. And he explained the nuances involved in aggravated assaults there. So, so just thought it real important to have the correct information out there. Um, um, so that again, we can, we can again, um,

Yep. So in, uh, 2020, I think you all know, we, we, we started with the, the parks and open space master plan. And, and that plan gave a, probably like a macro level overview of our parks, um, talked about connectivity canopy and, and how to, you know, really interconnect the parks across the city. We felt that that plan didn't address some of the immediate needs within the parks, um, which would be the reason you want to go to the park and the reason you want to connect the park. You know, just general items like drainage, lighting sidewalks, uh, within those individual parks. So we worked with Brevard County parks and recreation and also interviewed a lot of the park end users.

And if you remember last year or when last we talked about this, we, we thought it, we thought it needed to be an infrastructure, you know, because again, kids need, uh, uh, playable surfaces, you know?
before you can talk about any of the, uh, any of the, uh, ancillary, uh, items there. So, so we are in most instances, our parks, uh, conditions are such to where we, we need to go back to addressing the foundation, you know, bleachers,
Flag: words were replaced by a machine repair · 00:34:01–00:34:01 · machine repair: words replaced where two further machine readings agreed (not checked by a person)
And so within that plan, you know, we have our, our summary and overview. We have the evaluation of our existing conditions within parks, as ‸ well as the needs within those.

We have Carl Anderson, Manor, Stradley, Joe Lee, Gilmore, provost and Juni Rios. Um, what, what the summary also talks about and what really has impacted the parks within that, that administrative area is that year 2000 referendum that failed. And, and that would have been an initial investment.

um, how the county operates our parks there, but we still are, uh, the, the city. know, just my neighbors that I have, you know, many people use the parks many times with their individuals. So they're numbers. ‸ So are we, are we probably waiting this? Because there's no ‸ sense of how we're prioritizing.
that's, that's the vast majority at any of these regional parks. The league play is really the vast majority. And I, and I think whenever you see improvements at regional parks, you, you almost see the trickle down of they're not just going to redo a field. They're, they're then going to add a playground because they know parents are there with kids. Then they're going to add the walking path. The other amenities kind of follow those improvements typically. And, but you know,

Those are not related to league play. Those are addressing the core needs of that individual park and that park may service a league in certain instances as a regional park. But in a lot of instances, it's just your, I forget the term you use, passive, maybe neighborhood park or whatever we're calling those there. So, so, so this thing builds the infrastructure based on the use that's at the park.

we do go through each individual park and, and, and talk about the park, the size, just give an overview of it and then make general recommendations of it. So, you know, as part of this plan, when it gets adopted each year through the budget cycle, what we'll be looking for ‸ council is, you know, do you want to prioritize one or two parks or multiple parks and which initiatives at those parks do you want to prioritize? So we can work on the budgeting of those. Some of them are low hanging fruit, you know, putting benches in and canopy, you know, other items when you're redoing an entire park, that's obviously a pretty big budgetary item. So we just have to be able to get ahead of that and the design process and everything.

resurface the basketball court. So smaller things like that, that are really primarily for the cocoa citizens that use those parks. And then, but when you do get into those larger parks, you know, you are trying to maintain that league play and bring in more leagues and hopefully work your way to tournaments and things like that. for training grounds. So in order to be able to get that credit, we have to have ‸ at least five acres that's connected to fire station one. So when you count in the property that the fire stations on, along with the property that's vacant next to it,
that's good but we can have that excuse me we can have that conversation I think when you say chief you ‸ built that into the accreditation is is is as a part of the plan we've said to the accrediting agency that we're going to expand into that area for purposes of training facilities or
correct so to get the full credit I mean as you know councilman you have to have a fire tower well that's a huge undertaking but we can still get partial credit while we're in that movement of having that plan there by having that property. So that's part of our master plan or five year plan that we have for the organization is building that out in phases to eventually get to that fire tower so we get the full credit of it.
I've talked about other parcels and so again, you know, it's really tough to identify specific parcels there. So I think, you know, you can talk about neighborhoods. It's probably the best way to go in terms of future

