Agenda (the City's wording)
The City's agenda for this meeting is on file (PZ_Reg_Agenda_03_01_2023), but its item list has not been read reliably by machine yet, so no outline is shown.
Transcript Partial transcript
Machine transcription of the meeting recording. The words are the recognizer's, except where a passage is marked as corrected or machine re-recognized; most have
not been checked against the audio, so words, numbers and names can be misheard.
It describes what was said. It cannot establish who voted how, an amount or an outcome — the City's
minutes do that (above).
A time links to its passage, and “Copy link” copies that link. No recording can be started from here.
251 suspect passage(s) marked in place; inspection incomplete: language review.
How this transcript was made. New machine transcription of the whole recording, with 14 voices separated from the audio.
23 short machine repair(s) (27 word(s)) are labelled in place, with the original words beside them: an ordinary word was replaced only where two further machine readings agreed on a different one.
Checks run on this transcript: the recognizer's own warning signs and whether a voice was detected where the words are. Not completed: language review.
A second, independent machine reading was compared with it word by word: the same words for 84.2% of 11,433 content words.
Dotted words (250 places) are ordinary wording differences: hover or tap to see the other reading.
251 passages (29% of the words) are marked suspect: their words are not shown ("unclear audio") and support no statement: numbers, amounts, negation or names differ; the language review questioned them; or no voice was detected there.
Agreement between two machine readings is not verification.
Inspection is incomplete: language review.
Speakers were separated by voice. A plain name rests on evidence tied to that voice; “provisional” is a name from an earlier text-only pass and is not verified; “Speaker N” is an unidentified voice.

Okay. Okay. Um, as I have it, we have, um, we need to approve the minutes for tonight's meeting. However, I'm understanding that two of the items on the agenda need to be suspended. Is that still current, Kristen?
two of the items that would be, uh, item one and two, um, that is the rezoning for Quail Ridge and the, um, appeal of the small scale site plan, um, are requested to be removed from the agenda. So, um, that could be part of the motion to approve the agenda with those modifications.
Okay. Um, can I get a motion to approve with the removal of items one and two? So moved. Second. All right. All in favor? Aye. Aye. All opposed? All right. Next is the approval of the November 2nd meetings minutes. Has everybody on the board had at least a couple minutes to look through and make sure that there's

this particular ordinance that we've referenced to change this from basically from because I'm just trying to get a further clarity of it we're looking to basically move this into the annexation of the city of Cocoa
this this area in particular as you can see if you go back here the whole area got an axe from the county to the city of Cocoa but for some reason that is unknown to me
got a zoning assignment assigned to those parcels. And now the Paradise Church is planning to build their future church at that property. They are looking to rezone before they can move on and develop a new church.

overlaying intention and the reason why I put great pause to this is because I actually live over here I know the overall overarching impact of what can transpire in this particular area because we have apartments. As you can see from thefrom the map that has been provided, we have apartments that are located here that already are already uh succumb to a parking shortfall. So they have now started to park, and the gentleman can attest, because uh barriers have been put in place to impede them from parking on this land because that's where they're parking. so my immediate concern when I started to do my level of research towards this and I'm just outlaying as to my where my thought process is when we're looking to make these zoning changes from what I'm starting to gather, we have to be in full-fledged knowledge of what it is of the intended purpose. if the intended purpose was residential then I could better understand if that was their purpose if it is to resurrect the church because once again there was one there from what I do understand at some forward at some prior point in time, how are they going to accommodate their parking? So that that's that's where I I lend to pause today because I don't think there's enough land there for proper development for what it is that they're looking for I'm all for what it is that they that they're looking to do I'm just concerned with the parking dilemma that is presented in that immediate area

we are trying to assign a zoning designation. And the surrounding properties, if you flip back to the location, the other map, the surrounding properties are generally also

And so, you know, respectfully, that would be within the purview of the Board of Adjustment because they hear special exception applications. And at that time, they would actually look at the factors for the specific use that they are proposing. For a zoning ‸ application, they do not necessarily have to commit to a particular use. ‸ So that would be something that, you know, the community can weigh in on when the specific application for a special exception is heard by the Board of Adjustment. I hope that that helps.