So, so in terms of, uh, we're going to take you through the parks master plan. I think he probably finished most of that discussion and then talk to you about projects there. Brian, ‸ I like this one better because it gives them more details in terms of, of the actual projects.
Okay. And so we'll, we'll start with provost. So the, the direction originally from council, the, the main goal there was to convert that softball field to a multipurpose field. Um, so we, we've done that in the design. We do want to incorporate field lighting as well. Uh, removing one of the tennis courts and converting it to two full size basketball courts as well. We weren't sure if we're going to be able to fit two full size, but we were able to, to get the orientation right for that. Uh, part of the direction was to remove the standalone court. We, going through that with the designer and also some input we're receiving with, uh, how popular pickleball is right now. We thought it would be a better idea to just convert that into two or three pickleball courts. Um, we, we're pretty sure we can fit three of them there and that'll probably come out of the savings as well compared to removing that entire slab. Um, this would just be a resurface and repainting of that. And then the restroom building modifications as well. Yeah. I put the note in there and highlighted it. You know, there's a, a lot of things going on at provost that are going to cost a lot of money. So that's how we're going to position the bid.

maintenance agreement for that. That should save a significant amount of money because the lighting alone for a field, um, and then the courts, you're probably half a million dollars there by itself. Um,
much annually. Just the install. Shit. So it's lighting is typically one of the more expensive items. Um, we'd like to have that infrastructure in first because you don't want to build a new field and have to trench it up and put lights in afterwards. Um, so that, that's really the goal there. I think we've met most of that on provost. Uh, a couple of the items we're just looking for input on is, is the court colors. Um, you know, we can do the standard green courts with it.
come back to you guys and tell you how short we are on the, on the entire listing there. And then, and then we can, you can give us direction on what comes first if we can't fund it all in the, uh, in the initial budget there. Now we, and we're going to talk about this later under, under, uh, Rebecca's section. And we do have some savings from, um, projects that we've already, uh, completed. Mm-hmm.
priority parks or how we're going to address those savings there. So I do think it's good that he's getting a line item sort of, uh, quotes within that RFP on the various, uh, items up there. And so we're able to sort of, again, pick

Yeah, ‸ so part of the, the final design, we actually, cause it, it is a walking path, so we were looking to put a sidewalk through there as well. Um, and I know you talked about fencing, so part of the plan is to do the perimeter fencing, and that's something we discussed as well with your construction fence. We'll leave it in there, and then it's a value, you know, we'll value engineer portions of it and have them just put the permanent fence in. We also have individual field fencing and court fencing, just so, you know, the cross play, you don't lose basketball or something into, into the football field or pickleball as well. And you see that it's pretty normal for parks now to, to really section off each park with fencing. And, and then the county would have the ability to, to lock those individual fields. Okay. But, you know, like a football field, typically you have four foot fence. If someone wants to get in, you know, they can.

Okay. Uh, next is, uh, Bracco. So these are current pictures we've, we've installed, our, our contractors installed a lot of the exercise stations. They're working on the pads for that as well. So we're, we're hoping that's, that's done here in the next couple of weeks and,
So that's part of this. We're gonna ‸ install some of the larger Oak trees, um, ones that'll actually be able to live, you know, you want to try to get them as big as you can, but at a certain point, it gets hard to take care of them. So once we get approval for that, we'll, we'll start putting in those trees as well through there and.

‸ And so this is just kind of a schematic of what that splash pad, uh, may look like the, the water features themselves may change, but we're looking at around 11 water features. You'll have a school age area and then a preschool area, and we'll have sidewalks connecting that to the, to the rest of the park.
screen, that far right area. That was really the best spot for the pavilion. And, um, ‸ when you look at the, the previous plan for provost, um, there was actually a pavilion in that location that, that wasn't installed as well. So we're matching that plan, but we, we have to go out to bid here next month on that and, and work from there. We think we'll be okay budget wise on this one. Uh,