The house next to it and the next property, which we just recently purchased, was a drug house. And there was a lot of things going on. Eventually, the city shut that house down and tore it down. When the city tore it down,
we had a difficult time starting that process over again because our bishop who ‸ was funding and helping us in Lakeland actually passed away. And so we have been maintaining that property and keeping it clean. But the residents of that area started having difficulties because of those apartments across the street. The people were parking on that lot, not only on that lot, but the lot next to what we just purchased. Actually, a young lady was killed over there just recently before we took over that property in a car. There was a guy that was living over there, staying over there. ‸ He had all types of materials, cars, trucks, stolen cars. So the area was pretty bad. And the residents
Flag: words were replaced by a machine repair · 00:17:16–00:17:17 · machine repair: words replaced where two further machine readings agreed (not checked by a person)
We purchased that property. And since we purchased that property, what we've done is we come through and clean that area up. We have limited parking. We've asked the city to enforce the outside and the easement ‸ of that parking. So some of the residents have stopped by and thanked us.
Flag: numbers, amounts, negation or names differ between the machine readings · 00:17:48–00:17:52 · unresolved: the words are not shown (unclear audio); listen to the recording
up that area. But as a pastor, I can clean it up physically, but it needs some other work. ‸ And that's what all those young people who live across the street in those apartments over there. That is an area that is not being serviced. And as a licensed mental health counselor, as a certified school counselor, as my wife is also a teacher, we think that we have some tools to be able to help those people over in that area. So what I was proposing is not something so big. We bought the other lot to have parking because that has always been our problem is that we haven't had enough parking.

handicapped. So we were going to put those in that, the property that we just bought where the young lady got killed. That was in our mindset. Whether we can do this, accomplish this, we don't know. But one thing that we are trying to do is at least try. And so that was our purpose right now is to get a zoning and then we can deal with the other battle. We can fight the other part. And if we can get it done, we'll get it done. If we can't get it done, again, we're going to do the best we can to change an area. Because even now, since we've been over there and clean that area up, and I can tell you, you know, people pass by and they say, you know, thank you so much. Because you don't have all that parking. You don't have people in the road. The roadway is not blocked. It has been a change over there, but that's just the beginning. So we can, again, work with those young kids. That would be great. So that's our goal. That's what we have in mind. So that's what we are purposing, not to create a problem. But to solve one.

tried to do off-site. It's just a small property. That's what it is. It's a prime location, but it's just not enough room. There's a house, there's a property behind us that's for sale. It actually took us over 10 years just to get the property next door.
and I'm very supportive of it. But my question is, is that when you look further into the building and sizes, are you willing to maybe reduce it some to

And if the people of that area feel like it would be a harm, a detriment, I won't do it because I need their buy-in. It has to be a community thing. It can't just be our thing or my thing.
that I've lived in that community for 35 years. So it's not like I'm all of a sudden new and I'm making this comment. I'm well-versed, well-familiar, and I am overlaying to what my fellow board member has stated, Mr. Greenwood. I find myself in support of the motion, but I really need to have a greater clarity. And that's the reason why I pose the question, because I see things that you don't see when you're not there simply mowing the grass.

to the number of parking, but if there's not enough lighting there that could have maybe contributed to some of the negativity there, I highly recommend that you look into that and not go to what only is minimally required. Uh, consideration of a zoning tax amendment to change district regulations regarding gym and fitness facilities in various zoning districts. Currently gym and fitness facilities are only allowed within the central business district in urban mix use district. There are currently several, several of these facilities in other zoning districts where they are not permitted, and staff has received interest from other parties wishing to create new gym and facilities in the city. Staff reviewed the city zoning districts to determine the, which one may be appropriated for the gym and fitness use limitations on square footage were also included as necessary. So here we have a summary of the proposed changes without the zonings in the districts and the appendix and article section that they were gonna, um, the tax amendment is gonna ‸ say the current status of gym and fitness facilities.