facility, and that will be our pump house for the splash pad and everything else. Then, uh, Stradley. So the, the main goal here was the football field and it's stormwater issues. Um, so that's really what we focused on is making those drainage improvements,
having it laser level and regraded to, to get the water outside of the field. And then actually including a new stormwater area, kind of near the entry way to that field. Uh, we,

other aspect of the Stradley project was looking at the concession building and the clubhouse building. Our staff's been in there for ‸ past couple months, making some improvements with the restroom fixtures. I believe we're waiting on, on some new doors for the restrooms as well to replace those.
And then as part of the county funding, there is an extra 200,000 there that we'll be able to use for these improvements. That's more than likely going to go to the field. That's our assumption. We'd like to tie this project with provost and have one contractor. Um, it, it'll probably lower the price a little bit

city is only doing the football field. The county is, is doing the baseball fields and softball fields. And then they're also in design on the septic. Um, I, I'm not sure where that stands. There wasn't a lot of money that, that they put towards that. I believe that was county funded as well. It wasn't coming out of the administrative board funding. So they're, they're probably going to wrap that design up within the year and then they'll have to go out to bid and, and you know, go from there. They're going to need a lift station. I think they've been working with utilities on and off on that.

so when the construction comes up, we, you know, it'll depend on what that cost is. And, you know, the county will probably tell us, and if, if they need help with it,

So the, the county's been doing some work over at Travis. Uh, they've got some budget in there for fixture and door improvements, some flooring improvements, just kind of some much needed architectural type improvements within the building. Um, I don't believe they have any major improvements outside of what they've recently done with the playground and the court there. I believe they converted one of the courts to a, a small full court. It's not a true full size court.
but what's different about that recreation center for many of the others that we have is that it has no sound cushioning. So at the point that it was built, of course, they didn't have some conditioning and you know what that is, right?
they basically, they cut down the echo. Without those, it becomes really, ‸ but you know, it just becomes miserable after a while being in that echo chamber. So, um, to get that, how would you get that on? Would that be a matter of going to that three member district?

so typically with, with the board, what we've done is the, the city would make a recommendation on some improvements that we'd like to see if that's one of them. It's, it's an easy ask and then they can, they can price it out and see what it looks like. If they can, if they can just consume that, um, then we'd have, we just ask them to go ahead and do that. If, if it's at a higher cost that they can't absorb, then it'd be something that the city could contract and install because it is our building. So the opportunity is there. I don't, I don't know what those costs are, or what's involved with that though.

um, makes it, uh, unattainable for them. So we talked about neighborhood strategy area and that isn't necessarily a part of this, although it certainly does go into the vision
And I actually have that as a discussion item under another section under your, under the council's priorities there. So I did list that out as a, as a desire,

so, and then the other thing would be landscaping, because as you recall, this was a park that it was determined that it would be a low maintenance park, that all the landscaping was mowed down. And, um, when we discussed this, I don't know if it was ‸ last year, I think it may have been last year, there was an attempt to put a line of plants up and those of all sense for the most part died.
Um, so you have very barren landscape. Um, and again, concerned by the neighborhood is, you know, being the classified as a low maintenance park now, um, and not being as attractive. So, um, we're also looking for places for dog parks.

Um, and community gardens, is this, is there potential to do any of those things? Because they do have the property that is, that is north of the actual building. That is not being used. It's kind of a, I guess it's kind of a dry stormwater storage.
If we're going to build those improvements and expect the county to do it. Uh, yeah, that's a tough conversation. So if we're going to make those improvements, then we just need to have a plan for that. The operation and maintenance of them.

But our, our issues are going to be what you guys have, you brought it up. I mean, it's, it's the maintenance and it's how you do the maintenance and how frequently you do the maintenance there. And that, that's, that's a, that's the negotiating point, the discussion point there. So, so again, uh, you know, last I talked to the parks director, they, they had presented some standards. I know that, uh, Bryant presented those to the council before, but they, I don't want to say they weren't serious about those standards, but they, they, that was the, that was the, uh, the starting point there, you know, so, so that's going to be the major issue, uh, is, is the maintenance and how often they maintain and, and those

to defer any voting on this master plan until the community can engage. ‸ 48 hours isn't enough. It's a complex process. And I do believe we have a lot of resources and experts that can weigh in that will actually help this process. So, but it's going to take us some time to dig. And I would just really, really make that plea to all of you. Please give us that chance to review ‸ and engage. That was the first thing. And then the second thing is my observation over the six months is for some reason, I feel like that this council is viewing citizens as an adversarial component. And I just want to tell you that
Flag: words only one machine reading has (possibly not said) · 01:32:24–01:32:27 · unresolved: the words are not shown (unclear audio); listen to the recording
So I would just want to let you know a few things of observations that I saw that we could probably get involved in and help you with. But for instance, my master planning expertise and I'm looking at the master plan itself and I'm seeing a facilities improvement plan and
we miss a lot of opportunities that way. The second thing I'm not seeing a short term viewpoint and a long term viewpoint. We see the short term and we're going to miss some opportunities there as well, including the fact that we're growing in population and we need to be thinking about facilities in the future as well. The other part that I would love to see and maybe I just need to dig a little deeper is the interconnectedness between some of the plans we already have in place. For example, the comp plan has an open space and recreational component to it. I'm not sure yet how it's all connected.
amazing to have more access to for the community. I'd like to see a diversification of activities and make sure that we include biking and walking and that kind of thing. And again, it could be I just need time to dig into the plans a little more. The other component that is huge on this the opportunity is to connect what we're doing to health and wellness of the community. And there are ways to do that. And there's ways to measure that.
‸ The other thing is the green space and the aesthetics. I think that we're starting to allude to that makes this a special place and seeing that component pulled in. So in conclusion, I know I've talked for a while. I just want to make a big plea. Give us the time. Please see us as resources. We're smart. We have the expertise. We want to engage. And please allow us that about that time to do that. Thank you very much. And I hope you'll consider what I said.

I'm going by the observations of the city council that I've been sitting in and trying to speak up and it just feels very almost like you don't want to hear our engagement. ‸ And also, I want to give you one other point. I have tried to reach out to the planning and zoning and when I went to find out how to get to that office,
area. So trying to learn my way around and was shut out completely from talking to the planning and zoning board. Furthermore, I actually applied for that board. I'm the only one with the expertise and master planning and architectural design ‸ was completely shut out. And he's open to talk to ‸ everybody. He'll tell you like he tells everybody else, call Kathy Frederick and she'll put you on my schedule, which she most times she won't even ask him about it. Yeah. So the whole idea and I didn't hear any accusatory language other than if you only have 48 hours. I mean, this is was only even posted 48 hours ago. ‸ This is an important community. they're called. They're at any rate actions that we're supposed to connect our parks by paths and bikeways and trails and all the things that are not mentioned in this master plan. you that the first thing that they need is a field where there are no ruts, where there's no drain in the end zone. Right. Where there is a goal post, where there are lights, where there are bleachers there.
I said last year, you ‸ this is primarily an infrastructure plan. uh There's really not a whole lot of people living out there. It's narrow access. uh With the active problems we have for CCA, we should probably not consider that.

minutes, sir. ‸ floor is yours. Thanks, sir. So when we voted before on permanency, we then went and put a lot of money into that outside area. And not only just to make it nicer, but also, Mr. Mayor, for your concerns about safety, we had them really bulk that wall up that's around it to make sure that we obviously don't want anybody to get hurt if a car happened to. So we really bulked that up andand paid some extra money and make sure that the safety measures were in there. Now, that little area makes a big difference still because people still are not totally safe. I don't know if
people feel better about coming out So, you know, all our events that we try to do here in the village are to bring people in the village. We have a beautiful place down here. And that's all our goal is. Anytime we do an event or anything, any charity work, we try to keep it right here

So we all try to work together and get every business that's around here involved into it. So I'm not sure why we're having some issues about that when
it's it's It is better for us, bottom line wise I'm not going to lie to you. And we're willing to pay for that area. But bottom line, it means a lot to us. And I think it helps us do more for the community around us, too, the more we're able to do. So, and we have added some extra parking in the area recently. So, yes, we're taking someone to parking. And I get that. I get that. But I think with that,