‸ as stated, you know, it is already allowed gym and fitness facilities are already allowed in the CBD and there was no definition that appears added to the zoning code when that was ‸ done. So there isn't one.

there's already one existing where they're not supposed to be, then that's a problem. So I think for myself before I would approve any changes, I think it needs to be clearly defined so ‸ we know what we're talking about.
Okay. Can I just ask what is your main concern with the with the gym and facilities? I'm just trying to understand what is your main concern. When you say a

chose those particular zoning districts, we thought about where these gyms will be located and they would ‸ not affect like his concern Because if ‸ someone is at their house ahouse, if they're just a single family residential, they're not allowed to open a gym. rebuttal to that would be if we look at the the existing tree that is located on that historical property and that's the reason why I designate that a little bit different in terms of the encroachment beyond the canopy when you go to the actual root structure as it is encroaching according to what was reported and what was read it ‸ is encroaching upon this historic building so I I do stand in strong favor that this particular tree is removed and replaced with another tree because it is already the damage is substantiated already

tabled because according to the pictures and if we look at comparison the report that was provided these things are not substantiated. So it's my suggestion at this point that the particular tree on Swanee, if it is to be found through a certified arborist to be beyond the point of some type of restorative care then we will address that after we get that report as for this other one I think the eminence is already presented itself in the fact that the building itself is as well served a hundred years and I already know root tree ‸ roots expand and ten ‸ two times beyond the canopy that one would see so if the canopy itself is let's just say a 40 foot canopy because I don't have that in report at this time but then we would know that the extension of roots ‸ would be in normal occasion, two times that. So there is an eminence there, in my opinion, that should be addressed at this point for that one.

Also, I don't know if I can compete with Mr. Anderson, but my great grandfather was on the city council. You know, so they've been around. We've been around for a while.
You know, I take great pride in the city. I do observe on other boards with the Brevard County Transportation and Planning Office, the Trails Advisory Committee. I'm on that board

to that. But I was on the utility advisory board for a few years, about four years. I was the chairperson on that board towards the end for the past three years. And we weren't doing as much as I'd like to be doing. So I asked to look out and look for other boards. And Monica and everyone else was very helpful and helped me find this great board here.

Thank you, Wesley. Good evening. My name is Marcus Wheeler. I have lived here effectually most of my life. My parents migrated here because of the work that was being done at Kennedy Space Center. And thus we have remained. And I have been in the same neighborhood for a long time. I think it's important to highlight for myself that I've always been very civic minded. I think it's important as the areas under which we all reside, that we're aware of the impacts that it can present to the sustainability of all of us.

the only time I ever skipped school, which was Rockledge High School, was November the 29th, 1993. And that was the day that I chose to come to the clerk's office in the city of Cocoa to register to vote. That was it. That was very important to me and it remains an area of importance to me. I offered myself to this board because from an educational background,

Let me reiterate. I also see the efforts that need to be made in terms of business development and growth because that is the key blood to being ‸ viable in a prosperous city. And as we continue to look at our counterparts that are surrounding us, we have to be very cautious as to what we bring and how we bring if we want to sustain positive growth here in Cocoa. So that's why I did what I did to be where I'm at. That's it. I'm done.

Anyway, my, I was a graduate of 1974 from Cocoa High. Go Tigers. Went in the military, was a military policeman for four years. Got out, worked for the Department of Corrections and Sharps for six months and realized that was not going to be a career.

out of the service. And I want to be part of the solution, not part of the problem. That's why I wanted to be on this board. And you never know what else I might do. But I appreciate everybody on the board. And I asked the chairman to do this because I didn't know. We didn't know each other. Some of you did, but this is very enlightening. I can't beat Mr. Anderson on a family being here this long.

Yeah. So as you know, I'm the assistant city attorney here. I've worked with the law firm, Garganese Weiss, DeGrasse, and Salzman. I've worked with them for six years now. I grew up in Jacksonville, Florida. And then went out to Seattle and started my career there. Went to law school there. So I lived there for about 11 years before coming back to Florida. And wanted to be closer to ‸ family. So, because my family still lives in Jacksonville today. So, thanks.

So, yeah. Oh, I guess it's my turn. Well, I've been with the city three months now. So, as I know, I'm the new city planner. I'm originally from Brazil.