It was my understanding that we had had voted on this previously. And we were just waiting for direction on how to facilitate this from the city manager. I found out yesterday that

that I have from my location with people mentioning about the outdoor dining and how it brings them down here and how much they appreciate it as well. uh Again,
to strike this strike down what we have previously approved. If that is going to happen, I would uh request that this is done on a, uh with a little bit more time. So,
if i said obviously that is, but it brings more people to the village. More people to the village is not only beneficial for the restaurants, it's beneficial for the community and all the other businesses as well. I'd like to know if we are going to vote on this again, what the concerns are that is making this an issue that we're revisiting this again. If it's a safety issue, I thought that would possibly come up in how we were going to have the city manager present this to us. How, what guidelines we had to follow. Again, if a voteif a vote is going to be made on this today, I would appreciate ‸ if it ‸ be postponed to a full board meeting. We, uh this is a benefit again, not just for the restaurants, it's for the whole community as well. And, i hope to see everybody down on Mardi Gras. You'll see how nicely we decorated out the front area from Mardi Gras to get everybody in the spirits. And

group that wants to include that as a permanent basis, then you need to close all the streets in the village. And every person that's in business there can do the same thing. What's being requested now. And I have a whole corner. I wouldn't mind taking all that

and they are not supporting continuing this setup of parking being used to enhance businesses that were there. The council did this as a way to support and understand the problem about the pandemic to allow the people to still be in business. Now, if we're going to move this to a position, even if it was asked to pay for the spot, do it for everybody. You cannot do it for one or two people. So if you choose to go ahead and allow the on-street parking, then we need to go one step further and

only good for about 15 years. Do you all know that adds up to only 22 and a half million bucks? The rest of our attention in that area, even if we can get grants, should be the main priority is increasing the parking in the downtown area. That is priority because we're running out of money. In 15 years, the downtown area is not going to get that money. It's going to go. And I really feel that because the time it takes and all that, that's where we need to put our attention. Thank you. Transcript of Recording of 2023-02-23 (City Council Workshop : Session2 February 23, 2023): 649 passages, 5,911 words
A timestamp opens this recording at that passage.
150 suspect passage(s) marked in place.
How this transcript was made. New machine transcription of the whole recording, with 9 voices separated from the audio.
23 short machine repair(s) (28 word(s)) are labelled in place, with the original words beside them: an ordinary word was replaced only where two further machine readings agreed on a different one.
Checks run on this transcript: the recognizer's own warning signs, whether a voice was detected where the words are and a language review for likely mishearings.
A second, independent machine reading was compared with it word by word: the same words for 87.7% of 5,891 content words.
Dotted words (207 places) are ordinary wording differences: hover or tap to see the other reading.
150 passages (20% of the words) are marked suspect: their words are not shown ("unclear audio") and support no statement: numbers, amounts, negation or names differ; the language review questioned them; or no voice was detected there.
Agreement between two machine readings is not verification.
Speakers were separated by voice. A plain name rests on evidence tied to that voice; “provisional” is a name from an earlier text-only pass and is not verified; “Speaker N” is an unidentified voice.

a $25 fee that is renewed annually. It's only permitted as an accessory used for food and beverage sales establishments. Tables and chairs only in front of the permitted establishment, and it cannot interfere with pedestrian traffic along the sidewalk. So there has to be ample space for pedestrians to walk around each of those tables.

It was extended multiple times and then directed to make it a permanent ordinance last year. So as we move forward into the discussion on this, I'm going to show you some examples of cities that are using sidewalk cafe and or on-street dining permits. In the City of Mount Dora, they have a $100 one-time fee for their sidewalk cafe. And ‸ it has to be an eating and drinking establishment. They have to provide the city with a site plan, which includes a number of seats. ‸ The uses are not allowed during ‸ special events without city or event organizer authorization. They have no on-street dining permits at this time in the City of Mount Dora.
Mount Dora, if you've been to Mount Dora, is very similar to the Cocoa Village parking area. ‸ Most of the parking is on the outskirts ‸ of the village.

And they actually charge for their sidewalk cafe. It's a cafe seat. Fees are paid annually. If you have one to four seats, it's $80. Five to eight is $100. Nine to 12, $120.

depending on the roadway. And they are subject to limitations in each specific district. Delray Beach has CRAs, just like the City of Cocoa does. And they also have some other special districts along the beach side that have different fees in addition to what you see up on the screen. The City of Key West has a one-time application fee of $100 annually. And they have a cafe seat fees of $592.20. And you have to provide the layout of the seats and the site plan, how you're using it. And if you ‸ want to change the layout of the seats, it will cost you $50. The next one is one a little bit closer to us, City of Orlando. Again, eating and drinking establishments only. Seats and tables must be removed at the close of business each day. Must have separate ‸ contract with pressure washing companies and provide service record to the city as requested. So their cafe fees are $500 for one to five tables or up to 200 square feet, and $750 for six-plus tables over 200 square feet. And there are separate

So our Council consideration today, or when Council decides to consider this, number one, discontinue on-street dining, continue with the current on-street dining, and then establish new sidewalk and outdoor dining permit ordinance. And the annual fee as a recommendation is to

And only establishments with primary services, food and beverage sales, and they must have an appropriate license and an active BTR. And then the next part would be requiring pressure washing

public sidewalk and parking space at least once a month. Require a site plan with seating arrangements and using protective barriers if using the parking spaces. Require a hold harmless affidavit, and all existing established must reapply under the new ordinance and pay the appropriate fees. No businesses will be grandfathered into the program. And as you know, both Pub Americana and Village Idiot have protective barriers that they've alluded to and are using those as a way to meet some of the protective features along the roadways of Harrison and Oleander.
We're working on trying to establish this ordinance and how we want to create the rules for businesses moving forward. How do you want to limit or control that ‸ is entirely up to the council as we move forward with creating this ordinance?

What about insurance, Mrs. Meiderman? How do the other municipalities deal with ‸ insurance of the business ‸ if they have the sidewalks, outdoor dining permit?
Yes, sir, they do. Each of the establishments have to have their own insurance liability, depending on the city, would depend on what their requirements are. For an active BTR in the city, we do require that they have insurance. And as with most establishments, the ‸ health department for restaurants and bars does require them to have specific licensing in place in order ‸ to permit a restaurant or a bar. So we would require just to show that and then a hold harmless affidavit as well, to hold the city harmless of any incidents that would occur on that site.
didn't say that. That's okay. And all the others do ‸ have? Winter Park does not. The Delray Beach and Key West and Orlando do. Key West is very limited. Delray Beach is limited.

my research, most of these have come about from the COVID-19 era of time where they expanded their dining opportunities as well, and ‸ have enacted either a permanent or ‸ temporary. There are other cities that still have temporary on-street dining in place. Sarasota, some other cities in Hillsborough County also have ‸ some on-street dining still temporary.
‸ If a business would leave, just like any other business here in the city, they'd have to reapply for a BTR, and all of the provisions would not travel with the ‸ business. They would have to reapply for the on-street dining, sidewalk cafes,

It's just sidewalk. And part of this ordinance includes a sidewalk cafe as well, in order to establish some more criteria in regards to the cleanliness of the sidewalks. Some of our establishments keep them very clean and maintain them on a regular basis. Others do not. And so one of the ‸ purposes of doing a... ‸ Revising the sidewalk cafe and including the outdoor or on-street dining would also to include a maintenance plan that would be required of the business to maintain the sidewalk. It is difficult for public works to go in and maintain a sidewalk that has tables that are already in place, as they should not be moving those tables ‸ to do the work and cleaning the sidewalk.
really two different items, right? One is whether to continue the on-street dining, and then the other is whether we establish the sidewalk and if we had street dining.

Well, the one thing is, with it going into the general fund, it's more a streets thing. So you're recouping the cost because of maintaining the streets and the sidewalks and things like that. And then, as I mentioned, it has to do with the master plan and the CRA. You know, just like you, the CRA had to adopt a community policing type thing.
Additionally, the on-street dining and sidewalk cafe is a citywide project. So there may not... There may be other businesses, restaurant and bar establishments that may want to participate in that. And we have had...

Transcript of Recording of 2023-02-23 (City Council Workshop : Session2 (Part 2) February 23, 2023): 708 passages, 8,999 words
A timestamp opens this recording at that passage.
208 suspect passage(s) marked in place.
How this transcript was made. New machine transcription of the whole recording, with 15 voices separated from the audio.
19 short machine repair(s) (21 word(s)) are labelled in place, with the original words beside them: an ordinary word was replaced only where two further machine readings agreed on a different one.
Checks run on this transcript: the recognizer's own warning signs, whether a voice was detected where the words are and a language review for likely mishearings.
A second, independent machine reading was compared with it word by word: the same words for 89.8% of 8,633 content words.
Dotted words (236 places) are ordinary wording differences: hover or tap to see the other reading.
208 passages (26% of the words) are marked suspect: their words are not shown ("unclear audio") and support no statement: numbers, amounts, negation or names differ; the language review questioned them; or no voice was detected there.
Agreement between two machine readings is not verification.
Speakers were separated by voice. A plain name rests on evidence tied to that voice; “provisional” is a name from an earlier text-only pass and is not verified; “Speaker N” is an unidentified voice.
Thank you. Mr. Mayor, so Rebecca and I will team up on this. Actually, the directors will chime in, too, to explain the various items here. So each year, Mrs. Bowman and her staff, along with the auditors, actually reconcile the previous fiscal year, preparing the financial statements, i.e. closing the books. And so we're in the middle of that process. These numbers are preliminary numbers.
unassigned fund balance. Unassigned is not designated to a particular project expenditure there. And so, Rebecca, take us through your reconciliation and then I'll take them through the recommendations.

of fund balance are. ‸ And I start out by looking at what was the change in fund balance. This past year, we started out with about $32 million in total fund balance. And that can change the different categories of fund balance can change based on certain conditions. So for example, one item that we had that was a committed fund balance in fiscal year 21 was a million dollar loan to the CRA. In fiscal year 22, the CRA paid the city back that loan. And so that money went from being committed to a certain purpose to now it's going over to unassigned fund balance. At this point in time, I

we had already committed. Whether it was at the city manager's approval level or city council approval level. We had budget and we had purchase orders that were open for various projects that had to be reappropriated in the next fiscal year.

the unassigned fund balance due to the CRA loan. There was also a loan in a capital projects fund that the CRA paid back to the capital projects fund, which the general fund had funded to begin with. So some money was transferred back there.

financial operations manual that's approved by city council says that city manager has the authority to go ahead and assign those fund balances. And in the past, the city manager did do that, but Mr.
is more comfortable bringing these things to council and getting councils input on what is going to go into assigned fund balance. That will be the list.
Okay. So, um, as Mr. Witten just stated, this list is what will be published in the financial statements that will then in turn get presented to city council for acceptance, um, in March or April, depending on when I can get. All this information compiled and checked and cross checked. And then the auditors finishing their job and auditing the financial statements.

total fund balance, break out ‸ what we can't spend. Um, what's restricted, uh, for like external funding sources. So an example is the Jolie Smith fund, uh, the loan that section 108 loan that we took out for that, that loan specified the general

payment just in case the CDBG couldn't support it. So that's restricted. That's an external, um, agency company saying you can't spend this much of your money. Um, so I have to go through these different categories and then I come up with, okay, here's the total bucket of money that I see that, um, uh, can, that is unassigned. So city manager, what do you want to assign this money to? And so that's where I start at the top is the 16 million. And like I said, these are preliminary numbers because,

yeah, that was about a year and a half kind of went over through that. We went out to bid once we got the grant agreement and we got one bid at 5 million. Uh, so FEMA wanted us to go back out to bid. We did that. We got one bid from the same contractor again for 5.5 million. And so now we've been in negotiations with FEMA to try to have them cover that cost. It's a 2575 grant. We're trying to just have them cover whatever the overrun is, which is requiring us to go back and do a complete cost benefit of the project.
And so, and so again, very key point is, is that we, we, with this 1.1, we're literally saying to FEMA, we will cover the cost overrun. If you just hang in there and give us what you originally were scheduled to give us, even though he has to

And so establishing a program where there is a curriculum, a class over at Cocoa High for students who may be interested in public safety, where we would then take five students who are interested in being police officers, five students who are interested in being firefighters. They would have, again, the high school sort of academics on ‸ public safety. And then we would put them through ‸ the appropriate academies. We literally would fund the academy for these students and provide them a monthly living stipend.
for a number of years. I think five years, that may be a bit much. So ‸ I think others have done three years, but it's between three and five years that we would have them commit to being a firefighter or a police officer with the city of Cocoa. So I think that's a great recruiting tool. Absolutely. All kids don't want to, can't go to college. And so, you know, this would be sort of our special program to recruit those kids who are grown up here and who may have an interest in being first responders, but just simply don't have the dollars to do so. So that's the thought process behind that. ‸ Again, I know we have folks in the audience there. These are one-time dollars. ‸ So there are no recurring expenditure recommendations with regards to these dollars there. ‸ So we at least know we could do that program for one year and perhaps come out on the other side with five new police officers and five firefighters there.
Yeah. They'd have to, yeah, sign something committing to, you know, again, you know, we haven't worked out all the nuts and bolts of it there. But, again, normally it's a ‸ prorated repayment ‸ of what we put into you.

Let me move on to the next item, and that's what we're terming the affordable housing or down payment assistance program. We know that we don't get enough dollars through SHIP to service all of the folks that walk in the door. And so, this is simply a set aside

to talk to you about perhaps some of the projects that they're looking at and ‸ a commitment of dollars that would be required for ‸ the tax credit program if they did a project there. So this is ‸ sort of a designation of a pot for affordable housing initiatives, ‸ whether we do it through some of Mrs. Neuterman's programs or
come and request. This next one is not a repeat of the first one. This is actually to recruit officers that are obviously not in high school, but this is a special bonus incentive for new officers into the ‸ Cocoa Police Department and new firefighters into the ‸ Cocoa
Department. ‸ So ‸ this would be some bonus amount that actually could be ‸ put on top of the bonus amount that the state has in place and that the state will hopefully continue in the next fiscal year.

That maybe that's a, that's a fairly significant inducement to have folks come and, and, uh, and work for, for, uh, either one of our agencies there. Again, we know we
our, um, um, um, professionals, our engineers, our police and our fire there. That's another discussion. That's a discussion that, that has to occur when we find out what the, uh, what the new revenues will be. So, so this is not that discussion. I don't want the, um, the fire guys, the union guys, the police union guys to think that we, we've, we've pushed that to the side. You just can't fund recurring salary expenses with these one-time dollars there. So
in pursuit of, of, um, of, uh, recruiting more folks in public safety. What I handed to you was a memo from, uh, then commander Hankins to, uh, chief Cantaloupe that actually talks about, uh, the difficulties in recruiting and, and retaining, uh, qualified sworn law enforcement officers there. So again, this is not a new issue. Uh, this is an issue that's been here for a while. And again, we were talking about, um, this issue before the current police chief got here. Um,

Yeah, this is the, the elevation of Indian river drive, um, as well as the water quality enhancements related to, to Dixon and, and the water that we control rats, right outside that right away. Uh, we received the, the grant from the national estuary program to complete the 100% design. And then we're recently notified, um, by the state that the construction grant will be awarded to us.

and not doing any capital projects at all. So we, we fully intended the entire time. If we got the grant, we're going to have to ‸ use other grants to pay our share.
we'll have to work through the estuary program. Again, uh, the struggle with us on a project, which $3 million is not a very big project, but it is for stormwater. Each of those grants are going to have timing requirements and, and it's, it makes it difficult to meet those timing requirements. If you have to leverage one grant against another, um, and then you also run into issues where sometimes you can't leverage certain grant dollars to other grant dollars. So we'll have to be pretty strategic there, um, or we'll have to scale the project down quite a bit.
